<br /> 1nsolvency. The dissa�ution or termina�ion o�the Trust, the insal�en�y o�Trustor, th� appaintment vf a recei�er#or
<br /> any par� af Trustor's property, any assignment fior the benefit of creditors, any type of creditor workout, v� the
<br /> commencement vf any proceedtng under any bankrup�cy o�insolvency �aws by or against Trustor.
<br /> Creditor o� Forfeiture Proceedings. �ommencement of �oreclosure o� #orfei�ure proceedings, whether by judicial
<br /> proceeding, self-help, repossessian or any ather method, by any �reditor of Trustor❑r by any�o��rnmental agency
<br /> against any property se�uring the Indebt�dn�ss. This includes a garnishment of any vf T�ustor's accounts,
<br /> inciuding deposi� accaun�s, w�th Lender. Howe�er, th�s E�en� of D��Fault shall not apply if there is a gaod faith
<br /> dispute by Trus�vr as to the �a�idity or reasonahlen�ss o�the claim whi�h is �he basis of the creditor or for�eiture
<br /> proceedin� and if Trustor gi�es Lender written notice ❑� �he creditor or �orfeiture praceeding and deposits with

<br /> Breach of Dther Agreemen�. Any breach by Trus�vr under the terms of any oth�r agreement b�tween Trus�or and
<br /> Lender that is not remedied within any grace period pra�ided therein, including without limitation any agreem�n�
<br /> con�erning any ind�btedness or ather obligation❑f Trustor tv Lender, whether existing now ar later.
<br /> E�ents Affecting Guarantor. Any of the pre�eding events occurs with respect �o any Guarantvr ofi any of the
<br /> Indebtedness or any Guarantor dies or be�omes inc�mpeten�, or re�okes or dfsputes the �alidity Qf, or I�ability
<br /> under, any Guaranty of the Indebtedness.
<br /> Ad�erse Change. A materia� ad�erse change ❑ccu�s �n Trus�or's ��nancial cond�tivn, or Lender belie�es the
<br /> prospe�t of payment or perf�rmance of th� Indeb�edness is impaired.
<br /> Ins�cur�ty. Lender in gavd faith belie�es itself insecure.
<br /> Right to�ure. �f any default, other than a d�fault in payment, is curable and if Trustor has n�t be�n gi�en a notice
<br /> o�a breach of the same pro�ision❑f�his D��d of Trust w�thin�the preceding xwel�e t 12} mvn�hs, it may be cured if
<br /> Trustor, a�ter Lender sends written notice�❑ Trus�or demanding cure o�such de�au€t: {�y cures�h�defau[t within
<br /> twen�y t20} days; or �2y i� th� cure r�quires more than twenty 42D� days, immedia�ely initiates steps which
<br /> Lender deems in Lender's sole discretion to be su��icien� �o cure the defau�t and �herea�ter continues and
<br /> completes all reasona�le and necessary steps suffic�ent ta prvduce complian�� as sovn as reasanably practical.
