March 8, 2016. <br />RaNae Edwards, City Clerk <br />2016017 8 <br />WHEREAS, an additional public utility easement is required by the City of Grand <br />Island, from TS12 Phase II, LLC, in Lot One (1), Sterling Estates Sixth Subdivision, City of Grand <br />Island, Hall County, Nebraska and more particularly described as follows: <br />A UTILITY EASEMENT LOCATED IN PART OF THE LOT 1, STERLING ESTATES SIXTH <br />SUBDIVISION, IN THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA, AND MORE <br />PARTICULARLY DESCRIBED AS FOLLOWS: <br />COMMENCING AT THE NORTHWEST CORNER OF SAID LOT 1, STERLING ESTATES SIXTH <br />SUBDIVISION; THENCE ON AN ASSUMED BEARING OF SO0 ALONG ME WEST LINE <br />OF SAID LOT 1, A DISTANCE OF 57.00 FEET; THENCE 589 A DISTANCE OF 15.00 FEET <br />TO A POINT ON THE EAST LINE OF AN EXISTING 15 FOOT UTILITY EASEMENT RECORDED IN <br />HALL COUNTY REGISTER OF DEEDS, INSTRUMENT NO, 201502481 DATED APRIL n, 2015 AND <br />SAID POINT BEING THE POINT OF BEGINNING; THENCE CONTINUING S89°00'34"E A DISTANCE <br />OF 13433 FEET TO A POINT ON THE WEST LINE OF AN EXISTING 20 FOOT UTILITY EASEMENT <br />RECORDED IN HALL COUNTY REGISTER OF DEEDS, INSTRUMENT NO. 201502481 DATED <br />APRIL n, 2015; THENCE S00 ALONG SAID WEST LINE OF AN EXISTING 20 FOOT <br />UTILITY EASEMENT, A DISTANCE OF 20.00 FEET; THENCE N89 A DISTANCE OF 134.33 <br />FEET TO A POINT ON THE EAST LINE OF SAID 15 FOOT UTILTY EASEMENT; THENCE <br />N00°59'26”E, ALONG SAID 15 FOOT UTILITY EASEMENT A DISTANCE OF 20.00 FEET TO THE <br />POINT OF BEGINNING. SAID UTILITY EASEMENT CONTAINS A CALCULATED AREA OF 2686.56 <br />SQUARE FEET OR 0.06 ACRES. <br />WHEREAS, an Agreement f or the public utility easement has been reviewed and <br />approved by the City Legal Department. <br />NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF <br />THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, <br />authorized to enter into the Agreement for the public utility easement on the above described tract of <br />land. <br />BE IT FURTHER RESOLVED, that the Mayor is hereby authorized and directed to <br />execute such agreement on behalf of the City of Grand Island. <br />Approved as to FORti <br />Altirch 7, 2016 <br />
