Werner, being first duly sworn upon oath, disposes and states that: North Half of the Northeast Quarter (NY2NE1/4) of Section Eleven (11), Township Nine (9) North, Range Twelve (12) West of the 6th P.M., Hall County, Nebraska, except tract conveyed to the County of Hall for road R.O.W. recorded as Document No. 92- 104174 in the Register of Deeds Office in Hall County, Nebraska 1. Gordon H. Robbins of Hall County, Nebraska died on November 5, 1983 (the "Decedent "). 2. The Last Will and Testament of Gordon H. Robbins dated February 3, 1982 and Codicils thereto dated October 28, 1982 and June 28, 1983 (the "Decedent's Will ") were filed for probate in the County Court of Hall County, Nebraska at Case No. P83 -204. 3. At ARTICLE IX of the Decedent's Will, the Decedent provided for the creation a testamentary trust known as the GRANDCHILDREN TRUST for the benefit of the Decedent's grandchildren Johannes Robbins and Adrienne (Robbins) Messere. 4. At ARTICLE IX of the Decedent's Will, First National Bank of Grand Island and Arthur C. Mayer of Grand Island were designated as Co- Trustees of the trust known as the "GRANDCHILDREN TRUST ". 5. At ARTICLE X of the Decedent's Will, the Decedent provided for the creation of a testamentary trust known as the "CHARLES G. ROBBINS TRUST" for the benefit of the Decedent's son, Charles G. Robbins. 6. At ARTICLE X of the Decedent's Will, L.F. Haug was designated as Trustee of the trust known as the CHARLES G. ROBBINS TRUST; however, L.F. Haug never served as Trustee of said CHARLES G. ROBBINS TRUST and First National Bank of Grand Island and Arthur C. Mayer of Grand Island were designated as successor Trustees of said CHARLES G. ROBBINS TRUST. 7. Arthur C. Mayer served as Co- Trustee of the GRANDCHILDREN TRUST and as Co- Trustee of the CHARLES G. ROBBINS TRUST from the date of the initial funding of both Trusts on September 18, 1985 until September 20, 2002, at which time said Arthur C. Mayer resigned as a Co- Trustee of both of the aforesaid Trusts. 8. Effective upon the resignation of Arthur C. Mayer on September 20, 2002 as Co- Trustee of the GRANDCHILDREN TRUST and the CHARLES G. ROBBINS TRUST as referenced hereinabove at Paragraph 7., Norwest Bank Nebraska, N.A. formerly First National
