Trus��r shall promptly campfy w�th al� laws, ordinances, and <br /> re�ula�ions, now or herea�ter in effect, of all �o�ernmen�al au�harities appli�abfe t� the us� ar ❑ccupancy af the <br /> Property, including without �imitation, the Americans With Disabilities Ac�. Trustor may cantest in gvod fai'th any <br /> such law, ordinance, or reguiat€on and withhold compliance during any proceeding, including appropriate appeals, <br /> so [ong as Trustar has n�tifi�d L�nd�r in writing prior t❑doing so and so long as, in Lender's sole opin�on, Lender's <br /> interests in the Property are nat jeopardi�ed. The #ollowing pro�isions rela�ing to the taxes and fiens on the Praperty are part af this Deed o� <br /> Trust: <br /> Payment. Trust�r shalf pay wh�n due �and in all e�ents priar ta delinquen�yy all tax�s, spec�al�ax�s, assessments, <br /> charges 4including wa�er and sew�r�, fines and impositions le�ied against or on account vf the Prop�rty, and shall <br /> pay wh�n due a�l claims for work dane on or for se��ices rendered or material furnished to �he Property. Trustor <br /> shall mainta�n the Proper�y�ree of all liens ha�ing priority o�er or equa! to �he interest of Lender under this Deed o� <br /> Trust, except �or the lien �f taxes and assessments not due and except as othe�wise pro�ided in this Deed a� <br /> Trus�. <br /> Righ#ta Contest. Trustor may withhold payment of any tax, assessment, or�laim in connectian with a good faith <br /> dispute ❑�er ths abligation to pay, so long as Lender's interest in the Proper�y is not jeopardized. I�a lien arises or <br /> is filed as a resul� af nonpayment, Trustor sha11 within fifteen {�5} days af�er the �ien arises or, i� a lien is �iled, <br /> within ti�te�n {15� days after Trustor has notice o� the f��ing, secure the discharge of �he lien, or �� reques�ed hy <br /> Lender, d�pas�t with Lender cash ar a sufficient corporate surety bond or❑ther security satisfac�ory to Lender in an <br /> amount suffici�nt to discharge the lien plus any costs and attorneys' �ees, ar ather charges �ha�could accrue as a <br /> result of a forecfosure or sale under�he lien. ln any �ontest, Trustor sha��de�end itself and Lender and shaff sat�s�y <br /> any ad�erse judgment be�ore enfor�emen�agains�the Proper�y. Trustar shal€ upon demand furnish to Lender sa�isfaC�ory ��idence o� paymen� ❑f the �axes <br /> ar assessmen�s and shall auth�riz� �he apprap��ate go�e�nmental official to deli�er to Lender at any t�me a written <br /> statement❑f the taxes and assessm�nts aga�nst th� Proper�y. <br /> Notic� vf Canstruc�ion. Trus�or shall noti�y Lender at �east fi�teen �15} days t�efore any work is commenced, any <br /> ser�ices are furnished, or any materiafs are supp�ied fia the P�operty, if any mechanic's �ien, materialmen's lien, or <br /> ather fien could be asser�ed on accaunt o� the v►�ork, ser�ices, or materials. Trustor will upon request of Lender <br /> �urnish to L�nder ad�an�e assurances satis�actary to Lender that Trustar can and will pay the cost o� such <br /> impro�ements. <br /> PRDPERTY DAMAGE iNSURANCE. The following pro�isions relating to insu��ng the Property are a part af this D�ed of <br /> Trust. <br /> Main�enance of Insuran�e. Trustor shall procure and maintain poli�ies o� fire insuran�e with s�andard extended <br /> ca�erage endorsem�nts �n a repla�emen� I�asis for the full insura�fe �a(ue co�e�ing ail Impro�emen�s on th� Rea� <br /> Property in an amaunt sufficient �❑ a�oid appli�ati�n af any co�nsurance c�aus�, and with a standard mortgagee <br /> clause in fa�or o#Lender. Trus�or shall als� pr�cure and mainta€n comprehensi�e general liabili�y �nsuran�e in such <br /> co�erag� amounts as Lender may request with Trustee and Lender b��ng named as additional insureds in such <br /> liability insurance pvlicies.
