The f�llowing pro�isions ��ncerning Existing Endebtedness are a part❑f this ❑eed ❑f Trust: <br /> Existing Lien. The lien of this Deed of Trust securing the Indebtedness may be se�ondary and inferior to an <br /> existing lien. Trustor express�y co�enants and agrees to pay, vr see fi❑ the payment of, the Existing indebtedness <br /> and �to pre�ent any default an such indebt�dness, any default under th� instruments e�idencing suc� indebtedness, <br /> ar any default under any security documents for such indebtedness. <br /> Na Modification. Trustor shall not �nt�r int❑ any agreement with the holder of any mortgage, deed ❑f trust, or <br /> other� security agreement which has priori�y o�er this ❑eed of Trust by which that agreement is modified, <br /> amended, extended, or renewed without the prior written �onsent of Lender. Trustor shall neither requ�st nor <br /> accept �ny futu�e ad�ances under any such secur�ty agreement withnut the prior written consent af Lender. <br /> C�NDEMNATI�N. The fall�wing pro�isi�ns relating t❑ condemnation proceedings are a part❑f this De�d of Trust: <br /> Proc�edings. Ifi any prnceeding in condemnatian is filed, Trustor shall promptly notify Lender in writing, and <br /> Trustar shall promptly take such steps as may be necessary to defend the action and abtain the award. Trustor <br /> may be the nominal party in su�h proceeding, but Lender shal� be entitied ta participate in the proceeding and to be <br /> repr�sented in the proGeeding by �ounsel ❑f its ❑wn chai�e, and Trustor will deli�er ar cause t� be deli�ered to <br /> Lender such instruments and documentation as may be reques�ed by Lender from time to time to permit such <br /> parti�ipation. <br /> Applicativn of Net Proceeds. If all ❑r any part ❑f the Property is cond�mned by eminent domain proceed�ngs ar by <br /> any proceeding ❑r pur�hase in I�eu ❑f condemnat�an, Lender may at its election require that ali ❑r any portian ❑f the <br /> net proceeds af the award be appli�d to the lndebtedness or the repair or restoratian af the Prape�ty. The net <br /> proc�eds of the award shall mean the award after payment ❑f all reasonable casts, expenses, and attorneys' #ees <br /> incurred by Trustee or Lender in connectian with the c�ndemnation. <br /> IMP�S�TI�N ❑F TAXES, FEFS AND CHARGES BY G�VERNMENTAL AUTh�R�T�ES. The tollov►iing pro�ision� r��at+ng <br /> to go�ernmental taxes, fees and charges are a part of this ❑eed �f Trust: <br /> Current Taxes, Fees and Charges. Upon request by Lender, Trustor sha[I execute such documents in additian to <br /> this Deed ❑f Trust and take whate�er other action is reques�ed by Lender t❑ perfect and �ontinue Lender's lien on <br /> the Real Property. Trustar shall reimburse Lender for al� taxes, as described helow, together with a!i expenses <br /> incurred in re�arding, perfecting ❑r cantinuing this Deed of Trust, including without limitation all taxes, fees, <br /> doc�mentary s�tamps, and ❑ther charges for re��rding ar r�gistering this ❑eed of T�u�t. <br /> Tax�s. The fal�owing shall canstitute taxes to wh�ch this section applies: �1} a sp��ific tax upon this type of <br /> Deed ❑f Trus� or upon all or any part af the Indehted�ess secured by this Deed ❑f Trust; ��f a specific tax an <br /> Trustor which Trustor is authorized or required to deduct fram payments on the Indebtedness secured by this type <br /> af DPed af Trust; �3� a tax on this type of ❑eed of Trust chargeable aga�nst the Lender or the holder of�h� Note; <br /> and �4y a specific tax ❑n afl or any por��on of the Indeb�edness ar on payments o� principal and interest made by <br /> Trustor. <br /> Sub�equent Taxes. �f any tax ta whi�h this section applies is enacted subsequent to the date of this ❑eed of <br /> Trust, this e�ent shall ha�e the same eftect as an E�ent of De�Fault, and �ender may exercise any or all o� its <br /> a�ailable remedies for an E�ent ❑f Default as pro�ided belaw unless Trustor either {1 y pays the tax before it <br /> k�ecames del�nquent, ❑r ��y contests the tax as pro�ided aba�e in the Taxes and Liens sectian and deposits with <br /> Lender cash ❑r a sufficient corporate surety b�nd or ather security satistactory t❑ Lender. <br /> SECURiT'Y AGREEMENT; FINANCING STATEMENTS. The following pro�isions �elating to this Deed of Trust as a <br /> security �greement are a part❑f this Deed ❑f Trust: <br /> Security Agreement. This instrument shall constitute a Security Agre�ment �o th� extent any of the Property <br /> cflnstitutes �ixtures, and Lender shall ha�e all of the rights of a secured party under the �niform �ommer�ial Code <br /> as amended fram time t❑ time. <br /> Security Interest. Upon request by Lender, Trustar shall take whate�er actian is requested by Lender to perfect <br /> and cantinue Lender's s�curity interest in the Rents and Persanal Prap�rty. In addition ta re�ording this ❑eed of <br /> Trust in the real praperty records, Lender may, at any time and with�ut further authorization �rom T�ustar, file <br /> executed eounterparts, copies or reproductions of this Deed of Trust as a financing statement. Trustor shall <br /> reim&�urse Lender far all expenses incurred in perfecting ❑r cantinuing this security interest, Upon default, Trustar <br /> shatl not rema�e, s��er or deta�h t�e Personal Praperty fram the Property. Upon detault, Trustar shall asserr�rb�e <br /> any Personal Property nat affixed t❑ the Praperty in a manner and at a place reasona�ly con�enient t❑ Trustor and <br /> Lender and make �t a�ailable t❑ L�nder w+thEn three �3� days af��r receipt af written demand from Lender t❑ the <br /> extent permitted by applicable law. <br /> Addresses. The mailing addresses of Trustor �de�tor} and Lender �secur�d party} from which infarmation <br /> cancerning the security interest granted by this Deed ❑f Trust may be �b�ained {each as required by the Llniform <br /> Commerciaf Code} ar� a� stated on the first page af�his De�d ot Trust. <br /> FURTHEF� A55URANCES; ATTQRNEY-IN-FACT.
