<br /> Am�ndments. This Deed of Trust, �ogether with any Rela�ed Dacumen�s, constitu�es the entire understanding and
<br /> agreement of the parties as to the matters se� �orth in this Deed of Trus�. No altera�ion o�ar amendmen� to this
<br /> Deed o#Trust shall be ef�ective unless gi�en in writing and signed by the party or par�ies sought to be Charged ar

<br /> Annua[ Repvr#s. If �he Proper�y is used for purposes v�her than Trus�or's residen��, Trustor sha�� furnish tv
<br /> Lender, upon request, a certified statement of net operating income recei�ed from �he Pr�perty during Trus�or's
<br /> pre�ious fiscal year in such form and detail as L�nder shall requ�re. "Net op�rating �n�ome" shall mean all cash
<br /> receipts from the Property less all cash expenditures made in conne�tion with the operatian af the Property.
<br /> Captivn Headrngs. Capt�on headings in this Deed of Trust are for con�eni�nce purp�s�s only and are not to be
<br /> used �o interpr�t or de�in�the pr��isians of this Deed of Trust.
<br /> 1Vl�rger. There shall be no merger o�the in�erest or es�ate created by this Deed of Trust with any o�her in�erest or
<br /> estate in the Proper�y at any time held by ❑r�or the ben�fit af Lender in any capaci�y, withou�the w�itten �onsent
<br /> of Lender.
<br /> Go�erning Law. This Deed of Trust w�ll he go�erned by �ederai !aw applicable to L�nder and, tv the ex�ent nv�

<br /> Deed v#Trust has been accspted by Lender in the S�ate of Nebraska.
<br /> Chvice a� Venue. I� there is a lawsuit, Trustor agrees upon Lend�r's reques� to submit to the jurisdiction �f the
<br /> cour�s o�Hall Caunty, State of Nebraska.
<br /> Joint and Se�eral Liability. All obliga�ions of Barrower and Trustor under th�s Deed of Trust shall be joint and
<br /> se��ra�, and al[ referen�es�o Trustor shall mean each and ��ery Trustor, and a�� r�ferences to Borrower shall mean
<br /> �ach and e�ery Borrower. This means that each T�ustor signing h�low is responsihle for ali obiigations in this Deed
<br /> ❑f Trust.
<br /> Nv V11ai�er by Lender. L�nder shall not be deemed to ha�e wai�ed any rights under this Deed vf Trust unl�ss su�h
<br /> wai�er is gi��n in writing and signed �y Lender. Na delay or omission on the part of L�nder in exercis�ng any right
<br /> shal� operate as a wai�er of such right or any ❑ther right. A wai�er by Lender of a pra�ision of this ❑eed ❑f Trust
<br /> shal[ not prejudice ar cansti�ute a wai�er o� Lender's right ❑therwise to demand strict compliance wi�h �hat
<br /> pro�ision or any other pro�ision of this Deed af Trust. No prior wai�er by Lender, nor any course ofi dealing
<br /> between Lender and Trus�or, shall canstitute a wai�er of any ❑f Lender's rights or o� any of Trustor's obligatians
<br /> as to any future transac�ions. Vllhen��er the consent o# Lender is required und�r this Deed of Trust, �he granting

<br /> Succ�ssors and Assigns. Sub�ect t❑ any limitations sta�ed in th�s Deed of Trust on transfer of Trustor's interest,
<br /> this ❑eed of Trust shall �� binding upon and inur� to �he bene�it of the parties, their successors and assigns. 1f

<br /> DEFINITIDNS. The following capita[ized words and terms shalf ha�e the following meanings when us�d in this Deed o�
<br /> Trust. Unless specifically stated to the con�rary, all references �o dallar amaunts shall mean amounts in lawful m�ney
<br /> ❑f �h� lJnited 5tates of America. Vllords and terms used in the singular sha11 in�lude the plural, and the plural shall
<br /> �n��ude the s�ngular, as �he context may requi�e. Vllords and terms not otherwise de��ned in this Deed af Trus� shall
<br /> ha�e the meanings attributed t❑such�erms in the Uniform Commercial C�de:
<br /> Ben��i�iary. The ward "Bene�iciary" means Exchange Bank, and its successvrs and assigns.
<br /> Borrower. The word "Borrower" means June M. Frank Re�acable Trust and in�ludes all co-signers and ca-makers
<br /> signing the Note and all the�r successors and assigns.
<br /> ❑eed of Trust. The words "�eed of Trus�" mean �his ❑eed v� Trust among T�ustor, L�nder, and Trustee, and
<br /> includes wi�haut limitation all assignment and security interest pro�isians r�lating to the Persvnal Prope�ty and
<br /> Rents.
<br /> Defautt. The word "De�ault" means the Default set forth in�his Deed of Trust in the section titled "Defauft".
<br /> En�ironmentaf Laws. The w�rds "En�ironmental Laws" mean any and all state, federal and loca� statu�es,
<br /> regu�atians and ordinan�es relating to the protection of human health or the environment, including without
<br /> limitation the Comprehensi�e En��ronmen�af Respanse, Compensation, and L�ahility Act of 198�, as amended, 42
<br /> U.S.C, 5ection 96�1, �t seq. {"CER�LA"�, the Super�und Amendmen�s and Reau�harizat�on Act of 198f, Pub. L.
<br /> No. 9J-499 t"SARA"�, the Ha�ardous Materia�s Transportation Act, 49 U.S.C. Section 18Q1, et seq., ths Resource
<br /> Conser�ation and Reco�ery Act, 4� U.S.C. S�ction 69�1, et seq., or other applicable state or federa� laws, rules,
<br /> ar r�gulations adopted pursuant thereta.
<br /> E�ent v�Defaul�. The words "E�ent of❑efau�t" mean any o#the e�ents o�defaul�set farth in this Deed of Trust in
<br /> the e�ents of default section o�this Deed o�Trust.
<br /> �uaranty. The w�rd "Guaranty" means th� guaranty�r�m guaran�or, endorser, surety, ❑r acCommodativn party�o
<br /> Lender, including withaut limitat�on a guaranty af all or part o�the No�e.
<br /> Hazardvus Subs�ances. The words "Hazardous Substances" mean materials �hat, because of fiheir quantity,
<br /> concentration ar physical, chemical or infectious characteristics, may cause Qr pose a present or patential ha�ard
<br /> to human health �r the en�iranment when impraperly used, treated, star�d, dispvsed o�, genera�ed, manufactured,
<br /> ��ansported vr otherwise hand�ed. The w�rds "HazardQus 5uhstances" are used in their �ery �r�adest sense and
<br /> include without limitatian any and all ha�ardaus or tvxic su�stances, materials or waste as defined by �r �isted
<br /> under the En�iranmental Laws. The term "Hazardous 5ubstances" alsv incfudes, without limita�ion, petrvleum and
<br /> petroleum by-products ar any fract�on thereof and asbest�s.
