<br /> P�5SE55i�N AND MAINTENANCE aF THE PRQPERTY. Trustor agrees that Trustar's possessian and use v� the
<br /> Property shall be go�erned by�he fvllawing pro�isions:
<br /> Possessivn and Use. Un�il the o�currence vf an E�ent o� ❑e�au�t, Trus�ar may {1 f remain �n possessian and
<br /> control of the Praperty; ��} use, operate or manage th� Praperty; and {3� collect the R�nts�ram the Property.
<br /> Duty to Main�ain. Trustor shal� maintain th� P�operty in tenantab#e condition and prompt�y p�r�arm all repa��s,
<br /> replacements, and maintenance necessary ta preser�e its�alue.
<br /> Compiianc� 1Nith Enrrirvnmental Laws. Trustar represents and warrants to Lender that: �1} During the perivd of
<br /> Trustor's awnership ofi the Property, there has been no use, g�neration, manufacture, sfio�age, t�eatment, d�sposal,
<br /> r��ease vr threat�ned release vfi any Hazardous Substance by any pers�n on, unde�, ab�ut or fram the Prop�rty;
<br /> �2} Trustar has no knowledge nf, or reason to belie�e that there has �een, exc�pt as pre�i�usly d�sclosed t� and
<br /> a�kn�wledged by Lende� in w�iting, �a� any hreach or �iolation of any En�ironmental Laws, �by any us�,
<br /> generati�n, manu�actur�, storage, t�eatment, dispvsaf, refease �r threatened release �f any Hazardaus Substan�e
<br /> on, under, a�out or �rom the Praperty by any prior awners �r occupants �f the Property, ar �c� any a�tua� �r
<br /> threatened litigation �r claims of any kind hy any pe�son relating to such matters; and 43� Ex�ept as p�e�iously
<br /> disclvsed to and a�knQwl�dged by Lender in writing, �a} neither Trustor nar any tenant, contractar, agent or other
<br /> authvri�ed user of the Praperty shafl use, generate, manufac�ure, store, treat, dispose of or release any Ha�ardvus
<br /> Substance on, under, about or frvm the Proper��; and �by any such acti�ity shall be conduc�ed in cvmpliance with
<br /> all applicable �ederal, s�ate, and Ivcal laws, regula�ivns and ordinances, �ncluding wi�hou� fimi�a�ivn all
<br /> En�ironmental La►►vs. Trustar au�horizes Lender and i�s agents to enter upvn the P�ope��y ta make such
<br /> inspections and tests, a� Trus�or's expense, as Lender may deem apprnpriate t❑ determine �ompliance of the
<br /> Property with this section �# the Deed of Trust. Any inspectians o� tests made by Lender sha�l be for Lender's
<br /> purposes oniy and shall nat �e cvnstrued to create any respvnsi�aility ar liahility vn the part o� Lender�a Trus�vr or
<br /> to any vth�� p�rson. The representations and wa�ranties cantained herein are based on Trustor's due d��igence in
<br /> in�estigating the Property for Ha�ardaus Suhstanc�s. Trustor hereby {1� releases and wa��es any future ciaims
<br /> against Lender f�r ind�mnity ar cont�ibut�on in �he e�ent Trustar be�omes I�able for cfeanup ar ather costs under
<br /> any such laws; and ��� agrees�� indemnify, defend, and hofd harmless Le�der against any and alf c[aims, ivsses,
<br /> liabilities, damages, pena�ties, and expenses which Lender may directly or indirectly sus�ain vr suffer resulting frvm
<br /> a breach of this section of the D�ed vf Trus� or as a cvnsequence of any use, genera�ian, manufac�ure, s�orage,
<br /> disposal, release or�hreatened release ocGurring prior tv Trus�or`s ownership or in�erest in�he Proper�y, whe�her or
<br /> not the same was or should ha�e been known �o Trus�or. The pra�ision� of this section of �he Deed of Trus�,
<br /> including the vbligation ta indemnify and defend, shall sur�i�e the payment af the Indehtedness and the satisfa��ion
<br /> and re�an�eyan�e of the lien of this ❑eed afi Trust and shall not be a��ected by Lende�'s acquisifiion ❑f any interes�
<br /> �n the Prvperty, whether�y fvreclosu�e or otherwise.
