KNOW ALL BY THESE PRESENTS that Peggy Rae, a single person,
<br />hereinafter known as Grantor, for and in consideration of the sum
<br />of SIX HUNDRED and No /100 DOLLARS ($600.00) in hand paid does
<br />hereby and herewith grant, bargain, sell, convey and confirm unto
<br />Central Platte Natural Resources District, hereinafter known as the
<br />Grantee, the following described temporary construction easement:
<br />On, over, across, and through a tract of land in Block 3 of
<br />Ponderosa Lake Estates Third Subdivision in Section 36,
<br />Township 11 North, Range 10 West, of the 6th P.M., Hall County,
<br />Nebraska, and more particularly described as follows:
<br />Commencing at the Southeast Corner (SE Corner) of said Block
<br />3 Ponderosa Lake Estates Third Subdivision; thence on an
<br />assumed bearing of S 88 °43'43" W along the south line of said
<br />Block 3 a distance of 92.56 feet to the point of beginning;
<br />thence continuing S 88 °43'43" W along said south line a
<br />distance of 85.03 feet; thence N 02 °17133" W a distance of
<br />112.31 feet; thence N 89'06'34" E a distance of 179.15 feet to
<br />a point on the east line of said Block 3 and the westerly
<br />right of way line of U.S. Highway #281; thence S O1 030103" E
<br />along said east line and said westerly right of way line a
<br />distance of 30.12 feet; thence S 89 °23'14" W a distance of
<br />89.33 feet; thence S 00 °45'36" W a distance of 82.06 feet to
<br />the point of beginning. Said easement area contains 0.29
<br />acres more or less.
<br />Grantor does herewith grant Grantee, its agents, officers,
<br />employees, representatives, contractors, successors and assigns the
<br />immediate, full and free right and authority to enter into and upon
<br />the easement area and to grade, excavate, store and stockpile
<br />materials, conduct surveys, operate and store construction
<br />equipment, operate equipment, temporarily relocate utilities and to
<br />otherwise conduct all activities necessary for the construction of
<br />structures, conveyances and floodways associated with or a part of
<br />the Lower Wood River /Upper Warm Slough Flood Control Project. The
<br />easement granted herein shall terminate upon the completion and
<br />acceptance of the above project by Grantee. The payments to
<br />Grantor above described compensate Grantor for all damages caused
<br />by the establishment and construction of the above project.
