<br /> inspections and tests, at Trustor's expense, as Lender may deem approp�iate to determine compliance vfi the
<br /> Property with this se�tion of the Deed o� Trust. �4ny inspections or tests made by Lender shall be far Lender's
<br /> purpflses only and shall n�t b� construed to �reate any respons�h��ity or liahi�ity on the part of Lender to Trustor or
<br /> tn any other person. The representatians and warranties contained herein are based on Trustor's due difigence in
<br /> in�es�iga�ing the P�operty for Hazardous 5ubstances. Trustar hereby ��} releases and wai�es any future c�aims
<br /> agains� Lender for indemni�y or contribu�ion in the e�en� Trus�or he�omes liable �vr cleanup or ather costs under
<br /> any such �aws; and ��3 agrees to indemnify, defend, and hold harmless Lender against any and all �laims, Ivsses,
<br /> fiabilities, damages, penalties, and expenses which Lender may direc�ly or indirec�ly sustain or suffer resu(ting��om
<br /> a breach of this sectian o�r the ❑eed of Trus� or as a cansequence of any use, generation, manutacture, sto�age,

<br /> Nuisar��e. 1JVas#e. Trustvr shall nvt ��use, Conduct or permit any nuisance nor camm�t, pe�mit, vr suffer any
<br /> s�ripping of �r waste on or to �he Proper�y or any por�ion of the Property. Without limiting the general�ty of the
<br /> foregoing, Trustor wifi not remo�e, or grant tv any v�her par�y the �igh�to remo�e, any timber, minera�s �includ�ng
<br /> oi� and gasy, coal, c(ay, scaria, sa�l, gra�el ar rvck products without Lender"s prior wri��en consent.
<br /> Remv�a�o�Impro��men�s. Trustor shali not demolish or remo�e any impro�emen�s �rom�he Real Property w�thout
<br /> Lender's prior written consent. As a conditivn to the rema�al of any Impra�ements, Lender may require Trustor to
<br /> make arrangements satis�actary �o Lender to replace su�h Impro�em�nts wi�h Impra�ements af at least �qual
<br /> �alue.
<br /> Lender's Righ�to Enter. L�nd�r and �ender's agents and repr�sentati�es may ent�r upon the Real Property at al�
<br /> reasonable times to attend to Lender's interests and to inspect the Rea! Property fvr purposes of Trustor's
<br /> compliance with the terms and conditions o�this ❑e�d o�Trust.
<br /> Compliance with Governmental Requirernertts. T�ustor sha�� p�om�t�y comp�y w�th a�l laws, ordinan�es, and
<br /> regulations, naw or hereafter in effe�t, vf aff ga�ernmental authorit€es applicable �v the use �r �CCupanCy af the
<br /> Property, inc�uding wi�hou� limitation, the Americans Vllith Disabifities Act. Trust�r may contest in gvod fai�h any
<br /> such law, ordinance, or regula�ion and withhold compliance during any prace�ding, inc[uding app�apriate appeals,
<br /> so lan� as Trusfiar has notified Lender in wri�ing prior tv doing sa and so long as, in Lend�r's so��opin�on, Lenc�er's
<br /> in�erests in the P�operty are not jeopardized. Lender may require Trustor t❑ post ade�{uat� security or a sur�ty
<br /> bvnd, reasona�ly satis�a�to�y to Lender, ta pratec��ender's interes�.
<br /> Du�y tv Prote�t. Trustor agrees ne�ther ta abandan or lea�e unattended the Proper�y. Trust�r sha�� d� a�� other
<br /> acts, in addition to thos� acts set forth aho�e in this section, which frvm the character and use of the Property are
<br /> reasonably nec�ssary to prote�t and preser�e the Property.
<br /> DUE�N SALE - C�NSENT BY LENDER. Lender may, at Lender's �ptivn, d�clare immedia�ely due and payable al[ sums
<br /> s�cur�d by this Deed af Trust upon�he sa�e o�trans�er, �rvithou� Lender's prior written consen�, af all or any part of th�
<br /> Real Property, ar any interest in the Rea� Property. A "sale or transfer" means the con�eyance of Real Praperty or any
<br /> right, tit�e o� inter�s� in the �eal Prop�rty, whether lega�, bene�iciai or equitable; whether �oluntary or in��luntary;
<br /> whether by outr�gh� sale, deed, instaflment sale cantract, land c�ntract, �antract �fvr deed, leasehold interes� with a
<br /> term greater than thr�e {3� years, lease-option contract, or by sale, assignm�nt, or�rans�er of any beneficial �n�erest in
<br /> or�o any fand trust hvlding title �v �he Real Property, or by any oth�r method of con�eyance o� an interest in the Real
<br /> Property. Hvwe��r, this option shall not be exercised i�y Lender if such exer�ise is prohibited by federa� law or by
<br /> Nebraska law.
