200002933 <br />ORDINANCE NO. 8579 (Cont.) <br />running north on the west line of said Southeast Quarter of the Southwest Quarter <br />(SE' /4 SW' /4) for a distance of Thirty (30.0) feet; thence running east on a line <br />parallel to and Sixty Three (63.0) feet north of the south line of said section for a <br />distance of Ten (10.0) feet; thence running north on a line parallel to the west line <br />of said Southeast Quarter of the Southwest Quarter (SEt /4 SWt /4) for a distance of <br />Four Hundred Sixty Three and Five Tenths (463.5) feet to the south line of the <br />easement granted the City of Grand Island, recorded in Miscellaneous Book 14, <br />Page 676, in the Hall County Register of Deeds Office; thence running east on the <br />south line of said easement, which line is also parallel to the south line of said <br />section for a distance of Ten (10.0) feet; thence running south on a line parallel to <br />the west line of said Southeast Quarter of the Southwest Quarter (SEt /4 SW' /4) for <br />a distance of Four Hundred Ninety Three and Five Tenths (493.5) feet to a point <br />Thirty Three (33.0) feet north of the south line of said section; thence running <br />west on a line parallel to the south line of said section for a distance of Twenty <br />(20.0) feet to the point of beginning, said easement containing 0.12 acres, more or <br />less, as shown on the plat attached hereto as Exhibit "A" and incorporated herein <br />by this reference; <br />is hereby vacated. <br />SECTION 2. The title to the property vacated by Section 1 of this ordinance shall <br />revert to the owner or owners of the real estate abutting the same in proportion to the respective <br />ownership of such real estate. <br />SECTION 3. Upon vacation of the above - described easement, any special <br />contractual arrangements between the City of Grand Island and the original Grantor(s), their <br />successors and assigns, shall survive this action to vacate said easement and shall be considered a <br />term and condition of the corrected public utility easement granted to the City in order to correct <br />the misalignment of the tracts and improvements. <br />SECTION 4. This ordinance is directed to be filed in the office of the Register of <br />Deeds of Hall County, Nebraska. <br />SECTION 5. This ordinance shall be in force and take effect from and after its <br />passage and publication, without the plat, within fifteen days in one issue of the Grand Island <br />Independent as provided by law. <br />Approved as to Form <br />- 2 - March 24, 2000 A City Attorney <br />
