<br /> release vr thr�at�ned release of any Ha�ardous Substance by any person on, under, about o� �rom the Property;
<br /> {2� Trustor has no knowledge of, or reason to belie�e that there has been, except as pre�iously disclosed to and
<br /> acknow[edged by Lender in writing, �ay any breach or �iolation af any En�ir�nmenta� Lav+rs, 4b� any use,
<br /> generation, manu#acture, s�orage, �reatment, disposal, release or threaten�d release o� any Hazardous Substance
<br /> an, und�r, about or �rrvm the Proper�y by any privr ov►rners �r �ccupants af the Property, or �c� any a�tuaf or
<br /> threatened litigat�an ar claims ❑f any kind by any p�rson relating t� such matters; and �3} Excep� as pre�iaus[y
<br /> disclosed to and acknowledged by Lender in writing, {ay neither Trustvr nor any tenant, contractar, agen�vr vther
<br /> au�horized us�r o�the Praperty shall use, generate, manufac�ure, store, treat, dispase o�or release any Hazardous
<br /> Subs�ance on, under, abvut�r frvm the Property; and �b� any such acti�ity shaff b� conducted in compliance with
<br /> all applicable fiederal, sta�e, and �o�al iaws, regulations and �rdinances, inc�uding without �imi�ation a��
<br /> En�ir�nmental Laws. Trustor au�horizes Lender and its agents to enter upon the P�operty t❑ make su�h
<br /> inspections and tests, a� Trus�or's exp�nse, as L�nder may d��m apprvpriat� �o determine cvmpliance of the
<br /> Prvperty with this se�tion of the De�d vf Trust. Any inspections or �ests made by Lender shall he #or Lender's
<br /> purposes vnly and shall not be canstrued to create any responsihiiity vr �iabi�ity vn the part of Lender to Trustor or
<br /> to any other person. The representations and warranties contained herein are based on Trus�or's due di��g�nce in
<br /> in�estigating the Prvperty �vr Hazard�us Su�stanc�s. Trustor hereby �1� �e�eas�s and wai�es any fiuture claims
<br /> against Lender �or indemnity vr contri�ution in �he e�ent Trustor b�comes liable for �leanup or ❑ther costs under
<br /> any such laws; and 4�� agrees to indemnify, defend, and ho�d harm�ess L�nder aga�nst any and all �laims, losses,
<br /> liabi�it��s, damages, penal�ies, and expenses which Lender may d�rect�y or ind'€rect�y sustain or suffier resulting from
<br /> a breach of�his section of the ❑eed of Trust vr as a consequence af any us�, g�neratian, manufa�ture, starage,
<br /> disposa[, re�ease or threat�ned release o�curring prior ta Trustar's o�,rvnership or interest in the Proper�y, whether or
<br /> not �he same was ar should ha�e been known �o Trustor. The p�v�isions vf this section of the D�ed of Trust,
<br /> including the ob�igat�on to indemnify and defiend, shall sur�i��the paymen�t of�he Indebt�dn�ss and the satisfaction
<br /> and recon�eyanc� v�the kien��this Deed of Trust and shall nat be affiected by Lender's a�quisitian of any interest
<br /> in the Prvperty, wheth�r by fvreclosure or o�herwise.
<br /> Nuisancer VIIdS�B. Trustor shall no� cause, �onduct ar permit any nuisanc� nor commit, permit, or suffer any
<br /> stripping of or waste on or ta the Praperty vr any por�ian of �he Property. V1lithaut limiting the generality of the
<br /> faregoing, Trustor wil� not remo�e, �r grant to any a�her par�y the righ�to remo�e, any ��mbe�, m�nerals 4including
<br /> oil and gasy, coaf, c�ay, sco��a, soil, gra�el ar rock produc�s withou�Lender's prior written �onsent.
<br /> Remv�al of�mprv�ements. Trustar shall not demolish or remo�e an� [mpro�ements fram the Rea[ Prop�rty withou�
<br /> Lender's prior wri��en c�nsent. As a ��ndifiivn tv the rem��a� of any Impro�ements, Lender may require Trustor to
<br /> make arrangements satisf�ctory fio Lender to replace such lmpraErements with lmprv�ements of at least equal
<br /> �alu�.
<br /> Lender's Right to Enter. Lender and Lender's ag�nts and representatives may enter upan the Real Property at all
<br /> reasvnab�� times to a��end �v Lender's interests and to inspe�t the R�af Property for purposes of Trusta�'s
<br /> compliance with the terms and condi�ions vf this Deed vf Trus�.
