<br /> 2'I. HazardausSubstances.As used in this Seetion�1: (a} "I�aza�dau.s,Su�.stance.s"are those substances
<br /> defined as toxic or hazardous substances,pal�utants,or wastes by En�ri.ron.menta,l Law and the following
<br /> �ubsta.nces: gasoline,kerosene,other flammable or taxic petroleum produets,toxic pesticides and herbicides,
<br /> volatile solvents, materials cantaining asbe�tos ar forma�dehyde, an�1 radioacti�e materials; (b}
<br /> "Er�viro�rr�er�tal Law"means federal laws and laws of the jurisdiction where the Property is Iflcated that
<br /> r��ate to health, safety or envirvnm�ntal protection; (c} "Ercvi�onme�tal Clea�up"includes any response
<br /> action, remedial act�on, or remova�action, a.s d�f�ned in Environmenta.l Law; and(d}an "Er�vi�or�►ner�tal
<br /> Cor�ditiora"means a condition that can caus�, contribute to, or atherwise trigger an En�riron.mental Cleanup.
<br /> Borrower sha11 not caus�or permit the pr�sence,use,disposa�, storage,or release of any Ha�ardous
<br /> Substa.nces,or threaten to release any Hazard�us Substances,on�r in the Property. �or�rawer shall nat do,
<br /> nor al�ow anyone else to do,anyth�ng affecting the Property(a}that is in v�o�ation of an�Envixonmenta.l
<br /> Law, (b}which creates an�nviranmental Condition,or(c)which,due to the presence,use,or release of a
<br /> Ha�ardous Su�astance,creates a condition that adve�sely affe��s the value of the Property. The preceding�wo
<br /> sent�nc�s shall na�apply to the presence,use,or storage on the Property of sma11 quantities of Ha2ardous
<br /> Substances that are�enerally recognized to be appropriate to normal resident�al uses and ta maintenance of
<br /> the Pr�perty(including,but not 1imi�ed to,hazardous sub�tances in consumer product��.
<br /> Borro�er sha11 promptly g�ve Lender�vritten notice of(a)an.y investigation,claim,demand, lawsuit or o�her
<br /> act�on by an�r go�ernmenta.l or regulatory agency or private party in�olving the Pr�perty and any Ha�ardous
<br /> Substance or Environmental Law of which Bonower has actual kno��edge, (b}any E�vironmenta.l
<br /> Condition, including but not limited toA any spilling, leaking,discharge,release or threa�of re�ease of any
<br /> Hazar�iou�Substance,ant��c}any condition caused b��he presence,use or release af a Hazardous Substance
<br /> �vhich adversel�affects the value of the Prop�rty. If Borraw�r�earns,or is notified by any gav�rnmen�tal or
<br /> regulator�authori�y,or any pr�vate party,that any removal Qr other remediation of any Ha�ardaus Substance
<br /> affecting�he Propert�is necessary, Borrower shal�prom�tly take aIl necessary remedial actions in
<br /> accardance with Environmenta.l Law.Nathing herein sha11 create any obligation on Lender f�r an
<br /> En��.ron.rr�enta���eanup.
<br /> Non�Uniform�o�enants.Borrower and Lend�r covenant and agree as fallo�s:
<br /> 22. Acceler�tion;Remedies.Lender shall give notice to Bvrro►�ver prior to a�ce�erat�Qn following
<br /> Borrawer's breach of an����enant vr agreement in this�ecurit�Instrument�but nat pri�r�o
<br /> a�celerat��n under Section 18 unless Applicable Law provides��herwise�,The notice shall spec�fy: �a}
<br /> the default; �b}the action required to cure the c�efaui�; �c�a dat�,not�ess than 3�da�s fram the date
<br /> the natice is given ta Barrower,by which the default must be cure�; and�d}that failure to cure the
<br /> default on or before the date�pecified in the not�ce may result in acceleration of the sums secured by
<br /> this�ecurity Instrument and sale of the Property.The n�tice shall further infvrm Borrov�er of�he
<br /> rig��to re}nstate after acc�ler�tior�and the right to bring a cvur�act�on t�assert the n�n-existen�e of a
<br /> default or any other defense of Btirrower to acceleration and sale.If the default is not cured on ar
<br /> before the date spe�ified in the notice,Lender at its option may require immed�ate payment in full vf
<br /> all sums se�ured by this S�curity Instrument without further d�mand and may invoke th�power of sale
<br /> and any other remedies permitted by Appli�able Law.Lender�hall be entitled to collect all expenses
<br /> incurred in pursuing the remed�es provided in�this Section 22,inc�uding,but not limit��to,reasonable
<br /> attorneys'fees and�asts of title evidence.
