<br /> Death or InsvtWency. The death o�Trust�r, '�he insol�ency of Trustar, the appointmen�of a recei�er far any part❑�

<br /> cvmmencement❑f any proceeding under any bankruptcy ar insol�ency laws by or against Trustvr.
<br /> Creditor vr Forfeiture Proceedings. Commencemen� ❑f fareclvsure or �arfei�ure pra�eedings, wheth�r i�y judicial
<br /> proceed�ng, self-help, repossession o� any other me�hod, by any creditor of Trustor�r by any go�ernmental agency
<br /> against any praperty s�curing the lndebtedness. This includes a garnishment af any o# Trustor's a��ounts,
<br /> including deposit accounts, with Lender. Hawe�er, this E�en� of Default shall not apply i� th�re is a good faith
<br /> dispu�e hy Trustor as ta the �alidity or reasona�leness o� the claim which is �he E�asis of #he creditor ar farfei�ur�
<br /> proceed€ng and i� Trustor gi��s L�nder written notice af �h� creditor or forfeiture proceeding and deposits with
<br /> �ender monies or a surety bond for�h� �reditor or forfeiture pro�eeding, in an amount determined by Lender, in its
<br /> sole discre�kian, as being an adequate reser�e or bond for the d�spu�e,
<br /> Breach vf�ther Agreement. Any brea�h by Trustvr under the terms o�any vther agreement between Trustor and
<br /> Lender that �s nat remedied wi�hin any grace perioc! pro�id�d �therein, including without limitatian any agreement
<br /> cancerning any indeb�edness or❑ther ohligation a�Trus�ar to Lender, wh�ther exist�ng now ❑r later.
<br /> Ev�nts Affecting Guaran�vr. Any flf the preceding e�en�s occurs with respect to any guarantor, endorser, sure€y,
<br /> or ac�ommodatian party o� any of the Indehtedn�ss or any guaran�or, endorser, surety, or a�commodat€on par�y
<br /> dies nr becomes in�ampetent, ar re�okes or disputes the �alidi�y af, or liability under, any G uaranty of the
<br /> Inde��edness.
<br /> Adverse Change. A mater�al ad�erse change occurs in Trustor's financial conditian, or Lender belie�es �he
<br /> prospe��of payment or performance af the Indebtedness is impaired.
<br /> �nsecurity. Lender in good fa�th b�li��es �tself insecure.
<br /> Right to Cure. ff any default, ❑ther than a default in payment, is curable and i�Trust�r has not b�en gi�en a notice
<br /> a�a breach of�he same provis�on of this Deed ❑f Trust wi�hin the preceding twel�e �12} man�hs, �t may be cured if
<br /> Trustor, after Lender sends written noti�e to Trustor demanding cure of such default: �1} cures the default within
<br /> tvventy ��Q} days; or �2� �� the cure requires more than twenty ���} days, immediately initiates steps wh�ch
<br /> Lender d�ems in Lender's so�e discretion to be sufficien# ta cure the defaul� and thereafter continues and
<br /> completes a�l reasonahle and n�cessary st�ps suffic�ent to produ�e compliance as soon as reasonably practical.
<br /> RlGHTS AND RE1VlEDIES �N DEFAULT. If an E�ent of Default accurs under this Deed vf Trus�, at any time thereafter,
<br /> Trustee or Lender may exercise any one ar more of the�ollowing rights and rem�dies:
<br /> Acceleration Upon Defau�t; Additiona! Remedies. If any E�ent o� Defaul� occurs as per�he terms o�the No�e
<br /> s�cured hereby, Lender may declare all Indebtedness se�ured by this Deed o�Trus�to be due and payable and
<br /> the same shall thereupon become due and payable withaut any prssentm�nt, demand, pratest vr nvtice of any
<br /> kind. Thereaf�er, Lender may:
<br /> taf Ei�ther �n person or by ag�nt, wi�h or without bringing any ac��on ar proceeding, or hy a recei�er
<br /> appoin�ed by a court and without regard ta the adequacy of its s�cur�ty, enter upon and take possession
<br /> o��he Property, or any par�thereof, in its own name or in the name of Trustee, and do any ac�s which it
<br /> deems necessary ar desira�le�o preser���h� �alue, marketability vr rentability vf the Property, or pa�t of
<br /> the Property or interest in the Praperty; increase the income �rom the Property vr protect the security of
<br /> the Pr�perty; and, with or withau� tak�ng possession �f th� Proper�y, sue far or otherwise c�lleCt the
