C & I Cattle Co., Inc. — Spencer -Will, Inc. Easement <br />In consideration of the mutual agreements set forth below, the parties agree: <br />20160455 <br />This easement is made by and between C & I Cattle Co., Inc., a Nebraska <br />corporation, and Spencer -Will, Inc., a Nebraska corporation (formerly known as East C <br />& I Cattle Company). <br />1. Each party grants to the other a reciprocal mutual easement to use the <br />property of the other on a nonexclusive basis to permit and allow a right -of -way over <br />and above the property of the other for odors, dust, noise, insects, or air, water or soil <br />pollution caused by livestock operations on the premises of the other. This is an <br />easement that consents to all conditions arising from livestock operations. <br />2. Each party represents to the other that it is lawfully seized of the real <br />estate and has full power and authority to create, grant and convey the easements <br />hereby conveyed. <br />3. The easement granted to Spencer -Will, Inc. shall apply to, and cover, the <br />following described premises owned by C & I Cattle Co., Inc.: <br />PT W1/2, NW1 /4, Sec 4 Twp 12 N, R 11W of the 6 P.M., <br />Hall County, Nebraska, consisting of approximately 53 <br />acres. <br />4. The Easement granted to C & I Cattle Co., Inc., shall apply to and cover, <br />the following described premises owned by Spencer -Will, Inc. <br />See Exhibit A <br />5. The reciprocal Easements granted by this instrument shall run with all the <br />real estate of each party as described above. <br />6. This Easement shall bind the heirs, successors, and assignees of the <br />parties, and shall run with the land. This is the entire agreement of the parties.
