<br /> ❑ea#h vr lnsvl�en�y. The death ❑f Trustvr, the insv(vency of Trustor, the appoin�ment o�a rece��er for any part of
<br /> Trustor's proper�y, any assignmen� for the ben�fiit of creditors, any type o€ �reditor workout, or the
<br /> commen��ment vf any pro�eeding und�r any bankruptcy❑r inso��ency laws by or against Trustor.
<br /> Creditor ❑r For�eiture Proce�dings. Commencement of fvreclosure or forfeiture praceedings, whether hy judicial
<br /> proceeding, self-help, repossessian or any other method, by any �redi��r o�Trustor or by any go�ernmental agency
<br /> agains� any prvp�rty securing the Indehtedness. This includes a garn�shment of any of Trustor's accounts,
<br /> inc�uding deposit accounts, with Lender. Howe��r, this E�ent of Default shall not apply if there is a good fai�h
<br /> dispute by Trus�tor as to the �alidi�y or reasonab�eness of the claim which is �he basis of�he creditor or farfei�ure
<br /> proceeding and if Trus�or gi�es Lender wri���n noti�e vf the credi�or ar forfeiture proceeding and depasits with
<br /> Lender monies or a sure�y bond for the credi�or or farfeiture proc�eding, in an amaunt de�ermined by Lender, �n its
<br /> sole disc�etion, as being an adequate reser�e or b�nd for the dispu�t�.
<br /> Breach o��ther Agreement. Any hreach by Trustvr unde�the�erms o�any ather agreement be�ween Trus�or and
<br /> Lend�r �ha� is nat �emedied within any grace period p�o�ided ther�in, including wi�hout I�mita�ion any agreement
<br /> cvnc�rning any indebtedness or other vbligation of Trustor tv Lender, wheth�r existin� now or later.
<br /> E�ents Affecting Guarantor. Any af the p�-eceding e��nts occurs with respect ta any guaran�vr, endorser, su�ety,
<br /> or accamm�dativn party ofi any o� the Inde�tedness or any guarantor, endorser, surety, or accommodation party
<br /> dies ❑r becomes incampetent, or re�okes or disputes the �a��dity �f, or liabili�y under, any �uaranty o� the
<br /> Indebt�dness.
<br /> Ad�erse Change. A mat�ria� ad�erse change accurs in Trustar's financial condition, or Lender belie�es the
<br /> prospec�o�payment❑r performance of the Indebt�dness is impaired.
<br /> lnsecur�ty. Lender in gQvd faith belie�es itself insecure.
<br /> Right tv Cure. �f any defau[t, other than a default in payment, is curable and if Trustor has nat been gi�en a notice
<br /> o�a breach of th�same pro��sion of th€s Deed vf Trust within the prec�d�ng twel�e �12� months, it may be cured if
<br /> Trustor, a�ter Lende�sends written notice ta Trustor demanding cure of such default: �1} cur�s the default ►rvi�hin
<br /> twen�y ��Q} days; or ��} if the cure requires more than twenty �2Q� days, immediately �n�tiates steps which
<br /> Lender deems in Lender's sole discretion �� be sufficient t❑ cure the default and �herea�t�r cantinues and
<br /> �ampletes all r�asona�le and necessary steps su'�f�cien��o produ�e comp��ance as saon as reasanably practiGal.