<br /> Nuisance. VlJaste. Trustor shall not cause, cvnduGt or permit any nuisan�e nor commi�, perm�t, or su��er any
<br /> s�ripping of or waste an ar t❑ the Prvperty �r any por#ion of the Property. Vlli�hout limiting the generality o� the
<br /> faregoing, Trustor wiff not rema�e, or grant to any vther party the right to �emo�e, any timber, minerafs �in��uding
<br /> oii and gas�, coal, clay, s�vria, soil, gra�el ❑r rock produc�s wi�hout Lender's prior written�onsen�.
<br /> Rem��al nf lmproWements. Trustor shall not demolish a�-remo�e any Impro��ments fram�he Real Proper�y without
<br /> Lend�r's p�i��written consen�. As a conditivn t�the remo�a! v�any Imp�o4�ements, Lender may require Trustar to
<br /> make arranyements satisfactory to Lender ta rep�a�e such �mpro�ements with �mpro�ements o� at least equal
<br /> �alue.
<br /> Lend�r's Righ�to Enter, L�nder and Lender's agents and represen�ati�es may �nter upon the Real Praperty at all
<br /> reasonabie times to at#end tv Lender's in�eresfis and to inspect the Real Proper�y for purpose� of Trustor's
<br /> c�mpliance with the�erms and condi�ivns of�his Deed o�F Trust.
<br /> Cvmp�iance wi�h G��ernmenfal Requiremen#s. Trustor shall promptly comply ►nrith a�l lavvs, ord�nances, and
<br /> regulations, now or h�rea�ter in e��ect, a� a�l go�ernmenta! authorit€es applicable to �he use or occupancy ❑� the
<br /> Proper�y, incfuding w�thaut limitat�an, the Ameri�ans Vllith Disabilities Act. Trustor may contest in gaad �aith any
<br /> such faw, �rdinance, or regufatian and withhofd cvmpliance during any pro�eeding, in�fuding appropria#e appeals,
<br /> so fong as Trustor has no�ified Lender in writing privr t�dving so and so lvng as, in Lender's sole opinion, Lender's
<br /> €nterests in the Pr�perty ar� not jeopardized. Lender may require Trustar to pvst adequate security or a sure�y
<br /> bond, reasonably satis�actory to Lend�r, ta protect Lender's interest.
<br /> Duty to Prvte�t. Trustor agrees neither to ak�andon or lea�e una�tended the Property. Trustor sha�l do aII ❑ther
<br /> acts, in addi�ion to those acts set for�h abv�e in this section, which�rom the charac�er and use vf the Property are
<br /> reasanably ne�essary�o pro�ec�and preser�e�he Praperty.
<br /> DUE�IV SALE-C�NSENT BY LENDER. Lender may, at Lende�'s optian, dec�a�e immediately due and payable a�l sums
<br /> secured by this Deed v�Trust upon the sale or trans�er, without L�nder's priar wr�tten consent, o�ail or any part v�the
<br /> Real Property, nr any int�r�st in the Reai Property. A "sale vr transfer" means the con�eyance af ReaE Pr�perty �r any
<br /> right, title or interest in the Real Property; whether legaf, beneficiaf or equitable; whether �ofuntary or in�oluntary;
<br /> whether by outrigh� sale, deed, instaflment sale contra�t, land contrac�, contract for deed, leasehold interest with a
<br /> term greater than three {3� years, Iease-ap�ion contra��, or �y sale, assignment, ar trans��r of any beneficial €n�erest in
<br /> or to any �and trust hald�ng tifil� to the Rea! Property, o� by any �the� method of c�n�eyanc� o� an �nterest �n the Real
<br /> Property. If any Trustor is a corporation, partne�ship or li�nited liahility �ompan�, trans�e� a�so includes any �hange in
<br /> ownership of more than�wenty-fi�e p�rcent ��5°/a� ❑��h��ating stack, partners�ip interests vr limited I�ab�l�ty company
<br /> interests, as the case may #�e, o�f such Trustor. Hawe�er, this option shall nvt �e exer�ised by Lender if such ex�rcise
<br /> is prohibited by federal law or by Nebraska law.
<br /> TAXES AND LIENS. The fvllowin� praWisians rela�ing to �he taxes and liens on the Prvper�y are par� of �his Deed of
<br /> Trust:
<br /> Paymen#. Trus�or shall pay when du� 4and in all e�en�s prior tv delinquen�y� all#axes, sp�cial taxes, assessmen�s,
<br /> charges �including wa�er and sewer}, fines and impvsitivns le�ied aga�ns� ar �n acc�unt �f the Proper�y, and shall
