201604300 me, my estate, my heirs or assigns for permitting my Agent to exercise any such authority, nor shall any person who deals with my Agent be responsible to determine or insure the proper application of funds or property. I hereby direct that any Trustee that I have appointed over any property in which I may have an interest shall cooperate in making the necessary funds available so that my Agent appointed hereunder shall be able to adequately carry out the duties set forth hereunder. ARTICLE X - DURABILITY PROVISIONS Pursuant to the provisions of applicable state law, I declare that this power of Attorney shall not be affected by my disability or incapacity, and that the authority granted herein shall continue during period while I am disabled or incapacitated. 9 9 an YP P acitated. Further, pursuant to applicable state law, all such authority shall continue after my death, until notice of such death shall have been received by my Agent so that my Agent has actual knowledge of the fact that I have died. Any action taken in good faith by my Agent during any period while it is uncertain whether I am alive, before my Agent receives actual knowledge of my death, or, in any event, taken during any period while I am disabled or incapacitated, shall be as valid as if I were alive, competent, and not disabled, and this power may be accepted and relied upon by anyone to whom it is presented until such person either: (a) receives written notice of revocation by me or a conservator of.my estate; or (b) has actual knowledge of my death. ARTICLE XI - SUCCESSOR AGENTS If my Agent should fail or refuse to qualify or act as my Agent or become incapacitated, I hereby constitute and appoint my son, Russ Vetick, to act as First Successor Agent. My First Successor Agent shall have all the powers and authority, discretionary or otherwise, herein conferred on the designated Agent My First Successor Agent shall not be liable or responsible in any way for any of the acts or defaults of my primary Agent, or for any losses or expenses resulting from or occasioned by anything done or neglected to be done by my primary Agent, but my First Successor Agent shall be liable only for the acts or defaults of such First Successor Agent in respect to property actually dealt with by such First Successor Agent. My First Successor Agent may execute and deliver an affidavit that my primary Agent is unwilling or unable to serve or to continue to serve and such affidavit shall be conclusive evidence insofar as third parties are concerned of the facts set forth therein and, in such event, any person acting in reliance upon such affidavit shall incur no liability to my estate. If my First Successor Agent should fail or refuse to qualify or act as my Agent or become incapacitated, I hereby constitute and appoint my daughter, Paula Hutt, to act as Second Successor Agent. My Second Successor Agent shall have all the powers and authority, discretionary or otherwise, herein conferred on the designated Agent. My Second Successor Agent shall not be liable or responsible in any way for any of the acts or defaults of my primary Agent or First Successor Agent, or for any losses or expenses resulting from or occasioned by anything done or neglected to be done by my Pane: of 7
