<br />34. Power of Attorney Effective Notwithstanding Disability of Principal Continues
<br />in Effect After Principal's Death Until Notice. Pursuant to provisions of Nebraska Probate Code
<br />Section 30 -2665, I declare that this power of attorney shall not be affected by my subsequent
<br />disability or incapacity, and that the authority granted herein shall continue during any period while
<br />I am disabled or incapacitated. Further, pursuant to Section 30 -2668, all such authority shall
<br />continue after my death, until notice of such death shall have been received by my agent so that my
<br />agent has actual knowledge of the fact that I have died. Any action taken in good faith by said agent
<br />during any period while it is uncertain whether I am alive, before my agent receives actual
<br />knowledge of my death, or, in any event, taken during any period while I am disabled or
<br />incapacitated, shall be as valid as if I were alive, competent, and not disabled.
<br />35. Revocation of Prior Powers. I revoke all prior General Durable Powers of Attorney
<br />(except Special or Limited Powers of Attorney and Powers of Attorney for Health Care) that I may
<br />have executed, and I retain the right to revoke this Power.
<br />36. Revocation of this Power. This Power can be revoked only in the following manner:
<br />a. By the execution by me of a subsequent Durable Power of Attorney,
<br />unless the subsequent Power contains a statement to the contrary and
<br />specifically refers to this Power by its date; or
<br />b. By the recordation of my express written revocation in the office of
<br />the County Clerk of the county of my residence or domicile, or in any
<br />county in any state in which this Power has been recorded; or
<br />C. By the lawful revocation by the conservator of my estate.
<br />37. Third Party Reliance. My agent shall not incur any liability to me, my estate, my
<br />heirs, successors, or assigns for acting or refraining from acting hereunder, except for willful
<br />misconduct or gross negligence. For the purposes of inducing any individual, organization, or entity
<br />(all of whom will be referred to in this paragraph as a "person ") to act in accordance with the
<br />instructions of my agent as authorized in this document, I hereby represent, warrant, and agree that:
<br />a. Reliance on Agent's Authority and Representations. No person
<br />who relies in good faith upon the authority of my agent under this document shall
<br />incur any liability to me, my estate, my heirs, successors or assigns. In addition, no
<br />person who relies in good faith upon any oral or written representation that my agent
<br />may make as to (a) the fact that this document and my agent's power are then in
<br />effect, (b) the scope of my agent's authority granted under this document, (c) my
<br />competency at the time this document is executed, (d) the fact that this document has
<br />not been revoked, or (e) the fact that I am alive and that my agent continues to serve
<br />as my agent shall incur any liability to me, my estate, my heirs, successors or assigns
<br />for permitting my agent to exercise any such authority.
<br />b. No Liability For Unknown Revocation or Amendment. If this
<br />document is revoked or amended for any reason, I, my estate, my heirs, successors
<br />and assigns will hold any person harmless from any loss suffered or liability incurred
<br />as a result of such person acting in good faith upon the instructions of my agent prior
<br />to the receipt by such person of actual notice of such revocation or amendment.
<br />C. Agent May Act Alone. The powers conferred on my agent by this
<br />document may be exercised by my agent alone, and my agent's signature or act under
<br />the authority granted in this document may be accepted by persons as fully
<br />authorized by me and with the same force and effect as if I were personally present,
<br />competent, and acting on my own behalf. Consequently, all acts lawfully done by
<br />my agent hereunder are done with my consent and shall have the same validity and
<br />effect as if I were personally present and personally exercised the powers myself, and
<br />shall inure to the benefit of and bind me, my estate, my heirs, successors, assigns and
<br />personal representatives.