<br /> Cvmpliance with GoWernmen�ai Requirements. Trustvr shaff prvmpt�y comp[y with all laws, ordinan�es, and
<br /> regulatians, now or hereafter �n effec�, of all governmen�al authorities app[�cable t� �he use ar accupancy a� �he
<br /> Property, inc�uding without limi�a�ion, th� Americans With Disabilities Act. Trustor may cantes� in govd faith any
<br /> such law, ordinan�e, or regula�ion and withhold compliance during any proceeding, includ�ng appropriate appeals,
<br /> so long as Trustor has nv�ified Lender in writing prior�o doing sv and sa long as, in Lender's sale apinion, Lender's
<br /> interes�s in the Praperty are not jeopardized. Lender may require Trustor to post adequate security or a surety
<br /> bvnd, reasonably sat�sfa�tory tv Lender, t❑ pra�ect Lender's interes�.
<br /> Duty to Protect. Trustor agrees neither to abandvn or lea�e unattended the Property. Trustar sha11 do all vther
<br /> acts, in addi�ian ta those acts set fa�th aba�e in this section, which�rom the character and use ��the Proper�y are
<br /> reasonah�y necessary t� pr�tect and p�eser�e the Prope�ty.
<br /> DUE ON SALE-C�NSENT BY LENDER. Lender may, at Lender's option, declare immedia�ely due and payabl� all sums
<br /> se�ur�d by�his Deed �f Trus�upan the sa[e or trans�er, wifihout Lender's prior wri�ten �onsen�, of all or any part of the
<br /> Real Property, ar any in�erest in the Real Property. A "sa�e ar t�ans��r" means the con�eyance of Real Property vr any
<br /> right, title vr interest in the Real Proper�ty; whether lega[, bene�ic€a{ ❑r �quitab�e; whether �vluntary ar in�o�untary;
<br /> whe�her by outright sa1e, deed, �ns�allment safe contract, land c�ntract, cflntract fvr deed, feasehold interes� with a
<br /> term greater than �hree �3� years, �ease-op�ion contract, or �y sale, assignment, or�ransfi�r o�any beneficial inter�st in
<br /> or tv any land �rust hofding title ta the Real Prvper�y, or by any other method of con�eyanc� o� an in�eres� in the I�ea!
<br /> Property. Howe�er, this option shall not be exercised by Lender if such exercise is proh€�ited by f�deral law ar by
<br /> Nebraska �aw.
<br /> TA�lES AND L[ENS. The fo[Evwing prv��sivns relating to the tax�s and liens vn �he Property are pa�t a� th�s C]eed of
<br /> Trust:
<br /> Paym�nt. Trustvr shall pay when due �and in a�� e�ents pr�or�o deiinquency} all taxes, special taxes, assessments,
<br /> charges �inciuding water and sewer�, fines and imp�s�ti�ns le�ied against ar on account of the Property, and shali
<br /> pay when du� al1 claims for work done on ar for ser�ices rend�red �r materiai �urnished tv the Prap�r�y. Trustar
<br /> shall maintain�h� Property free Qf all liens ha�ing priority a�er ar equal �o the int�rest o�Lender under this Deed o�
<br /> Trust, except for the iien ❑� taxes and assessments not due and �xc�p� as otherwise pro�ided in �his Deed a�
<br /> Trust.
<br /> Ri�h#to Con�est. Trustor may v+iithhold payment of any tax, assessmen�, vr claim in cannecfiion with a good faith
<br /> disput�o�er the obfigation t� pay, s� I�ng as Lender's interest in the Proper�y €s not jeopardi�ed. I�a lien arises vr
<br /> is filed as a result of nonpayment, T�ustar sha�� within fifteen �15� days after the �ien aris�s or, if a lien is �iled,
<br /> within �i�teen ��5� days af#er Trust�r has not�ce v� the filing, secure the discharge of the lien, vr i� reques�ed by
<br /> Lender, depvsit wi�h Lender cash or a su�ficient corporate surety bond or other se�urity satisfa�tory to Lender in an
<br /> amount suf�icien�to discharge the lien p�us any c�sts and attorneys' #ees, or vther charges tha�c�u�d accrue as a
<br /> resu[t�f a#oreclosure or sale under the lien, ln any contest, Trusxor shal�de�end itself and Lender and shal! satisfy
<br /> any ad�erse judgmen�before enforcement against the Prape�ty. Trustor shall nam� Lender as an additional obligee
<br /> unde�any sure�y �ond furnished in the c�ntest pr�ceedings.
<br /> E�iden�e of Paymen�. Trustor shalf upon demand furnish tv Lender satisfactary e�idence ❑f payment of the taxes
<br /> ar assessmen�s and shal[ authorize the approp�iate gv�ernmental official to deli�er to Lender at any time a written
<br /> statement o�the�axes and assessments against the P�operty.
<br /> Notice of Construc�ivn. Trustar shal[ nvtify Lender at least �ri�teen {15} days befvre any work is commenced, any
<br /> ser�ices ar� fu�nished, or any materiafs are suppfied to �he P�operty, if any mechanic`s lien, mat�riafinen's I�en, �r
<br /> o�her lien could he asser�ed on account of the w�rk, s�r�icss, or materiais. Trustor will upon requesfi o� Lend�r
<br /> �urnish to Lende� ad�ance assurances satisfactory t� Lend�r that Trustor can and will pay the cost o� such
