<br /> a(� applicable �ederaf, state, and local �aws, regulati�ns and ordinances, including with�ut limitativn all
<br /> En�ironmen�al Laws. Trustor authori�es Lender and its ag�nts to enter upon the Praperty t� make such
<br /> inspections and tests, at Trustar's expense, as Lender may deem apprapriate to determine comp�iance of the
<br /> Property with this sectian of the Deed of Trust. Any inspect�ons o� tests made hy Lender shai� be for Lender`s
<br /> purpvses only and shal! not be �onstrued �� create any responsib�lity or liability on�he part o� L�nd�r to Trustor or
<br /> to any other person. The represen�a�ions and warranti�s Contained herein are based on Trustor's due diligence in
<br /> in�estigating �he Property �or Ha�ardous Substances. Trustor hereby �1� releases and wai�es any future �laims
<br /> against Lender for indemnity or contribution in the e�ent Trustar becomes liable far cleanup or ❑ther cos�s under
<br /> any such laws; and �2� agrees to indemni�y, de�end, and hold harmless Lender against any and all claims, iosses,
<br /> fiahilities, damages, penalties, and expenses which Lender may directly or indir��tly sustain or suffer resulting fr�m
<br /> a hreach o��his section of the ❑eed of Trust or as a �ansequence �f any use, generati�n, manufac�ure, storage,
<br /> disposal, re�ease ar threa�ened release occurring pr�or to Trustor's ownership or in�erest in the Property, whether or
<br /> n�� th� same was or should ha�e been known t� Trusfior. The pro�isions of �his sect€on �� the Deed o�F Trust,
<br /> in�luding the obligatian�o indemnify and de�end, sha�� sur�i�e�he payrnent of�he {nde�tedness and�he satisfaction
<br /> and rec�n�eyance �f the lien of this Deed of T�ust and shall not be affected by Lender's acquisitian of any int�r�st
<br /> �n�he Property, whether by f�reclosure❑r atherw�se.
<br /> Nuisance, 1Naste. Trus�or shall not cause, conduct or permit any nuisance n�r comm�t, permit, or suffer any
<br /> s�ripping af ❑r waste on or �v the Prvp�rty or any portian vf the Property. With�ut limiting the generality of the
<br /> �oregoing, Trustor will not rema�e, or grant�o any ather party the righ� t❑ remo�e, any �imber, minerals �including
<br /> oil and gas�, coa(, ��ay, scoria, soil, gra�el or rock products w�thout Lender's prior written c�nsent.
<br /> Remo�al o#Impro�ements. Trusror shall not demolish or r�mo�e any Impro�ements from �he Reaf Praperty wi�haut
<br /> L�nder's prior writt�n consent. As a candition to the remo�af o�any �mpro�ements, Lender may require Trustor to
<br /> make arrangemen�s satis�a�tory �o Lender to replace such Impro�ements with lmpro�ements of at least equal
<br /> �afue.
<br /> Lender's Right to Enter. Lend�r and Lender's agents and r�presentati�es may ente� upon the Real Prope�ty at all
<br /> reasonable �imes �o attend to Lender's interests and �o inspect th� R�al Prope�ty for purposes of Trustor's
<br /> campliance w�th the terms and conditions o�this Deed of Trust.
<br /> Compliance with Governmental Requirements. Trustor shall promptly comply with a�i �aws, ordinances, and
<br /> regulativns, now vr hereafter in effect, of aff ga�ernmental authorities applicable to th� use or o��upancy af the
<br /> Property, incfuding without limitafion, �he Americans VVith ❑�sabilities Act. Trustor may contest �n good faith any
<br /> such [aw, ardinance, vr regula�ion and withhold comp(�ance during any praceeding, �ncluding app�flpriate appeals,
<br /> so long as Trustor has notified Lend�r in writing prior to doing sa and so long as, in Lender's sole opinion, Lender's
<br /> interests in th� Prape�ty are no� �eopardized. Lender may require Trustvr to post adequate security ar a 5urety
<br /> bond, reasonably satisfactory to Lender, �a pratect Lender's interest.
<br /> ❑u�y fi� Profiect. Trustor agrees neither to abandon or lea�e unattended the Property. Trustor shall do al1 o�her
<br /> acts, in addition to those acts set fo�th aba�e in this se��i�n, which from �he character and use of the Praperty ar�
<br /> reasonah�y necessary�o prate�t and preser�e the Proper�y.
