EXHIBIT B <br />and 17: <br />MODIFICATIONS TO SECURITY INSTRUMENT <br />(Tax Credit Properties) <br />The foregoing Security Instrument is hereby modified as follows: <br />1. Capitalized terms used and not specifically defined herein have the meanings given <br />to such terms in the Security Instrument. <br />2. Section 1 of the Security Instrument (Defined Terms) is hereby amended by adding <br />the following new definitions in the appropriate alphabetical order: <br />"Extended Use Agreement" means any extended low income housing <br />commitment (as such term is defined in Section 42(h)(6)(B) of the Internal Revenue <br />Code) recorded against the Mortgaged Property. <br />3. The following sections are hereby added to the Security Instrument as Sections 16 <br />16. Extended Low- Income Housing Commitment. <br />201 603849 <br />Lender agrees that the lien of this Security Instrument shall be subordinate to <br />the Extended Use Agreement; provided that such Extended Use Agreement, by its <br />terms, must terminate upon a Foreclosure Event in accordance with <br />Section 42(h)(6)(E) of the Internal Revenue Code. <br />17. Cross - Default. <br />Borrower acknowledges and agrees that any default, event of default, or breach <br />(however such terms may be defined) after the expiration of any applicable notice <br />and/or cure periods under the Extended Use Agreement shall be an Event of Default <br />under this Security Instrument and the Loan Documents and that any costs, damages <br />or other amounts, including reasonable attorney's fees incurred by the Lender as a <br />result of such an Event of Default by Borrower, including amounts paid to cure any <br />default or event of default, under the Extended Use Agreement shall be an <br />obligation of Borrower and become a part of the Indebtedness secured by this <br />Security Instrument and the Loan Agreement. <br />[DOCUMENT INITIALS OCCUR ON THE FOLLOWING PAGE] <br />Modifications to Security Instrument (Tax <br />Credit Properties) Form 6315 <br />Fannie Mae 01 -11 <br />Page 1 <br />© 2011 Fannie Mae <br />