<br /> TAXES AND LlENS. The fofiowing pro�is�ons relat�ng to the taxes and liens on the Prvperty are part of this f]e�d o�
<br /> Trust;
<br /> Payment. T�us�or shall pay when due {and in all e��nts pri�r�� deiinquency� a!l�axes, special�ax�s, assessments,
<br /> charges �inc�uding wa�er and sewery, fines and impositions le�i�d against or on account �#�h� Property, and shall
<br /> pay when due a�� ��aims for wark done on or for ser�ices rendered or ma�erial furnished to the Prop�rty. Trustor
<br /> shall maintain the Property free of all liens having privrity a�er or equal to the in�eres�of Lender under�h€s Deed of
<br /> Trust, ex�ep� for the lien o� taxes and assessments not due and except as otherwise pra�ided in this Deed o�
<br /> Trust.
<br /> Right to C�ntest. Trustar may withhold payment of any tax, assessment, ❑r claim �n conn�ction with a good fai�h
<br /> dispute a�er�he obligation tv pay, so �ong as Lender's interest in the Property is not jeopardiz�d. I�a lien arises or
<br /> is �iled as a result �f nonpaym�nt, Trustor shall wi�hin �if�een {�5} days after the lien arises vr, if a lien is filed,
<br /> wi�hin fifteen {�5} days a�ter Trustar has notic� of �he filing, se�ure �he discharge of the lien, or i� requesfied by
<br /> Lender, depvsit with Lend�r cash ar a sufficient cvrporate surety bond or other securi�y satisfac�ory to L�nder in an
<br /> amount sufficient t� discharge the ��en plus any cvs�s and attorneys' fees, or other charges �ha��ould accrue as a
<br /> resu�t o�a foreclosure or safe under the lien. In any contest, Trustor shall de�end itself and Lender and shall satisfy
<br /> any ad�erse judgmen�before enfar�ement against ti�e Property. Trustor sha�i name Lender as an addi�ional oblig�e
<br /> under any surety bond furnished in the eontest proceedings.
<br /> E�iden�e vf Paymen#. TrustQr shall upvn demand �urnish ta Lender satisfactory e�idence of payment o�the taxes
<br /> or assessm�nts and shall authorize the appropriate go�ernmen�al official to deli�er to Lender at any time a written
<br /> s�atement o�th�taxes and assessmen�s agains��he Proper�y.
<br /> No�ice v�Construction. Trustor shall notify Lender at least fifte�n �153 days befare any work is commenced, any
<br /> ser�ices are �urnished, or any mate�iafs are suppl�ed ta the P�ope�ty, i# any meChanic's lien, ma�erialmen's li�n, or
<br /> other ��en could be asserted �n account Q� the wo�k, se��ices, or materials. Trustvr will upvn reques� of Lender
<br /> furnish tv Lender ad�ance assurances satisfactory to Lender that Trustor can and wi�l pay fihe cast of such
<br /> impro�ements.
<br /> PR�PERTY DAMAGE INSURANCE. �The following pr��is�ons relating to insurfng the Property are a part a#this Deed vf
<br /> Trust.
<br /> Maintenanc� of lnsurance. Trustor shall procure and maintain p�licies of fire insurance with standard extended
<br /> co�erage endorsements on a replacemen� �asis �or t�he �ull insurable �alue co�ering all Impro�ements o�r �he Real
<br /> Property in an amoun� su�f�c�ent ta a�oid applicatian vf any coinsurance �lause, and wi�h a standard mortgagee
<br /> clause �n �a�or of L�nder. Trustor shal� also pracure and maintain comprehensi�e general �iabili�y insurance in such
<br /> c��erage amaunts as Lender may request with Trustee and Lender being named as additianal insureds in such
<br /> liabili�y insurance po[ic�es. Additivnally, Trusto� shall maintain such other insurance, in�luding bu� not limited to
<br /> hazard, business interrupt�on, and boi�er insurance, as Lender may reasanably require. Poli�ies shall be vuritten in
<br /> form, amoun�s, cv�erages and hasis reasvnably ac�eptable t❑ Lender and issued by a campany or c�mpanies
<br /> reasonably a�cep�able �o Lender. Trustor, upon request of Lender, will deli�er to Lender frvm time t❑ time the
