AMENDED AGREEMENT <br />201603884 <br />w <br />.l . ( 1 V u n c� <br />This Amended Agreement is made and entered into this 6 day of Mary, 2016 by and <br />between Patty Jo Cummings, Lynn Drudge, Rhonda Longenecker, and Jodie Soto, hereinafter <br />referred to as "Sellers ", and Doyle Jantzi, hereinafter referred to as "Buyer ". <br />WITNESSETH: <br />The Sellers are the owners of a six (6) acre tract of land more particularly described on <br />Exhibit A attached hereto and incorporated herein by this reference; and <br />WHEREAS, the Sellers desire to convey to Buyer the property described on Exhibit A, <br />and in return therefore, will be allowed to have use of an irrigation well situated on land owned <br />by Buyer having been conveyed to him by Document No. 97- 105387, filed for record July 7, <br />1997, with the Hall County Register of Deeds, and further Buyer grants to Sellers, their <br />successors and assigns an easement of ingress and egress over a path 12' wide and approximately <br />130' in length east of an irrigation well situated in the Southeast corner of land conveyed to Buyer <br />by Document No. 97- 105387, filed July 7, 1997, said easement is shown in approximate terms <br />on the attached Exhibit B. <br />WHEREAS, this Agreement amends an Agreement filed December 28, 2015 with the <br />Hall County Register of Deeds as Instrument No. 201508740. <br />NOW, THEREFORE, In consideration of the foregoing, the parties hereto agree as <br />follows: <br />1. Incorporation of Recitals. Recitals above made are incorporated into the body of this <br />agreement and are made a material part hereof by this reference. <br />2. Trade of Real Estate for Well Usage. Sellers hereby convey to Buyer the real estate <br />described on Exhibit A, and Buyer, in return therefore, shall allow the Sellers, their successors <br />and assigns, an easement of ingress and egress hereinabove described to allow use of an <br />irrigation well on land owned by Buyer, as described by the preceding provisions of this <br />agreement. <br />3. Maintenance of Well: Whichever party, or a party's successor, who is using the well shall <br />be responsible for well maintenance and repair. <br />4. Public Record. This Agreement shall be indexed against the legal descriptions to the tracts <br />of real estate shown on Exhibit A, and the Sellers shall have the use of the irrigation well <br />
