Hack and Sheri S. <br />Hack , husband and wife ( "Grantee "). <br />RECITALS <br />201602053 <br />A. Grantor, Wardens and Vestrymen of St. Stephens Episcopal <br />Church is the owner of certain real property located in Hall County, Nebraska, <br />legally described as: <br />B. Grantee, Monte C. Hack and Sheri S. Hack, are the owners of <br />certain real property located in Hall County, Nebraska, legally described as: <br />South Eighty Eight (88) feet, Lot Eight (8), Block Sixty Three (63) Original <br />Town, City of Grand Island. <br />C. Grantor desires to convey and grant and Grantee desires to receive <br />the grant of an access easement for purposes to place and maintain J a r sewer line <br />underneath ground owned by Grantor as more fully described herein. <br />NOW, THEREFORE, in consideration of the mutual promises and for <br />other good and valuable consideration, Grantor and Grantee agree as follows: <br />1. Grant of Easement. Grantor hereby grants to Grantee, their <br />successors and assigns, a non - exclusive and perpetual under the easement <br />premises consisting of space to allow the existing sewer line from Grantee's <br />property to the sewer main located in the alley north of Grantor's property. The <br />grant shall include the construction of a clean -out access trap and ability of <br />Grantee to maintain the sewer line all at Grantee's expense. Grantee shall not <br />damage or destroy any improvements made or on-Graptor4speitpncluding but <br />not limited to its concrete parking lot. In the eventGrait6e nee s td remove any <br />concrete or structure or excavate at any Iocati,Q . a ,ham,.., `only" with the <br />consent of Grantor. <br />2. Location of Easement. Grantee easement shall commence at a <br />point seventy six (76) feet north of the Southeast Caper of Grantor's property <br />where the clean out access trap is located. The easement shall extend from that <br />point in a Northwesterly direction twenty (20) feet and the , Northerly to the North <br />line of the property (alley) Fifty Six (56) feet.