<br /> RIGHTS AND RENiEDlES ON DEFAULT. If an E�ent o� De�faul�o�curs under this Deed of Trust, at any time �hereaf�er,
<br /> T�ustee or Lender may exerc�se any one ar more of the�ollowing rights and remedies:
<br /> Acce�eration Upon De�ault; Additianal Remedies. 1f any E�en�af De�ault accurs as per the fierms of the Nofie
<br /> secured hereby, Lender may declare all Indebtedness secured by this Deed of Trust to be du� and payable and
<br /> the same shall thereupon be�vme due and payable w�thout any presentment, demand, protest o�no�i�e af any
<br /> kind. Thereafiter, Lender may:
<br /> �a} Either in person or by agent, with vr without bringing any a��ivn or proceeding, a� by a r�ce��er
<br /> appointed by a court and without regard to the adequacy o�its security, enter upon and take p�ssessi�n
<br /> of the Praperty, or any part thereof, in its own name or in�he name of T�ustee, and do any acts rrvhich i�
<br /> deems n�cessary or desirable to preser�e the �alue, marketat�ili�y or rentabili�y af the Praperty, ❑r part of
<br /> the Property or interest in the Property; increase th� incame �rom the Property or protec�the securi�y of
<br /> the Property; and, wi�h or without taking possession of the Property, sue for �� vtherwise colle�� the
<br /> �ents, issues and profits of the Property, including thase past due and unpaid, and apply t�e same, I�ss
<br /> costs and exp�nses af aperation and callec�ion attorn�ys' fees, to any indebt�dness secured by this Deed
<br /> of Trus�, all in such order as Lend�r may determine. The ent�ring upon and taking possessivn of the
<br /> PrQperty, the collecti�n of such rents, issues and prafits, and �he application therevf shali not cure vr
<br /> wai�e any de�aul�or notice of de�au�t under this Deed of Trust ar invalidate any act don� in respons� �o
<br /> such default or pursuant to such nat��� of default; and, notwithstanding�he continuance �n possession o�
<br /> the Property or the co��e�tion, re�e�pt and applicat�on �f rents, issues or pro��ts, Truste� or Lender sha(!
<br /> be enti�led to exercise e��ry right pro�ided for in �he Note ar�he Rela�ed Do�uments or by law up�n �he
<br /> accurrence a�any e�ent of default, including the r�ght t❑exercise th� power a�sale;
<br /> �b7 Comm�nce an action�❑ foreclose#his ❑eed vf Trust as a mortgage, appaint a recei�er or specifically
<br /> en�orce any o�the c��enants here�f; and
<br /> tc} Deli�er to Trustee a written dec[aration of default and demand for sale and a wri�ten natice ❑f defau[t
<br /> and elec�ion�to cause Trustor`s interest in the Prop�rty to be sa[d, which natice Trus�ee sha�� Gause to �e
<br /> du[y filed for re�ord in the appropriate offices vf the County in wh�ch the Property is lo�ated; and
<br /> �d} With respect�o a!I ar any part o�the Persona[ Proper�y, L�nde� shall ha�� al� the rights and remedies
<br /> o�a se�ured par�y under the Nebraska Unifvrm Commercial Code.
<br /> Foreclosure hy Pvwe�o�Sale. If Lender elects�o fore�lose by exercise of the Power af 5ale he�ein cvn�ained,
<br /> Lende� shall not��y Trust�e and shall deposit wi�h Trustse this ❑��d vf Trust and the Note and such receipts
<br /> and e�idence af expenditures made and secured k�y this ❑eed of Trust as Trust�� may require.
<br /> 4a� Up�n r�ceip�of such notice from Lender, Trustee shall cause to be re�orded, published and deli�ered
<br /> �o Trustor such Notic� of Defau[t and Natice ❑� Sale as then required by law and by this ❑eed of Trust.
<br /> Trus'tee shail, without demand an Trustor, a�ter such time as may then be required by law and a�ter
<br /> recordation of such Natice of De�ault and after Notice of Sa�e ha�ing �een gi�en as required �y law, sel�
<br /> �he Property a� the �ime and p[ace ❑f sale fixed by i� in such Na�ice of Sale, ei�her as a whole, ❑r in
<br /> separate lots ar parcels or�tems as Trus�ee shali deem exped�ent, and in such order as it may determine,
<br /> at public auction �o �he highest bidder for cash in lawful man�y of the Un�ted 5�ates payable a�the ��me
<br /> of sale. Trustee sha�l deli�er to such purchaser or purchasers thereof its goad and su�ficien� deed or
<br /> deeds con�eying the proper�y so sold, but without any co�enant or warranty, express or implied. The
<br /> recitals in such d�ed o� any matt�rs or �ac�s shail be cvncfusi�e proof of the tru�hfulness therevf. Any
<br /> person, including rrvithout limi�a�ion T�ustvr, Trustee, or Lender, may purchase at su�h sale.

<br /> Trust, in�luding cos#s of evidence of title in connect�on with sale, Truste�shall apply the proceeds vf sale
