<br />The undersigned Grantor(s) for and in consideration Of One Dollar which is hereby acknowledged
<br />Dollars 6$_1_Q0 _J and other good and valuable consideration, the receipt whereof is hereby rf
<br />acknowledged, do hereby grant and convey unto U S WEST COMMUNICATIONS, INC., a
<br />Colorado corporation, whose address is 700 W. Mineral Ave., Littleton, Co., its successors,
<br />assigns, lessees, licensees and agents a perpetual easement to construct, reconstruct operate,
<br />maintain and remove such telecommunications, facilities, including electrical facilities, from time
<br />to time, as said Grantee may require upon, over, under and across the following described land
<br />which the Grantor owns or in which the Grantor has any interest, to wit:
<br />A part of "Lot 1" and "Lot 24 ", Meadowlark West Third Subdivision, City of Grand Island, a
<br />15,030' easement, (being a part of the E 112 of the NE114 of Seciion Thirteen ('13), Township
<br />Eleven (11) North, Range Ten (10) West of the 6th P.M.) Hall County, Nebraska, and more
<br />particularly described on "EXHIBIT A" made hereto and a part of this document.
<br />In consideration of this easement, U S West will waive billing of moving the existing cabinets
<br />along Webb Road in Meadowlark West Third Subdivision. Also, U S West will landscape with
<br />three (3) foot high Column or Japanese Yews on all sides of said easement, in number and
<br />density sufficient to obscure the view of any equipment placed on the surface of the easement
<br />area.
<br />Situate in County of HALL, State of NEBRASKA. Grantee shall have the right of ingress and
<br />egress over and across Lot 1 and Lot 24, to and from the above - described property.
<br />Grantee shah' be responsible for all damage caused to Grantor arising from Grantee's exercise of
<br />the rights and privileges herein granted.
<br />T')e G; ardor reserves the right to occupy, use and cultivate , landscape and otherwise improve
<br />said easement for all purposes not inconsistent with the rights herein granted.
<br />The rights, conditions and provisions of this easement shall inure to the benefit of and be binding
<br />upon the heirs, executors, administrators, successors and assigns of the respective parties
<br />hereto.
<br />Grantee by its acceptance of this Easement agrees (1) that no more than three (3) cabinets will
<br />be placed on the surface of such easement area, (2) except for any such cabinets all facilities,
<br />lines, and appurtenances will be installed underground only, (3) any cabinets installed on the
<br />easement area, shall not exceed 70" in height.
<br />Any claim, controversy or dispute arising out of this Agreement shall be settled by arbitration in
<br />accordance with the applicable rules of the American Arbitration Association, and judgment upon
<br />the award rendered by the arbitrator maybe entered in any court having jurisdiction thereof. The
<br />arbitration shall be conducted in the county where the property is located.

<br />Robert Allen, the Grantor, would much prefer that the Grantee, U.S. West
<br />Communications, Itic., would locate its communication pedestal and cabinets
<br />to a location directly north of the detention cell. This would put all of
<br />U.S. West Communications, Inc.'above ground facilities in back of the new
<br />Albertson's Supermarket rather than in front of Albertson's. The City of
<br />Grand Island has offered U.S. West Communications, Inc. four different
<br />ideal locations directly north of the detention cell and directly south
<br />of the new entrance road.