<br /> RIGHTS AND REMED�ES �N DEFAULT. If an E�ent of Defau[t occurs unde�this Deed of Trust, afi any time �thereafte�,
<br /> Trustee�r Lender may exerc�se any one❑r m�re af the follow�ng rights and remedies:
<br /> Accelera#ivn Upon Defaul�: Addit�ona� Remedies. If any E�ent �f Defiau�t occurs as per the �erms of the Note
<br /> secured hereby, Lender may declare ail Indebtedness secured �y�his D�ed of Trust to be due and payable and
<br /> the same shall thereupon become due and payable wi�hout any presentment, d�mand, protest❑r notic�of any
<br /> kind. Thereafter, Lender may:
<br /> �a� Either in person or by agen�, with or withaut bringing any acti�n a� proceeding, ar by a recei�er
<br /> appointed by a cour�and withou� regard �o the adequacy o�its security, en�er upan and �ake possession
<br /> . af the Property, or any part thereo�, in i'ts ❑wn name or in'�he nam� o�Trus�ee, and do any acts whi�h it
<br /> deems necessary or desira�le to preser�e the �a1ue, marketability or rentability of the Prop�rty, ar part of
<br /> the Property or �nt�rest in the Property; increase the incvme #rom �he Property or protect the security of
<br /> the Prope�ty; and, wi�kh ar withou� taking possessi�n af the Pr�p�rty, sue for or athe�wise �oll�ct #he
<br /> rents, issues and profits of the Property, including fihose past du� and unpaid, and apply the same, I�55
<br /> costs and expens�s o�operation and ca�lection a#torneys` fees, t� any ind�bt�dness s�cured by this Deed
<br /> �� Trust, all in such ord�r as Lender may determin�. The entering upon and taking possession of the
<br /> Prvperty, the col�ection ❑f such �ents, issues and profi�s, and the app�icatian the�eof shall not cure ❑r
<br /> wai�e any defau�t or notice of defau�t under this Deed of Trust or in�a�idate any act dvne in response ta
<br /> such de#ault or pursuant to such not�ce of defau�t; and, notwithstanding the�ontinuance in possession o� -
<br /> the Praperty or the coflectian, r�ceipt and application of rents, issu�s Qr profits, Trus�ee or Lender shall
<br /> be entitled to exer�ise e�ery right pro�ided for in th� Note or the Related ❑ocuments vr by law upan the
<br /> occurrence o�any event of defau�t, including the right ta exercise the pvwer o�sale;
<br /> �b� Commen�e an actian to fareclose this D�ed af Trust as a m�rtgage, appo�nt a recei�er or speci'�ically
<br /> en�arce any of the �o�enan�s hereof; and
<br /> �c� Deli�er�o Trust�e a wri�ten declaratian of default and demand�or sale and a written notice of de�ault
<br /> and electian to cause Trus�or's interes� in the Property�o be sold, which notice Trustee shall cause�o be
<br /> du�y filed for record �n the appr�priafie offices of�he County in which the Pr�perty is lo�ated; and
<br /> {d} With r�spec�to ali or any part of�he Persvnal Property, Lender shall ha�e all the ri�hts and remedies
<br /> of a se�ured party under the Ne�raska Uni�orm Commercial Cvde.
<br /> Fvre�iosure �y Power vf 5ale. If Lender elects ta foreclose by exer�ise ❑f the Power vf 5ale herein contained,
<br /> Lender shall notify Trustee and sha�! deposit with Trustee this Deed o#Trus� and the Note and su�h C�C�lptS
<br /> and e�idenc�af expend�tures made and secured hy�his De�d of Trust as Trustee may require.
<br /> �a� lJpon receipt o�such n�tice from Lender, Trustee shall cause to be recorded, published and de�i�ered
<br /> �a Trustor suGh Notice ❑f D��ault and Not�ce of 5ale as then required by law and by this l7eed o�Trust.
<br /> Trus�ee shall, without demand �n Trustor, after such time as may then be required by 4aw and af�er
<br /> re�ordatian of such No�ice of ❑efault and after Nat€�e of 5ale ha�ing been gi�en as r�quired by law, sell
<br /> �he Prap�rty at �he time and place o� sale #ixed by it in such No�ice o� 5a1e, either as a who�e, or in
<br /> separate lots or par�els or items as T�ustee shall d��m expedient, and in such order as it may d�termine,
<br /> a� publ�c auction to the h�ghest hidder for cash in lawful money of the united States payable afi the time
<br /> vf sale. Trustee shall deli�er to su�h purchaser ar purchasers thereof its good and sufficient deed or
<br /> deeds con�eying the property sv sold, but without any co�enant or warranty, �xpress ar implied. The
<br /> recitals in su�h deed of any matters vr fiac�s shall be conclus��e proof o�the truth�ulness th�reaf. Any
<br /> person, �ncluding withvut limitation Trustor, Trustee, or Lender, may purchase a�such sale.

<br /> Remed�es Not Exc�usiWe. Trustee and Lender, and each of them, shall he en�i�led to enforce payment and
<br /> per#ormance of any indeb�edness or obligations secured f�y this []eed of Trust and to exercise all rights and powsrs
<br /> under this ❑eed af Trust, under the Note, under any o� the Related Dacuments, �r under any other agreement or
<br /> any laws now or herea�ter in force; no�w�thstanding, some or all of such indebtedness and obligations secured by
<br /> this Deed of Trust may now or he�eaf�er be otherwise secured, whether by mo�tgage, de�d of trust, pledge, lien,
