<br /> Praperty with this section of th� Deed of Trust. Any inspections ar tes�s made by Lender sha�l be for Lender's
<br /> purp�s�s anly and shall n�t be canstrued to create any respvnsibility or liability on th�part of Lender to Trustor or
<br /> ta any other person. Th� representations and w�rranties contairr�d herein are based on Trusto�'s du� �i�igence in
<br /> in�estigating the Prvperty for Ha�ard�us Substances. Trustvr hereby ��� releas�s and wai�es any future claim�
<br /> against Lend�r for ind�mnity or�ontri�utian in the evsnt Trustor becomes liabfe for cfeanup or ather costs under

<br /> dispasal, release or threatened r�lease occurring prior to Trust�r's�wnership or int�rest in th�Property, whether ar
<br /> not the sarne was or should ha�s been kn�wn to Trustor. Th�� pra�isions o� this se�tian o� the aeed of Trust,
<br /> +ncluding the obligativn ta inc�emnify and defend,shai�sur�i��th�paymeni of the Indebtedness and th�satisiaGtion
<br /> and recon�eyance�f the lien af this Deed af Trust and shall n�t be affected by Lender's a�quisiti�n❑f any intere�t

<br /> Nuisance. Waste. Trustor shal� not Gause, canduct vr permit �ny nuisan�� nor commit, p�rrnit, or suf#er any
<br /> strippin� of ar wa�te on or to the Property or any partion �f the Property. Without lirni#ing the �enerality af the
<br /> foregoing, Trustor will not r�mQ�e, ar grant to �ny vther party the right t� rema�e, any timl�er, m�nerels �including
<br /> vil and gasj, c�al, clay, sc�ria, soil, gra�el or rvck pradu�ts withaut Lender's prior w�itten consent.
<br /> Remo�a!of Impra�ements. Trustvr shall not dernolish or r�move any Impravements#rom the Real Prvperty withoUt
<br /> Lender's pri�r written consent. As a �ondition ta the rem��al of any Improvements� L�nder m�y require Trust�r tQ
<br /> rnake arrang�ments satisfactvey ta Lende► to replac� such lmpro�emen#s with Improvements af at least equal
<br /> �alue.
<br /> Lencler's Righ#to Enter. Lender and Lend�r's agents and repressntatives m�y enter upan th� Real Property at all
<br /> r�a$�nable times to attend to Lender's interests and to insp�ct the Fieal Property for purposes of Trustar's
<br /> campliance with the t�rms a�nd canditions of this D��d a#Trust.
<br /> Campliance with Go��rnmental Requirements. Trustor shall promptly comply with ail laws, ardinances, and
<br /> regul�tians, naw ar hereafter in �ffect, �f all g�uernmental autharities applicable to the use or occupancy o� the
<br /> Praperty, including withaut limitation, th� Americans With ❑isabiliti�s A�t. Trustar may contest in good faith any
<br /> such la►n►, ❑rdinance, or regulation and withhvld camplian�e during any pr4ceedirrg, inGluding appropriate appeals,
<br /> s❑�ong as TrU$tor has notified Lender in writing privr ta dving sa and sa I�ng as, in Lender's s�le apinion, Lender's
<br /> interests +n the Prvperty are nat jeapardized. Lender may require Trustvr tQ po�t �dequate security or a surety
<br /> b�nd, reasanably satisfactory ta Lender, to prote�t Lende�'s interest.
<br /> Duty to Pratect. Trustor agrees neither to aband�n or lea�e unattended the Pr�perty. Trustof sh�li do ell vther
<br /> act�, in addition to thase acts set forth aba�e in this section, wh�ich from the�haracter ar�d use�f the Property are
<br /> r�asan��ly necessary to pratect and preser�e the PrQperty.
<br /> DLJE QM SALE-CONSENT B11 LEN�ER. Lende�may, at Lender's aptian,d�clar�immediately due and payable all sums
<br /> secured by this Deed of Trust upon the s�le�r transfer, wi#h�ut Lender's prior written cons�nt, of all or any part v#the
<br /> Real Pfoperty,or any int�rest in the Real Praperty. A "sal�or transfer" means the �onv�yance of Real Property ar any
<br /> right, title or interest in the Real Praperty; whether fegal, b�neficial ar ��uita bie; wheth�r �olUntary or in��lun�ary;
<br /> wheth�r by vutright s�le, deed, insta�lment sale contra�t, land contract, �antract f�r d�ed, �easehald intere$t with a
<br /> term greater than thr�e ��f Vear�, lease-o�tion contract, or by sa�e, assignment,ar transfer ❑f any b�ne�icia� intere�t in
<br /> or ta any land trUst halding title ta ths Rea� Praperty, ar by any other method of conveyance of an in#erest in the Real
<br /> Prap�rty. Hvwever, this aption shall not be exer�ised by Lender if �uch �xercise is prohib�ted by �ederal law or by
<br /> Nebraska 1aw.
