<br /> to any ❑ther person. The representativns and warranties cvntained herein are based vn Trustor's du� diligence in
<br /> in�estigating the Property for Hazardvus Substan��s. Trustar hereby �1} refeases and wai�es any future claims
<br /> against Lender fvr indemnify ar contribution in �he e�ent Trus�or becomes liable for c�eanup v� other c�sts under

<br /> foregoing, Trus�or�rvill nv� remo��. o�grant to any other party the right to r�m��e, any timber, minerals {in�luding
<br /> oil and gas�, cva�, clay, scvria. soii, gra�el�r ra�k products without Lender's prior written cvnsent.
<br /> Remv�al of Impro�emen�s. Trustor sha�l nv#demaiish or rema�e any Imprv�ements fram the Real Praperfiy without
<br /> Lender's priar written consen#. As a canditivn to the remo�al of any Impro�ements, Lender may require T�ustvr ta
<br /> make arrangemen�s satisfactory ta Lender to rsplace such Impr��ements with Impro�ements a# a� ieast equa!

<br /> Lender's Right to Enter. Lender and Lender's agents and representat��es may �nter upon the l�eal Praperty at al�
<br /> reasonabie times ta attend �a Lender`s �nterests and t❑ inspect the Real Property for pu�pvses of Trustor's
<br /> c�mpl�ance with the terms and conditions af this Deed of Trust.
<br /> Cvmp�iance wi�h Go�ernmental Requirements. Trustor shali promp�tiy c�mply ►rvi�h a!i laws, ordinan�es, and
<br /> regulations, nvw or hereaf�er in eff��t, of all governmental au�hori�ies applicahie to the use or ac�upancy o�the
<br /> Property, including withou� �imitation. fihe Am�ricans V1lith Disabilities Act. Trustar may contes� in gvod faith any
<br /> such la►rv, ordinan�e, or regulati�n and withh�ld compliance during any prviceeding, inc�uding appropriate appeals,
<br /> so long as Trustor has nati�ied L�nder in writing privr ta doing sv and so Iong as, in Lender's so�e vpinivn, Lender's
<br /> interes�s in the Prvp�rty are not jeopardizedr Lender may require Trustvr to post adequate security or a surety
<br /> bond, reasonah{y satisfactvey to Lender, ta protect Lender's interest.
<br /> Duty tv Prvtect. Trustor agrees neither �o abandon vr isa�e unattended #he Property. Trus�or shall d� all other
<br /> acts, in addition tv thvs�acts set�orth abo�e in this sectian, which fram the�ha�-aG�er and use vf th� Property are
<br /> r�asonab[y necessary to protect and pr�ser�e the Property.
<br /> DUE ON SALE-CONSENT BY LENDER. Lender may, at Lender's option, decfare immediately due and payable all sums
<br /> secured hy this Deed of Trust upvn the sa�e ❑r transfer, without Lender`$ priar written cansent, vf all ar any part a�the
<br /> Rea[ Prvperty, or any interest in the Real Praperty. A "sa{e or transfer" means the con�eyance ❑� Real Prvperty or any
<br /> right� title or interest in the R�al Praperty; whether legal. �eneficial or equitable, wh��her valuntary or in�oluntary;
<br /> whether by outright sale, deed, installment sale contract, �and �ontrac�t. cantract for deed� �easehvld interest with a
<br /> term greater than three �3) years. lease-opti�n contract, or by sale, assignment. vr transfer❑�any heneficiai interest in

<br /> TAXES AND LIENS. Th� tallowing pravisians re[a#ing to the taxes and iiens on the Prvperty are part o�F this De�d vf
<br /> Trust:
<br /> Payment. Trus�or shall pay when due {and in all events prior ta definquency} aIl taxes, sp�cial#axes. assessments,
<br /> charges �including water and sewer�, fines and impasitians le�i�;d agains��r�n ac�aunt of the Property, and Shall
<br /> pay when due all claims for work done �n �r for ser�ices rend�red or material �urn�shed to the Prvperty. Trust�r
<br /> shall main#ain the Property free a�a�l liens having priority v�er ar equal ta the interest o�Lend�r under this ae�d vf
<br /> Trust, excep# for �he lien ❑f taxes and ass�ssments not due and except as otherwise pr��ided in �his Deed o#
<br /> Trust,
<br /> Right to Contest. Trustor may withhald paym�nt of any#ax. assessmenx, or�laim in connectian w�th a gvod faith
<br /> dispute o�er the o�iigation to pay, sv I�ng as Lender's interest in the Prvperty is nat jeopardized. If a E�en arises or
<br /> is filed as a resuit of nonpayment� Trustor shall wEthin fifteen t 15� days after the lien ar�ses or. if a lien is filed,
<br /> wi�hin fifteen {�5} days after Trustar has nvtice o�F fihe ��iing, secure the discharge of the lien, or if requested by
<br /> Lender, d�pvsit with Lender cash or a su�Fficien�corporat�surety bond vr�ther s�curE�y satisfactory ta Lender in an
<br /> am�un#sufifici�nt t❑ discharge the lien plus any costs and attorneys' �e�s, �r other charges that could accrue as a
<br /> resuft of a�For�closure or sa�e und�r the I�en. ln any contest, Trustor sha[�de�Fend itself and Lender and shall satisfy
<br /> any ad��rse judgment bef�re enforc�ment against the Prvpe�ty. Trustvr shat� name Lender as an addi�iona� ob�igee
<br /> under any surety bond furnished in th�contes't proceedings. �
<br /> Evidence of Payment, Trustor sha�! upQn demand �furnish to Lender satisfactory e�idence ❑f payment of the taxes
<br /> vr assessments and sha�i authorize the appropriate ga�ernmental o�Fficial to deliver to Lender a� any time a written
<br /> statem�nt�f the#axes and assessments against the Property.
<br /> Noti�e of Construction. Trustor shall notify Lender at least�ifteen t15f days �e�ore any ►rvvrk is commenced, any
<br /> ser�i�es are �urnished, �r any mat�rials are supplied to the Proper�y, if any mechanic's �ien. materialmen's iien, or
<br /> other lien could be asserted on accaunt o� th� wark, ser�ices, ar materials. Trustor will upvn reques� of Lender
<br /> furnish �o Lender ad�ance assu�ances satisfactory to Lend�r that Trustor can a�nd will pay the cost o� such
<br /> improvements.
<br /> PR�PERTY DAiVIAGE INSURAN�E. The fvE�owing prvvis�ons relating to insuring �he Property are a par#of this Deed ❑f
<br /> Trust.
<br /> Maintenance o� Insurance. Trustvr shal� procure and maintain pvlicies of fire insurance with s�andard extended
<br /> co�erage endarsements an a replacement �asis for the �uii insurable value cv�ering al! Impro�ements �n th� Real
<br /> Prvperty in an amvunt sufficien� to a�oid appl�cation of any cflinsurance clause, and with a standard mortgag�e
<br /> ciause �n#a�or�f Lender. Trus�ar sha1� also procu�e and maintain campr�h�nsi�e genera� liabi�ity insurance in such
<br /> cv�erage amaunts as Lender may request with Trustee and L�nd�r being named as addEti�na� insureds in such
<br /> liabifity insurance pol�c�es. Additiona�ly, Trustar shail maintain such o#her insurance, inctudEng but not iimited to
<br /> hazard, business �nt�rruption, and b�iler �nsurance, as Lender may reasonably require. Policies sha�i be written in