<br /> �UE�N SALE- C(]NSENT BY LENDER. Lende� may, at Lender's aption, declare immediately due and payable a(� sums
<br /> secured hy�his Deed of Trus�upon the safe vr�rans�er, withouf Lender's prior wri�t�n �ons�nt, of all ar any part❑f�he
<br /> Real Property, or any interest in�he Real Prvpe�ty. A "sa�e or transfer" m�ans�he con�eyance �� Real Prvperty or any
<br /> right, ti�le or inter�st in the Real Property; whether legal, hene#icial ar equitable; whether �oluntary �r �n�oluntary;
<br /> whefiher by aufiright saie, deed, ins�allmen� sale contract, land contract, contra�t �or deed, leasehold interes� with a
<br /> �erm greater than three �3� years, iease-op�i�n cvntract, or by sa�e, assignment, or transfer of any bene�icial in�erest in
<br /> or to any land �rust holding tit�e to the Real Proper�y, or by any other methad of con�eyance of an int�rest in �he Real
<br /> Prop�rty. Howe�er, this option sha�l not be �xercised by Lender i� such exercise is prohibited by federa� law ar hy
<br /> Nebraska law.
<br /> TAXES AND LIENS. The following pro�isions relating to the taxes and liens on the Property are par� of �his De�d o�
<br /> Trust:
<br /> Payment, Trustor sha�i pay when due 4and in all e�ents prior�o d�linquency3 all taxes, special tax�s, assessmen�s,
<br /> Gharges {in�luding water and sewer}, fines and imposi�ions le�ied against or vn accoun� of the Property, and shall
<br /> pay when due all claims for work dane an or far ser�ices rendered or materiai furnished to the Property. Trustor
<br /> shall mainta�n�h� Proper�y free of a!I liens ha�ing priority o�er or equal tv the interest o�Lender under this Deed of
<br /> Trust, except �or the lien of �axes and assessments nat due and except as a�herwis� prv�ided in �his Deed of
<br /> Trust.
<br /> Ri�ht ta Contest, Trustor may withhold paymen�of any �ax, assessment, or c�aim in connection with a good faith
<br /> dispute o�er the obligation to pay, so long as Lender's in�eres�in the Property is not jeapardi�ed. lf a I�en arises �r
<br /> is #il�d as a resuit �f nonpayment, T�ustor shall within fif�een 4�5� days aft�r the lien arises or, if a ii�n is f��ed,
<br /> wi�hin fifteen �15} days af�er Trustor has notice o� the �iling, se�ure the discharge o� the ��en, or if requested by
<br /> Lender, d�p�sit with L�nder cash or a suffici�nt corporate surety bond ar other se�urity sat�s�actory�❑ Lender in an
<br /> amoun�sufficient to dis�harge�he lien plus any �osts and attorneys' �ees, or o�her charges that c�uld accrue as a
<br /> result of a forecfasure or sale under the lien. ln any contest, Trustor shall d�fend i�sel�and Lend�r and shall sa�is�y
<br /> any ad�erse�udgment be�o�e enforcement agains��he Praperty. Trustor shal� name Lender as an additional obligee
<br /> und�r any surety bond furnished �n the Gantest praceedings.
<br /> E�iden�e vf Paymen�. Trustor shal� upon d�mand furnish to Lender sa�isfact�ry e�idence of payment ot the �axes
<br /> or assessm�nts and shall au�horize the appropriate ga�ernmenfial official to deli�er t❑ Lender at any time a written
<br /> statemen�❑f the taxes and assessments against the Praperty.
<br /> Nvtice v�Construc#inn. Trustor shall notify Lender at feast ��fteen t 15} days before any w�rk is commenced, any
<br /> ser�ices are furnished, or any materials are supplied to the P�operty, ifi any mechanic's lien, mater�almen's (ien, or
<br /> vthe� lien could be asserted on ac�vunt of �he work, ser�i�es, or materials. Trustor will up�n request af Lender
<br /> furnish to Lender ad�ance assu�ances sa�isfac�ory �o Lender that Trustor can and will pay th� �ost ❑f such
<br /> impr��ements.
<br /> PRQPERTY DAMAGE 1NSURANCE. The following pro��sions rela�ing to insuring the Property are a part of�his Deed ��
<br /> Trust.
<br /> Main�enance �f InsuranGe, Trustor shall prvcure and mainta�n po��ci�s ofi fire insurance with standard �x�end�d
<br /> co�erage endorsem�nts on a repla�emen� basis �or th� fulf insurab�e �alue �o�ering all Impro�ements on the Real
<br /> Praperty in an amaunt suf�icient ta a�oid application afi any �oinsurance clause, and wi�h a standard morfigagee
<br /> c(ause in fa�or of Lender. Trustor shall also pro�ure and maintain compr�hensi�e general liabili�y insurance in such
<br /> co�erage amounts as Lender may request with Trus�ee and Lender being named as additivnal insureds in such
<br /> �iability insuranc� policies. Additionalfy, T�ustor shall mainrain such other insurance, including hu� not limited to
<br /> hazard, business interrup�ion, and boiler insurance, as L�nder may reasonably require. Pa�i��es shall be written �n
<br /> �orm, amounts, co�erages and basis reasanah�y acceptahle to �ender and issued by a campany or companies
<br /> reasonably a��eptable t❑ Lender. Trustor, upon request �fi Lender, will deli�er to L�nder from time ta time th�
