Grantor shall maintain the Easement Property. <br />elf% <br />T IS EASEMENT AGREEMENT is made and entered into this day of <br />, 2016, by and between TALON APARTMENTS, INC., a Nebraska <br />MIN <br />Co rati ("Grantor'') and BRIAN 0. LAUB and JANEL L. LAUB, husband and wife <br />("Grantee"). <br />CO <br />WHEREAS, Grantor is the owner of the real estate legally described as Lot Three (3), <br />Vanosdall Second Subdivision in the City of Grand Island, Hall County, Nebraska ("Grantor's <br />Property"); and <br />WHEREAS, Grantee is the owner of the real estate legally described as set forth on <br />attached Exhibit "A" ("Grantee's Property"); and <br />WHEREAS, Grantee is willing to release the existing Easement recorded on November <br />22, 1985 as Instrument No 85-005808 in the office of the Register of Deeds of Hall County, <br />Nebraska, in exchange for an access easement upon part of Grantor's property to enable Grantee <br />to have access for ingress and egress from the Grantee's Property to Highway 34 upon the <br />property legally described as set forth on attached Exhibit "13"("Easetnent Property"). <br />NOW, THEREFORE, in consideration of the mutual covenants and agreements of the <br />parties, it is agreed as follows: <br />1. Grantor hereby grants and conveys unto Grantee a perpetual easement for access <br />purposes upon the Easement Property. <br />2. "Access purposes" as used in this Easement Agreement meals the right to the <br />non use of the Easement Property as a means of ingress and egress for passenger <br />vehicles (excluding commercial vehicles and faun machinery) to and from the Grantee's <br />Property by Grantees, their successors in interest, gust visitors and assigned. <br />4. Subject to the terms set forth herein, this easement shall run with the land and <br />shall be binding upon the parties, their successors in interest and assigns. <br />
