<br />MEMORANDUM OF TOWER LEASE AGREEMENT
<br />This Memorandum of Tower Lease Agreement is made this Rt) day of Mr1 , 2016,
<br />between Bosselman Pump & Pantry, Inc., f/k/a Bosselman, Inc., a Nebraska corporation, with its principal
<br />offices at 3123 W. Stolley Park Road, Suite A, P.O. Box 4905, Grand Island, NE 68802 -4905, hereinafter
<br />designated LESSOR and Verizon Wireless (VAW) LLC d/b /a Verizon Wireless, with its principal offices at
<br />One Verizon Way, Mail Stop 4AW 100, Basking Ridge, New Jersey 07920 (telephone number 866 -862-
<br />4404), hereinafter designated LESSEE. The LESSOR and LESSEE are at times collectively referred to
<br />hereinafter as the "Parties" or individually as the "Party".
<br />l at LESSEE entered into a Tower Lease Agreement (the "Agreement ") on
<br />oo , 2016, for an initial term of five (5) years, commencing on the
<br />Commencement Date. The Agreement shall automatically be extended for four (4) additional five
<br />(5) year terms unless the LESSEE terminates it at the end of the then current term by giving the
<br />LESSOR written notice of the intent to terminate at least six (6) months prior to the end of the
<br />then current term. If at the end of the fourth (4th) five (5) year extension term the Agreement has
<br />not been terminated by either Party by giving to the other written notice of an intention to
<br />terminate it at least three (3) months prior to the end of such term, this Agreement shall continue
<br />in force upon the same covenants, terms and conditions for a further term of five (5) years and for
<br />five (5) year terms thereafter until terminated by either Party by giving to the other written notice
<br />of its intention to so terminate at least three (3) months prior to the end of such term.
<br />2. LESSOR hereby leases to the LESSEE a portion of that certain space ( "the Tower Space ") on the
<br />LESSOR's water tower, hereinafter referred to as the "Tower ", located at Outlot 1, Block 2,
<br />Bosselville Subdivision, Hall County, Nebraska, more commonly referred to as W Wood River
<br />Road, Grand Island, Hall County, Nebraska, and being further described in a Warranty Deed
<br />recorded in the Office of Hall County Register of Deeds (the entirety of LESSOR's property is
<br />referred to hereinafter as the "Property"), together with a 30' x 54' parcel containing 1,620 square
<br />feet of land space (the "Land Space ") sufficient for the installation of LESSEE's equipment
<br />building; together with the non - exclusive right ( "the Right of Way ") for ingress and egress, seven
<br />(7) days a week, twenty -four (24) hours a day, on foot or motor vehicle, including trucks, and for
<br />the installation and maintenance of utility wires, poles, cables, conduits, and pipes over, under, or
<br />along a fifteen foot (15') wide right -of -way extending from the nearest public right -of -way, W
