200003417 <br />5. The assessment levied by the Association shall be used <br />exclusively for the following purposes: <br />a. Snow removal on the driveways, parking <br />spaces, public and private sidewalks and porches <br />located on the Properties; <br />b. Usual and customary care of the lawns located <br />on the Properties as determined by the Association; <br />C. Acquisition and maintenance of facilities and <br />equipment necessary to water the lawns located on the <br />Properties; <br />d. Care of the islands located on Summerfield <br />Avenue and on Meadow Way Trail and acquisition and <br />maintenance of facilities and equipment necessary to <br />provide water for the care of such islands; and <br />e. Other maintenance necessary or desirable, in <br />the discretion of the Association in regard to shrubs, <br />vegetation or grass on Lots contained within the Prop- <br />erties. <br />The Association is specifically authorized hereunder to con- <br />tract with any third party to manage the Properties or provide <br />maintenance as provided herein. <br />In the event that any maintenance or repair is caused <br />through the willful or negligent act of any Owner, his or her <br />family, guest or invitees, the cost of such maintenance shall be <br />promptly paid by such Owner. <br />The Association may, upon request from and with the written <br />consent of any Owner, contract to have various maintenance or <br />repair items performed for such Owner. Any maintenance or repair <br />items so performed shall be the obligation of such Owner and not <br />the obligation of the Association and such Owner shall promptly <br />pay for any maintenance or repair items so performed. <br />6. Each Owner of any Lot contained within the Properties <br />shall maintain insurance on the buildings and improvements <br />located on such Lot in an amount not less than the replacement <br />value of such buildings and improvements and provide proof of <br />such insurance to the Association. Each such Owner take all <br />action necessary so that any company providing such insurance <br />shall notify the Association in the event of cancellation of such <br />insurance and this Article III., Paragraph 6. shall constitute <br />the consent of any such Owner for any such company providing such <br />insurance to include within such insurance coverage provisions <br />for notice of cancellation of such insurance to be provided <br />directly to the Association. All insurance proceeds shall be <br />applied toward repairing the damages suffered. In case the <br />5 <br />