<br /> ren'�s, issues and profits of the Property, including thvse past due and unpaid, and apply �he same, less
<br /> casts and expenses of�p�ration and c�1l�ction attorneys' fees, tv any indebtedness secured by this Deed
<br /> of Trust, all in such ord�r as Lender may determine. The entering upon and tak�ng possession af the
<br /> Property, the callection af such rents, issues and prafits, and the applicati�n th��eof shall not cure �r
<br /> wai�e any default or noti�e of defau�t und�r this Deed of Trust �r in�a��date any act done in r�sponse ta
<br /> such defaul�Qr pursuant tn such not€�e af defau�t; and, notwithsfianding the con�inuance in possession of
<br /> the Proper�y or the c�ll�ction, re�e€pt and application vf rents, issues vr prafits, Trustee or Lender shall
<br /> �e entitled ta exer�ise e�ery right prv�ided for in the Note or the Related Do�uments or by law upon th�
<br /> accurrence o'�any e�ent of default, including the �-igh�to exercise�he power of sa�e;

<br /> and ele�tion to cause T�ustor's interes�in the Property to be sold, which notice Truste�shal� cause t❑ k�e
<br /> dufy filed for record in the appr�priate offi��s o�the County in which the Property is Iocated; and
<br /> �d3 Wi�h respe��ta all or any part of�he Personal Property, Lender shall ha�e afi the rights and remedies
<br /> a�a seGured par�y under�he Ne�raska Unif�rm Commercial Cade.
<br /> Fare�lvsure by Pawe�v�Sale. Ifi Lender elects to�ore�lase by�xercise of the Power o�5ale here�n con�ained,
<br /> Lender shall notify Trustee and sha[I deposi� with Trus�ee th€s Deed o� Trust and the Note and such receipts
<br /> and e��dence o�expend�tures made and secured �y this Deed of Trust as Trust�e may r�quire.
<br /> �a� Upon receipt v�such notice from Lend�r, Trus�ee shall cause�o be record�d, published and deli��r�d
<br /> to Trustor such Notice of Default and N�tice ❑f Sale as then requ�red hy law and by this Deed of Trust.
<br /> Trustee shall, withaut demand on Trustor, after such �ime as may then be required by law and after
<br /> recordatian of such Nati�e of Defiaul� and a�ter Nv�ice a� Sale ha�ing been gi�en as required by �aw, sei�
<br /> �he Property at the time and pla�e of sa�� fixed by it in such Notice of 5ale, �i�her as a whole, vr in
<br /> separate lots ❑r parcels or items as Trustee shall deem exp�dient, and in such order as it may de'�erm�ne,
<br /> at public auctivn to the highest bidder for cash �n law�ul money of�he United States payab�e a�the €ime
<br /> of sale. Trustee sha11 deli�er ta such purchaser or purchas�rs �hereof i�s govd and su�#icient de�d or
<br /> de�ds con�eying �he praperty so sald, but with�ut any ca�enant or ►rvarranty, express ❑r implied. The
<br /> r�citals in such deed of any matters vr facts shall be �on�lusi�e provf �f the �ru�hfulness thereof. Any
<br /> persvn, inciuding ►rvithout limitation Trust�r, Trustee, �r Lender, may purGhase at such safe.
<br /> �b� As may be perm�tted by law, af�er deducting all costs, �ees and expenses of Trustee and af this
<br /> Trust, in�luding costs a���iden�e a�t�tle in connection with sale, Trustee shall apply the proce�ds of sale
<br /> t� payment o� �i} all sums�xpended under the te�ms of this Deed of Trust or under the terms o�th� Na�e
<br /> not �hen repaid, including but not limited to accrued in�erest and �ate charges, �ii} a�l ❑ther sums then
<br /> secured hereby, and �iii} the remainde�, if any, ta the person or persons legally entitled thereto.
<br /> 4c� Trustee may in�he manner pro�ided �ay law postpone sale o�all or any portian vf the Property.
<br /> Remedies Not Exclusi►re. Trustee and Lender, and ea�h o# them, sha11 be entit�ed to enforce payment and
<br /> performan�e o�any indebtedness or ob�igativns secured by this Deed of Trust and tv exercise all rights and powers
<br /> under th�s Deed v� Trust, under fihe Nate, under any of the Related Documents, or under any other agre�ment or
<br /> any iaws now ar hereaf�er in for�e; notw�thstar�ding, some or af[.of such indebtedness and obligatians secured by
<br /> this Deed of Trust may now or hereafter be other�rvis� secured, whether by mortgage, deed af�rust, pledge, lien,
