WHEREAS, Thelen Grain Company, A Corporation organized underS
<br />the laws of the State of Nebraska, as owner of record, did file a °a
<br />Declaration of Restrictive Covenants and Subdivision Restrictions
<br />for Thelen Subdivision, First Addition, to the City of Wood River,
<br />Nebraska, as Instrument No. 98- 111198 in the Office of the Hall
<br />County Register of Deeds, and
<br />WHEREAS, the owners of the lots in Thelen Subdivision, First
<br />Addition, to the City of Wood River, Nebraska, desire to change and
<br />amend Section 1 of the Restrictive Covenants and Subdivision
<br />Restri.:- t- ions for Thelen Subdivision, First Addition, to the City of
<br />Wood River, Nebraska, dated November 6, 1998, and recorded as
<br />Instrument No. 98- 111198 in the Office of the Hall County Register
<br />of Deeds to provide as follows:
<br />"l. Land Use and Building Type. No lots shall be used except
<br />for residential purposes. No building shall be erected,
<br />altered, placed, or permitted to remain on any lot other
<br />than one (1) detached single family dwelling not to
<br />exceed 2 1/2 stories or Thirty -Eight Feet (38') in height
<br />and a private garage. All homes constructed on Lots One

<br />home shall be constructed on said lots. Notwithstanding
<br />the above, Lots Seventeen (17) through Twenty -Four (24)
<br />inclusive may be used for residential purposes and the
<br />undersigned owners do hereby consent and agree that a
<br />multi- family residential facility may be built or erected
<br />upon said lot or lots."
<br />We, the undersigned, warrant that we are the owners of the
<br />lots under which we are executing this Agreement and do bind our
<br />personal representatives, successors and assigns to the terms and
<br />provisions of the above Amendment in lieu of the provisions
<br />provided in the original Declaration of Restrictive Covenants and
<br />Subdivision Restrictions for Thelen Subdivision, First Addition.
