200102877 <br />WASTEWATER PIPELINE EASEMENT <br />For and in consideration of their mutual promises and <br />agreements hereinafter stated, the undersigned hereby agree as <br />follows: <br />ARTICLE I <br />Definitions <br />As used in this document the following words and phrases <br />have the following definitions: <br />1. Bosselman means: Bosselman, Inc., a Nebraska <br />corporation. <br />2. Econ -O -Lux means: Thomas B. Swedlund and William G. <br />Pauley, Jr., jointly and severally, d /b /a Econ -O -Lux Inn. <br />ARTICLE II <br />Real Estate Ownership <br />Bosselman owns the real estate described upon Exhibit "A" <br />which is attached hereto and made a part hereof by this <br />reference. <br />Econ -O -Lux owns the real-estate described upon _Exhibit "B "___ <br />which is attached hereto and made a part hereby by this <br />reference. <br />ARTICLE III <br />The Easement <br />Bosselman hereby grunts °to -Econ-O- Lux ° -a °csrt- exclu�iva- <br />easement under the sixteen foot (161) wide tract of real estate <br />shown upon Exhibit "C" which is attached hereto and made a part <br />hereof by this - reference, said grant of easement to be subject <br />to and limited to the following terms and conditions: <br />1. The sole purpose of the easement is for the <br />construction, repair and maintenance of an underground four inch <br />(411) diameter pipeline to serve as a conduit for wastewater from <br />a sewage treatment plant to be built by Econ -O -Lux on its real <br />estate to the Platte River at the west end of the easement. <br />2. The easement includes the right of ingress and <br />egress as is reasonably necessary for the purpose of the <br />easement. <br />1 <br />
