<br /> Praperty wi�h this secfiion o� the Deed of Trust. Any inspections vr t�sts mad� by Lender shall he #or Lender's
<br /> purposes only and sha[E n�t he constru�d to crea�e any responsibility or liabi[ity on the part of Lender t❑ Trusto�or
<br /> �o any o�her person. The representa�ions and warran�ies contained herein a�e based on Trustor"s due di�igence in
<br /> in�estigating the Property far Hazardous Substances. Trustor hereby �1� r�leases and wai�es any �uture c�a�ms
<br /> agasnst Lender �or indemnity o� contribution in the e�en� Trus�or hecomes liable for cleanup or o�her cvsts under
<br /> any such laws; and �2} agrees�o ind�mnify, defend, and hold harmless Lender against any and all claims, Iosses,
<br /> liabil�ties, damages, penalties, and expenses which Lender may direc'�ly or indire�tly susta�n ar suff�r resulting from
<br /> a br�ach o# �his section of the Deed o�Trust ar as a cvnsequence of any use, generation, manu�acture, s�orage,
<br /> dispasa[, �elease or�hreatened release occurring prior to Trustor's ownership❑r interest in the Property, whether or
<br /> not the same was vr sh�ufd ha�e been known to Trustor. The pra�isivns of �his section o� the De�d vf Trust, �

<br /> Nuisance, Vllaste. T�ustor shall not cause, conduct �r permit any nuisan�e nv� commit, permit, or su��er any
<br /> stripping of ar waste on �r to the Proper�y or any portion of the Prop�rty. Without �imiting the genera�ity a� fihe
<br /> forego�ng, Trustor will nat remo�e, or grant to any o�her par�y the right t� r�ma�e, any timber, minerals �includ�ng
<br /> a�l and gas�, coal, clay, sco��a, soii, gra�ei ar rack products wi�hout Lender's priar wr�tten cansent.
<br /> Remo�a�vf lmprv�ements. Trustor shal( not demo�ish or remo�e any �mpro�emen-�s from the Rea� Praper�y with�ut
<br /> Lender's prior w�itten c�nsen�. As a candition�o�he rema�al o�any Impro�erxaen�s, Lender rraay require Trustor to
<br /> make arrangem�nts satisfactory to Lender t� repla�e such impro�ements with Impra�ements of at least equal
<br /> �a�u�.
<br /> L�nder's Righ�#o Enter. Lende� and Lender's agen�s and representa�i�es may enter up�n the F�eal Praperty at al�
<br /> r�asana�le times t❑ attend to Lende�'s interests and to inspec� the Real Pr�perty for purposes vf Trustor`s
<br /> compiiance wi�h the terms and canditions of this Deed of Trus�.
<br /> Complian�e with Go►►ernmental Requiremen#s. Trustor sha11 promp�ly �omply with all faws, a�dinances, and
<br /> regulations, now ❑r hereafter in effect, o� al� go�ernmenta� authoriti�s applicahle to the use ❑r occupancy �f the
<br /> Property, �nc�uding without limitation, the Americans Vll�th D�sabilities Act. Trus�ar may cvnt�st in gvad faith any
<br /> su�h law, ardinance, or re�ula�ion and ►nrithhold c�mpf�ance dur�ng any praceed�ng, including apprapriate appeals,
<br /> sv long as Trustvr has notified Lender in wri�ing prior�a doing s� and�o long as, �n Lender's sole opinion, Lender's
<br /> interests in �he Property are not j�opardi�ed. Lender may require Trust�r ta post adequate se�urity or a sur�ty
<br /> �ond, reasnnably satisfa�tory t� Lender, to protect Lender's interes�.
<br /> ❑uty �o Prote�t. Trus�or agre�s neither t� abandon or lea�e unattended the Property. Trustor shall dfl all oth�r
<br /> acts, �n addit�on�v those a�ts set forth abo�e in this sect�on, wh�ch from the character and use vf�he Praperty are
<br /> reasanabfy n�c�ssary tv protec�and preser�e the Property.
<br /> DUE�N SALE- CQNSENT BY LENDER. Lender may, at Lender's option, d�clare immediately due and payabfe ali sums
<br /> secured by this Deed of Trust upan the sale or transfer, wi�haut Lender's pr"ror wr�tten �onsent, ❑f all or any par�t o��he
<br /> Reaf Praperty, or any interest in the R�a� Property. A "sale or transfer" means the con�eyance a� Real Prvper�y ar any
<br /> right, tit[e or interes� �n the Real Prvperty; whether legal, beneficial or equitable; whether �o[untary or �n�oluntary;
<br /> whe�her hy outright sale, deed, €ns�allment safe contract, land �ontract, cvntract �ar deed, leas�hofd int�rest with a
<br /> �erm grea�er than three �3} years, fease-ap�ivn contract, vr by sal�, assignment, vr�ransfer of �ny bene�icia! interest in
<br /> or ta any land trus� hv[ding title to the Real Property, or hy any other method of can�eyance af an interes� in the Rea!
