(9) West of the 6th P.M., Hall County, Nebraska, Bounded on the Westerly Side <br />by the Common Road; <br />together with all improvements now or hereafter erected on the property, which Financing <br />Statement & Security Agreement given by Scott Van Wie and Jana Van Wie was filed of record <br />in the office of the Hall County Register of Deeds on May 23, 2006, as Instrument No. <br />200604590, and which Conditional Assignments of Lease as Additional Security given by Scott <br />Van Wie and Jana Van Wie were filed of record in the office of the Hall County Register of <br />Deeds on May 23, 2006, as Instrument No. 200604592, and on November 8, 2007, as Instrument <br />No. 200709545. <br />Plaintiff claims there is now due the sum of Three Hundred Forty -Six Thousand Four <br />Hundred Twenty -Three and 84/100 Dollars ($346,423.84) plus interest at the rate of Five and <br />50 /100 percent (5.50 %) per annum, pursuant to the terms of the Adjustable Rate Note, accruing <br />from and after March 25, 2016, on the Adjustable Rate Note; and the sum of Eighteen Thousand <br />Three Hundred Fifty -Seven and 21/100 Dollars ($18,357.21) plus interest at the rate of Seven <br />and No /100 percent (7.00 %) per annum, pursuant to the terms of the Promissory Note, accruing <br />from and after March 25, 2016, on the Promissory Note; both of which are secured by the <br />Financing Statement & Security Agreement, the Consumer Security Agreement, and the <br />Conditional Assignments of Lease as Additional Security; and Plaintiff prays for the sale of the <br />above - described real estate to satisfy the amount found due, together with interest, costs and <br />expenses of suit; and to foreclose the said Defendants from all right, title, interest, lien, claim, <br />demand and equity of redemption whatever in and to said real estate and appurtenances thereto; <br />together with such other and further relief as to the Court may deem just and equitable. <br />Dated this 22 " day of April, 2016. <br />1894- 129/575631v4 <br />jets am& N07ARY• Stacie of Net aka <br />SUSAN IC.
