Cherry Park, LLC, confirms and acknowledges the subordination of each of such deeds of trust <br />to a first deed of trust to Fannie Mae and /or Berkeley Point Capital LLC. Such deed of trust instrument <br />number 97- 103711 was in the original principal amount of $300,000 which has been amended and <br />restated pursuant to a Promissory Note and Novation to a principal amount of $930,000. Such deed of <br />trust instrument number 99- 112286 was in the original principal amount of $380,000 which, has been <br />amended and restated pursuant to a Promissory Note and Novation to a principal amount of <br />$1,133,000.