<br /> Property. I� any Trustor is a corporat�on, partnership or f imi�ed iiability company, transfer alsa includes any change in ,
<br /> ownership of mv�e than twen�y-fi�e percent �Z5°/o} o�the �oting stvck, partnership interests❑r lim�ted I�abili�y company
<br /> interests, as the cas� may be, of such Trustor. Hawe�er, �h�s opt�on sha!! not be exer�ised �y Lender i�such exercise
<br /> is prohibited by federaf iaw ar#�y Nebraska law.
<br /> TAXES AND L1ENS. The foflowing pr��isions relating to the taxes and liens on th� Prop�rty are part �f this Deed a�
<br /> Trus�:
<br /> Payment. Trustor shai� pay when due 4and €n all e�ents prior to delin�u�ncy� a�l taxes, spe�ial taxes, ass�ssments,
<br /> cha�ges 4including water and sewer�, fines and imposi�ivns le�ied agains�vr on account af the Proper�y, and shall
<br /> pay when due all claims far work done an or for sgr�ices rendered ar materiaf furnished ta the Property. Trustor
<br /> shaff maintain the Property �re� af a!I liens ha�ing priority❑��r or equal to the interest of Lender under this Deed of
<br /> Trust, except for the lien of taxes and ass�ssments nvt due and except as otherwise provid�d in this Deed of
<br /> Trus�.
<br /> Right to Cvntest, Trus�ar may withhold paymen�af any tax, assessm�nt, or c�aim �n connection with a good �aith
<br /> d�spute o�er the vb('rgati�n to pay, sv long as Lender`s interest in the Property is n�t jeopard�zed. If a lien arises o�
<br /> �s fi(ed as a resul� ❑f nanpayment, Trustor sha�� within fi�teen �15} days af�er the lien aris�s o�, i� a f ien is �iled,
<br /> within fifteen �15} days af�er Trustor has nvtice o� the �iling, secure the discharge ofi �he lien, �r i� requested by
<br /> Lender, depas�t wifih Lender cash vr a sufficient cvrpvrate surety bond or�ther security sa�isfactory to Lender in an
<br /> amoun�sufficient to discharge the lien plus any �osts and attorneys' fe�s, or othe� charges that could accrue as a
<br /> r�su�t of a foreclosure vr sal� under the �ien. f n any�on�es�, Trustor shalf defend itse��and Lender and shall satis�y
<br /> any ad�erse judgment bef�re en�o�cement against the Praperty. Trus�or shall name Lender as an additional obligee
<br /> under any surety band furnish�d in the contest praceedings.
<br /> E�idence v� Payment. Trustor shall upon demand furn�sh to Lender satis#actflry e�idence af payment a��he taxes
<br /> or assessments and shall authvri�e the appropriate go�ernmental vf�Ficia� to d�li��r�o Lender at any tim� a writt�n
<br /> statemen�of�he taxes and assessments against the Property.
<br /> Notics of Cons�ructian. Trustar sha�� notify L�nder at least fifteen �15� days before any work is cammenced, any
<br /> ser�ices are furnished, ar any materiafs are supp�ied �o the Pr�perty, if any mechanic's �ien, materiaEm�n's lien, �r
<br /> other lien ��uid be asserted an accvun� of the work, ser�ices, or mat�r�als. Trustvr will upon request o� Lender
<br /> furnish �v Lender ad�ance assurances satisfac�ory �o Lender that Trustor can and wiil pay the co�t of such
<br /> impra�ements.
<br /> PRt�PERTY DAMAGE INSURANCE. The �al�owing pro�isions rela�ing tv insuring the Prvperty are a part o#�his Deed of
<br /> Trust.
<br /> Maintenance of �nsurance. Trus�ar shall procure and mainta�n polic�es of fire insuran�e wi�h standard extended
<br /> co�erage endarsements �n a replacement basis �or the ful! insurabl� �alue co�ering all Impro��ment� on �he Real
<br /> Property in an am�unt su#ficient to a�oid application of any coinsurance clause, and with a s�andard martgagee
<br /> clause in�a�ar of Lender. Trustor shall also procure and maintain ��mprehensi�e genera� I�a�ility insuranc� in such
<br /> co�erage amounts as L�nder may �equest with Trus�ee and Lender being named as additional insure�s in such
<br /> liability insurance polic�es. Additiona�ly, Trus�ar shall maintain such other insurance, inc�uding but not limited to
