<br /> Nuisance, Vllaste. Trustor shall not cause, canduct ❑r permit any nuisance nar commit, perm�t, o� suffer any
<br /> stripping of or wast� an or to the Prvperty �r any portion of th� Prop�rty. 1lVithou� limi�ing �he g�n�raiity o# �he

<br /> Remn�a!vf Imprv�ements. Trus�or shall n��demolish or remo�e any �mpro�ements fr�m the Real Property without
<br /> Lender's pr�or w�itten �onsent. As a condifiivn tv the remo�al �f any Impro�ements, Lender may require Trustor to
<br /> make arrangem�nts satis�ac�o�y '�o Lender t❑ replace such lmp�-v�ements wi�h Imprv�ements o� at feas� equal
<br /> �alue.
<br /> Lend�r`s Right tv Enter. Lender and Lender's agents and r�presenfiati�es may enter upan the Reaf Pr�pe�ty a� all
<br /> reasanab�e t�mes �a a�tend to Lender's interests and to inspect the Reaf Prope�ty for purposes of Trustor's
<br /> comp�ian�� with the terms and condi�ions of this De�d of Trust.
<br /> Cvmplian�e w�th Gv�ernmen#al Requirements. Trustor shall promp�ly camply with al[ faws, �rdinances, and
<br /> regula�ivns, naw or he�eafte� in e���ct, o� a�� go�ernmental autharities applicable to the use or occupancy of the
<br /> Proper�y, including without Iimitation, the Am�ricans W�th ❑�sab�lities Act. Trustor may contest in good fai�h any
<br /> such faw, ordinance, ar regu[a#ian and withh�fd c�mp��ance during any proc��ding, including appropriate appeals,
<br /> so long as Trustor has notified Lender in writing prior t�d��ng s� and so iong as, in Lender's svle vpinion, Lender`s
<br /> inte�ests in the Prop�r�y are no'� jeopardized. Lender may require Trustor to post adequate security ar a surety
<br /> band, reasonah�y satisfac�ory to Lender, �o pro�ect Lender's interest.
<br /> Duty to Prntect. Trustor agrees n�ither to abandan or �ea�e una�tended the Property. Trustor shall do all other
<br /> acts, in additian�o those acts set f�rth abo�e in this s�cfiion, which�rom the character and use of the Property are
<br /> reasonably necessary to protect and pr�ser�e the Property.
<br /> DUE�N SALE� C�NSENT BY LENDER. Lender may, at Lender's opt�on, declare immedia�ely due and payable all sums
<br /> se�ured by this Deed of Trust upon�he sa[� or�rans�er, withvut Lender's p�ior wri��en consent, of al[ or any par�of the
<br /> R�a� Proper�y, or any inter�st in the Rea[ Property. A "sale o�trans#er" means the �vn�eyan�e of Rea� Prope�ty or any
<br /> right, title or interes� €n the Real Property; whether I�ga�, beneficia� or e�uitahie; whe�Cher �oluntary ar in�oluntary;
<br /> whether by outright sale, deed, installment safe cvntract, land �ontract, contract for deed, feasehafd interest with a
<br /> term greater�han three �3} years, lease-vptivn contrac't, or by safe, assignment, or�ransfer o� any benefi�ial int�r�st in
<br /> or t� any land trust halding ti�le �o �he Real Proper�y, or by any other method of con�eyance o# an in�erest in the Real
<br /> Property. H�w��sr, this optivn shall nat be exer�ised by Lender if such exer�ise �s prohibited by federal law or by
<br /> Nebraska law.
<br /> TAXES AND LIENS. The �ollowing p�o�isions relating t❑ the �axes and liens an �he Property are part ❑f �his Deed ��
<br /> Trus�:
<br /> Paym�nt. Trus�or shall pay when due �and in a�� e�ents prior�a delinquency} a�l taxes, special taxes, assessments,
<br /> charges ��n��uding wa�er and sewery, #ines and impositions I��ied against or on ac�ount of the Property, and shall
<br /> pay when due a11 claims far wvrk dvne on or fiar ser�ices rendered ar materia[ furnished to fihe Prop�rty. Trustar
<br /> shaff maintain�he P�oper�y free of all �iens ha�ing privri�y o�er vr equal to the interest of Lender under this Deed af
<br /> Trust, ex�ept �or the ��en o� taxes and assessmen�s nv� due and except as otherwise pro�ided in this Dsed of
<br /> Trust.
<br /> Right to Contest. Trustor may w�thhold payment vf any tax, assessmen�, or claim in Cannection with a good faith
<br /> dispute❑�er the ob�igation�o pay, so long as Lender's interest in the Property is no'�jeopardized. [f a [ien arises or
<br /> is filed as a resu[t of nonpayment, Trustor shaii within fi#teen 415� days a#ter the lien aris�s or, i� a [ien is �ifed,
<br /> wi�hin fifteen ��5� days after Trustor has notice v� the #iling, se�ure the discharge of the fien, or i# reques�ed hy
<br /> Lendsr, deposi�with Lender cash❑r a su��icient carporate surety hond or other se�uri�y satisfiactory to Lender in an
<br /> amaunt suffi�ient ta discharge the fien pfus any costs and a�torneys' �ees, or other charges that couid accrue as a
<br /> resu��of a #oreclasure or safe under the lien. In any cantest, T�ustar shall defend itself and Lender and shall satisty
<br /> any ad�e�-se judgmen�before enfarcement against the Prop�rty. Trustor shai� name Lender as an additional vblig�e
<br /> under any surety bond furnished in th� contest proceedings.
<br /> E►►idence af Paymenfi. Trus�or shall upon demand furnish �a Lender satis�actory e�idence of payment o�the taxes
<br /> vr assessments and shall authari�e th� appropriate go�ernmenta� a�f�cial ta deli�er to Lender a� any time a written
<br /> statement o#the taxes and assessmen�s agains�the Property.
<br /> Notice o# Cvnstru�#ion. Trus�ar sha11 nv�ify Lender at least fif�een �1�y days before any work is commen�ed, any
<br /> ser�i�es are fu�nished, or any materials are supplied to the Property, if any mechanic's lien, materialmen's lien, or
<br /> other [ien �ould be asserted on accoun� af �he work, ser�ices, ar ma'terials. Trustor will upfln request of Lender
<br /> �Furnish ta Lende� ad�ance assurances satisfia��ory to Lender that Trustor can and will pay the cost o'� su�h
<br /> impro�ements.
<br /> PR�PERTY DAMAGE INSURANCE. The following pro�isions relating tv insuring the Praperty are a part vfi this Deed o�
<br /> Trust.
<br /> Ma�ntenance of Insurance. Trustvr shall procure and maintain policies of fire insurance w�th standard extended
<br /> co�erage �ndorsements an a repla��ment basis �or the '�ull insurable �alue ca�ering al� �mpro�emen�s on the Real
<br /> Property �n an amQunt su�fici�nt to a�oid application of any coinsurance �lause, and with a standard mvrtgagee
<br /> clause in fa�ar❑f Lender. Trustor shall alsa pracure and main�ain camprehensi�e general liability insurance in such
<br /> cv�erage amounts as Lender may request w�th Trus�ee and Lender being named as additional insureds in such
<br /> [iabili�y insuran�e palicies. Additionaily, Trustor shall mainfiain SLiCh other insurance, inc[uding but na� limited ta
<br /> hazard, business interruptian, and bviler insurance, as Lender may reasonably require. P�[ic�es sha�l be written in
<br /> form, amounts, co�erages and basis reasanably accepta�le ta Lender and issued by a company or �ompanies