<br /> TAXES AND LIENS. The following pra�isions relating ta the tax�$ and liens an the Property are par# af this Deed of
<br /> Trust:
<br /> Payment. Trustar shall pay when due Rand in all e�ents priar to de��nquency7 all taxes, sp�ciaE taxes, assessments,
<br /> charges {including water and sewer�, fines and impositions levied against or on accaunt of the Praperty, �nd shall
<br /> pay when due all �laims for worl�dane on or f�r ser�ices r�ndered �r mat�rial furnish�d ta the Property. Tru�t�r
<br /> shall maintain th�Praperty fr�e of all li�ns having priority ov�r�r equal to the interest of Lender under this Deed af
<br /> Trust, except f�r the lien �f taxes and assessrnents not due and except as otherwise provi�ed in this Deed af
<br /> Trust.
<br /> Right t4 G�n#es#. Trustor may withhold payment of any tax, assessment, ar claim in cnnn�c#ion with a good faith
<br /> d�spute o��r the oaligation to pay, sa Iong as Lender's interest in the Property is nat jeopardized. It a li�n erise5 �r
<br /> is filed as a r��ult of nanpayment. Trustor shall within fifteen {15� days af�er the lien arises �r, if a lien is filed,
<br /> within fifteen ��!5f d�ys �fter Trustar has natiGe af the filing, s�cure the discharge of th� lien, ar if requested by
<br /> Lender,dep�sit with Lender cash or a suffiicient carporate surety band ar ather security satisfa�tory ta Lender in an
<br /> amount sufficient to discharge the lien plus any costs and attorneys' fees, ar oth�r charges that could a��rue as a
<br /> resu�t af a fareclosur�or sale under the lien. In any cantest, Trustor shall defend itself and Len�er�nd shall satisfy
<br /> any ad�er�e judgment bef�re enforcement against the Property. Trustor shall nam� Lender as an additi�nal at�ligee
<br /> under any su�ety bond furnished in th�contest proceedings.
<br /> Evidence�f Paym�nt. Trustar shall up�n demand furn�sFr ta Lender satisfaetory��idencs o�payrnent af ths tsxes
<br /> or assessments and sha11 authorize th� appropriate go�ernm�ntal offici�l ta deliuer to Lender�t eny time a written
<br /> statement af the tax�s and assessments against the Propert�,
<br /> Notice af�onstruction. Trustar shall notify Lender �t least fifteen �15) days before any wvrk is comrnenced, any
<br /> serWices are furnished, or any rnaterials are supplied to tl�e Pr�perty, if any mechanic's lien, mat�riaimen's lien, or
<br /> ather lien c�uld �e asser�e� on ac�aunt ofi the work, ser�+��s, or materials. Trustor will upon request af Lender
<br /> fumish to Lender ad�ance assur�nces satisfactary ta Lender that Tru�tar can and will pay the c�st of such
<br /> impro�ements.
<br /> PROPERTY DAIVIAGE INSURAIVGE. The fallowing provisians relating to insuring the Prvperty are a part oi this Qeed af
<br /> Trust.
<br /> M�intensnce af Insurance. Trust�r shall pracure and maintain palicies �f fire insurance witk� standa�d extended
<br /> co�erage en��rsements on a repla�ement b�sis for the full insurable �alue c�WQring all Impro�ements on the Real
<br /> Prvperty in �n amount suff�cient ta a�oid application af �ny cainsuran�e claus�, and with a �tandard mortgagee
<br /> Glause in#avor of Lender. Trustar shall also pr�cure and maintain comprehensi�e general liabi�ity insurence in such
<br /> co�erage arnounts as Lender rnay request with Trustee and Lender b�ing named as addi#ianal insureds in such
<br /> liability �nsuran�e policies. Additionally, Trustar shali maintain such ath�r Ensurance, including �ut n4t limited to
<br /> hazard, bus+ness interruption, anc� bviler insurance, as Lender may reasvnably require. Policies shaLi be writt�n in
<br /> farm, amounts, Co�erages and basis reas�nably acceptabl� to Lender and issued by a �ompany ar companies
