<br />EASEMENT FOR PUBLIC RECREATIONAL TRAIL
<br />LOCATED ON
<br />CORNHUSKER ARMY AMMUNITION PLANT
<br />HALL COUNTY, NEBRASKA
<br />THE SECRETARY OF THE ARMY under and by virtue of the authority vested in the
<br />Secretary by Title 10, United States Code, Section 2668, having found that the granting of this
<br />easement will not be against the public interest, hereby grants to the CITY OF GRAND ISLAND, a
<br />political subdivision of the State of Nebraska, hereinafter referred to as the grantee, an easement and
<br />right -of -way for a public recreational trail, hereinafter referred to as the facilities, over, across, in and
<br />upon the lands of the United States as identified in Exhibits "A -1" through "A -3 ", attached hereto
<br />and made a part hereof, hereinafter referred to as the premises.
<br />THIS EASEMENT is granted subject to the following conditions:
<br />I. NATURE OF EASEMENT
<br />The grantee shall have the right to plan, design, construct, maintain, repair and operate a public
<br />recreational trail over, across, in and upon the lands described above. Further, the grantee shall have
<br />the right to prohibit removal of trees, shrubs and vegetation from the premises and may replace any
<br />trees, shrubs and vegetation which becomes diseased, damaged or dies. The grantee shall also have the
<br />right to plant additional trees, shrubs and vegetation on the premises to enhance the esthetic qualities of
<br />the recreational trail.
<br />2. TERM
<br />This easement is granted in perpetuity.
<br />3. CONSIDERATION
<br />The grantee shall pay in advance to the United States the amount of Four Thousand Three
<br />Hundred Twenty -Eight and No /100 Dollars, ($4,328.00) for the term hereof, payable to the order
<br />of the "FAO USAED - OMAHA" and delivered to the Department of the Army, Omaha District,
<br />Corps of Engineers, ATTN: CENWO- RE -PC, 215 North 17th Street, Omaha, Nebraska 68102-
<br />4978.
<br />4. NOTICES
<br />All correspondence and notices to be given pursuant to this easement shall be addressed, if to the
<br />grantee, to the City of Grand Island, City Hall, 100 East First Street, Box 1968, Grand Island,
<br />Nebraska 68802 -1968, and if to the United States, to the District Engineer, ATTN: Chief, Real Estate
<br />Division, 215 North 17th Street, Omaha, Nebraska 68102 -4978, or as may from time to time
<br />otherwise be directed by the parties. Notice shall be deemed to have been duly given if and when
