02 Y <br />fl <br />C <br />a <br />SOUTHERN PUBLIC POWER DISTRICT <br />RIGHT OF WAY EASEMENT <br />Southern Public Power District, 4550 W Husker Hwy, Grand Island, NE 68803, a political <br />subdivision of the State of Nebraska, hereinafter "Grantor," in consideration of value paid by <br />Jerry and Linda Woitaszewski, individuals, hereinafter "Grantee," hereby grants and conveys to <br />Grantee, their successors and assigns, the rights as set forth herein, across those portions of the <br />real estate owned by Grantor situated in Hall County, Nebraska, legally described on Exhibit "A" <br />attached hereto (the "Grantor Property") that are herein identified as the "Easement Areas." <br />Grantor and Grantee have reached agreement and are entering into this Agreement to <br />memorialize Grantee right of ingress and egress .across a private road located upon Grantor's <br />property. <br />NOW, THEREFORE, in consideration of the foregoing and for other valuable consideration, the <br />receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: <br />1. Grantor hereby grants to Grantee, without warranty, a non - exclusive eighty foot <br />(80) wide perpetual easement (the "Easement ") over and upon a private road as described and <br />depicted on Exhibit "A," as reasonably necessary to access its property located immediately <br />North of Grantor's Property. <br />2. The provisions of this Easement, including the benefits and burdens, shall run <br />with the land and shall inure to the benefit of the Grantor and Grantee.
