Wo , <br />i aszewski Gra tor <br />AGREEMENT <br />CA) <br />—c <br />c -, <br />This agreement is made and entered into this S day of March, 2016, by and <br />between Matthew L. Woitaszewski, a single person, hereinafter referred to as "Grantor ", <br />and Kenneth S. Woitaszewski and Debra L. Woitaszewski, husband and wife, <br />hereinafter collectively referred to as "Grantee ". <br />WHEREAS, the Grantor is the owner of a tract of land legally described as: <br />The East Half of the North Half of the Southeast Quarter (E1/2N1/2SE1/4) <br />of Section Twenty -Six (26), Township Eleven (11) North, Range Twelve <br />(12), West of the 6 P.M., Hall County, Nebraska. <br />WHEREAS, the Grantees are the owners of a tract of land legally described as: <br />The West Half of the North Half of the Southeast Quarter <br />(W1/2N1/2SE1/4) of Section Twenty -Six (26), Township Eleven (11) <br />North, Range Twelve (12), West of the 6 P.M., Hall County, Nebraska. <br />WHEREAS, the Grantor desires to convey to Grantees the use of an irrigation <br />well situated on the Grantor's above described real estate, for the use and benefit of the <br />Grantee's above - described real estate. <br />NOW THEREFORE, in consideration of the foregoing, the parties hereto agree <br />as follows: <br />1. Grantor hereby grants to Grantee the use of the irrigation well located on <br />Grantee's above - described real estate. <br />2. Whichever party is using the well shall be responsible for the costs of well <br />maintenance and repair. <br />3. This agreement shall be indexed against the legal descriptions to the tracts of <br />real estate as stated above. <br />4. This agreement shall be binding upon the parties hereto and their respective <br />successors and assigns, and shall benefit the Grantee's land. <br />5.
