Besse, Attorney at Law ( "Trustee "), whose mailing address is <br />P.O. Box 10, Kearney, NE 68848 -0010, and Larry Brannagan and Rose Mary Brannagan, Husband and Wife, <br />( "Beneficiary"), whose mailing address is 3211 Hiawatha Place, Grand Island, NE 68803. <br />Explanation <br />The Trustor owes to the Beneficiary the principal sum of Thirty Nine Thousand Dollars and 00 /100 <br />United States Dollars ($39,000.00). This amount owed is set forth in the Promissory Note that the Trustor has <br />made on this date ( "Promissory Note "). The Promissory Note provides for interest at the rate of 4.0% per annum <br />with monthly payments beginning on the first day of May, 2016 in the amount of Three Hundred Ninety -Four <br />and 86/100's ($394.86) and on the first day of every month thereafter for a total of One Hundred Twenty (120) <br />monthly payments. The Promissory Note has been delivered and is payable to the order of Beneficiary, and <br />which by this reference is hereby made a part hereof, and any and all modifications, extensions, and renewals <br />thereof. <br />This Deed of Trust to Secure Debt is also for the purpose of securing payment of all sums advanced by <br />Beneficiary to protect the trust estate, with interest thereon at the rate of sixteen percent (16 %) per annum <br />In order to secure the Trustor's promise to pay Beneficiary the principal sums of the Promissory Note, <br />to pay all other sums advanced to Trustor by Beneficiary to protect the security of this Deed, to repay any future <br />advances made by Beneficiary to Trustor under Paragraph 15 of this Deed, and to fulfill the terms and conditions <br />set forth in this Deed, the Trustor, by this Deed, hereby grants and conveys to Trustee, in trust with power of <br />sale, for the benefit and security of Beneficiary, under and subject to the terms and conditions of this Deed of <br />Trust, the real property, located in Hall County, Nebraska, and described as follows ( "Property"): <br />together with any improvements, whether now on the Property or erected on the Property in the future. <br />The Trustor covenants and promises that it has lawful title to the Property and has the right and power <br />to grant and convey the Property to Trustee. The Trustor further covenants that the Property is unencumbered <br />and that it will warrant and defend against all claims and demands with respect to the Property. The warranting <br />and defense of title, however, is subject to any declarations, easements, or restrictions that are of record. <br />—4 <br />
