Applicationof Payments or Proceeds.Except as otherwise described in this Section�, all payments <br /> � accepted and applied by Lender shall be applied in the following order of priority: (a} interest due under the <br /> Note; (b�principal due under the Note; (c}amounts due under Section 3. Such payments sha�1 be applied to <br /> each Periodi� Paym�nt in the arder�n which�t becarrYe due.Any remaining amounts sha�l be applied first to <br /> late charg�s, second ta any other amounts due under this Security Instrumer�t, and then to reduce the <br /> princ�pa�balance of the Note. <br /> If Lender recei�es a payment from Bonotiver far a�le�inquent Periadic Paym�nt which includes a suffcient <br /> amount to pay any late charge due,the payment may be applied to the delinquent payment and the late <br /> charge. If m�re than one Periodic Payment is outstanding, Lender may apply any payment received from <br /> Banower to the repayment of the Periodic Payments rf, and to the extent that, each payment can be paid in <br /> fu�l. To�he extent that any excess exists af�er the payment is applied to the full payment of one or m�re <br /> Periodic Payments, such excess may be appl�ed to any Iate charges due.Volunta.ry prepayments shall be <br /> applie�fust to any prepayment charges and then as d��cribed in the Note. <br /> Any application of payments, in.surance proceed�,ar Miscellaneous Proceeds to principal due under the Note <br /> shall not extend or postpone the due date,or change the amount,of the periodic Payments. <br /> 3. Fundsfor Escrow Items. Borrower shall pay ta Lender on�he day Feriadic Payments are due under the <br /> Note,until the Note is paid in full,a sum(the "Funds"}to provide for payment of amounts due for: �a}taxes <br /> and assessments and other i�ems which Gan attain priority o�er this Security Instrument as a�ien or <br /> encumbrance on the Proper�y; (b��easehold payments or ground rents on the Property, if any; (c}premiums <br /> for any and all insurance required by Lender under Seetion S; and(d}Mortgage InsuranG�premiums, if any, <br /> or any sums payable by Borrower to Lender rn lieu of the payment of Mortgage Insurance premiums in <br /> accardance with the provisions of Section 1�. These items are called"Escrow Items."At originatian or at <br /> any time during the term of the Loan, Lender may require that Community Association Dues,Fees,and <br /> Assessments, if any,be escro�ved by Borrawer,and such dues, fees and assessments shall be an Escra�tu <br /> Item. Barrav�er shal�promptly furnish ta Lender a11�otices of amounts to be paid under this Section. <br /> Sorro�ver shall pay Lender the Funds for Escrow Items unless Lender wai�es Borrovver's obligatian to pay <br /> the Funds far any or all Escraw Items. Lender may wai�e Bnnrower's obligation to pay to Lender Funds for <br /> ar�y or a11 Escrow Items at any time. Any such wai�er may only�e in�riting. In the e�ent of such waiver, <br /> Borrower shall pay directly,when and where payable,the amounts due for any Escraw Items for which <br /> payment of Funds has been waived by Lend�r and, if Lender requ�res, sha�l furnish to Lend�r receipts <br /> e�idencing such payment within such time period as Lender may require. Borrow�r's obligation to make <br /> such payments and to provid�receipts shali for al�purposes be deemed to be a co�enant and agreement <br /> contain�d in this Security Instrument, as the phrase "co�enant and agreement" is used in Section 9, �f <br /> Borrower is obligated to pay Escrow I�ems direetly,pursuant to a wai�er,and Borrower fails to pay the <br /> amount due for an Escrow Item,Lender may exercise its rights under Section 9 and pay such amount and <br /> Borrower sha11 then be obligated under Sect�on 9 to repay to Lender any such amour�t. Lender may re�oke <br /> the wai�er a�to any or a11 Escrow Items at any time by a notice gi�en in accordance with Sectio� 15 and, <br /> upon such revocation, Barro�rer shall pay ta Lender all Funds,and in such amounts,that are then required <br /> under this Section 3. <br /> Lender may, at any time,callect and hold Funds in an amount(a}sufficient to permit Lender t�apply the <br /> Funds at the time specified under RESPA, and(b)not ta exceed the maximum amount a lender can require <br /> under RESPA.
