<br /> �'I. Ha�ardous�ubstances.As used in this Section 21: �a} "Hazara�ou.s,Sul�.�tar�ce.s"are those substances
<br /> defined a�toxic or ha�ardous substances,pollutants,or wastes by En�ironmental Law and the folla�ving
<br /> substances: �aSQ�.1Yl�i kerosen�,other flammable ar�oxic pe�traleum products,toxic pesticid�s and herbicides,
<br /> volatile solvents, materials con�a.�ning asbestos ar formaldehyd�, aad radioacti�e materials; (b)
<br /> "Ercviror�r�e�tal Law"means federa�laws and laws of the jurisdict�on where the Property is l�cated that
<br /> relate to health, safety ar envir�nm�n�a1 protection; (c} "E�tviro�n�er�tal Clear�up"includes any respa�se
<br /> action, remedial action, or remaval ac�ion, as defined in Environmental Law; and(d}an "Er�vrror�►ner�t�xl
<br /> Cor�ditior�"means a condition that can cause, contr�bute ta, or otherwi�e txigger an Environmen�al�leanup.
<br /> Barrower shall not cause or permi�the pre�ence,use,disposa�,s�Qrage,ar release of any Hazardaus
<br /> Substances,or threaten to re�ease any Hazardous Substan�es,on or in the Property. Barrower shall nat�o,
<br /> nor a11o�v anyone else to do,anyth�ng affecting th�Property�a}that is in viola�ion�f any Enviranmental
<br /> Law,(b)�vhich creates an En�uvnmental Conditi�n,or(c��vhich�due to the presence,u�e,or release of a
<br /> Ha�ardous Substance,�reates a�nnditi�n that adversely affects�he value of the Property. The preced�ng two
<br /> sentences sha��not app�y to the pr�sence,use,or st�rage an th�Property of small quantities of Hazaxdous
<br /> Substances that are generall�recognized t�be appropriate ta normal residential uses and to maintenance of
<br /> the Praper��inc�ud�ng,but nat��m.i�ed ta,hazar�aus substan.ces in consumer products}.
<br /> Borro�ver sha��prvmptly give Lender�vritten notice af�a)any�n�restigation,c�aim,demand, lawsuit or ather
<br /> action by any gav�rnmental or regutatory agency or�rivate par�y invol�ing the Property and any Hazardous
<br /> Substance or Envuonmental La�r of�rhich Borrawer has actua�lfnowl�dge, (b}any Environmental
<br /> ��nd�tion, including but n.ot lim�t�d to,any spil�ing,leaking,d�scharge,release or threat of re�ease of any
<br /> Ha�ardous Sub�tance,and(c)any condition caused by the presenc�,use or r�lease of a Hazardou�Substa.nce
<br /> �vh�ch ad�ersely affects the va�ue of�he Property. If Borrower learns,ar i�notifed by any governmental or
<br /> regu�atory author�ty,or any private party,that any removal or o�her remediation of any Hazardous Substance
<br /> affecting the Property�s necessary,Borrower sha�l promptly take all n�cessary ren�edial actions in
<br /> a�cordanc�with Environmenta.�Law,Nathing her��n shal�create any obligation on Lender far an
<br /> Ea�ironmenta.l Cl�anup.
