<br /> Trus�ar'� ownership o�the Property, �here has been no use, gen�ratian, manufacture, s�arage,tr�atment, dispvsal,
<br /> release ar threat�ned rel�ase of any Hazardous 5ubs�an�e by any person on, under, a�oufi or fr�m the Proper�cy;
<br /> ��} Trustar has na knawledge of, or reason to belieWe that th�re has been, ex�ept as preWiously dis�lased to and
<br /> acknowledged by Lender in writing, tay any breach ar �iola�ion of any Environm�ntai Laws, �h} any use,
<br /> g�neratian, manufiacture, storage, trea�menfi, dispasal, r��ease or threa�ened release af any Ha2ardous 5ubstance

<br /> inspections and �ests, a� Trustor's ex�ense, as Lender may d��m appropriate t� determine compiiance a� the
<br /> Prvper�y wi�h this s�ction �f the ❑eed �f Trus�. Any inspections Qr �es�s made by L�nd�r sha�l be fior Lender's
<br /> purposes only and shail nat be construed �o cr�ate any responsibili�y ar liability on th� part�f Lend�r to Trust�r❑r
<br /> to any other persan. The repres�n�ati�ns and warrant�es cantained h�r�in are based an Trustor's due dil�gence in
<br /> in�estigating �he Property �ar Hazardous Subs�ances. Trustor h�r�by �1� reieases and wai�es any future claims
<br /> against Lender for indemnity ❑r c�ntributian �n the event Trus�ar �ec�mes liabfe for c�eanup or other costs und�r
<br /> any such laws; and {�} agrees ta inclemnify, defend, and hoId harmless Lender agains� any and al� claims, Eosses,
<br /> liabilities, damages, penaltiss, and expenses which Lender may directly or indirec�ly sus�ain or suffer resulting from
<br /> a breach �f this sectian of the Deed of Trust ❑r as a consequ�nc� af any use, �enera�ion, manufa�ture, s�orage,

<br /> Nuisance, Vllaste. Trustor sha11 nat �ause, conduc� or permit any nuisance nor commit, permit, or su��er any
<br /> stri�ping �f or waste Qn or t� the Praperty or any parti�n of the Property. Withaut limiting the g�nerality of the
<br /> foregoing, Trustflr wEll not �emove, or grant to any ❑ther party the ri�ht ta remave, any timber, minerais {inc�uding
<br /> ❑i� and gas}, cval, clay, scoria, soil, gravel ❑r rocic pr�duc�s without Lender's prior written consen�.
<br /> Rem��al af�mprv�ements. Trust�r shal! na�demoiish ❑r rema�e any lmpra�emen�s fram the Real Pr�p�rty w#�h�ut
<br /> Lende�`s prior writ-�en cons�nt. As a condi�ion to th� remo�al o�any ImproWements, Lend�r may r�quire Trustor to
<br /> make arrangements satisfactory to Lender to replace such Impro�emen�s w�th ImproWements af a� least equal
<br /> �alue.
<br /> Lender's Right to Enter. Lender and Lend�r's agen�s and representati�es may en�er upan th� Rea! Property a�k ail
<br /> reasonabie tim�s tn attend to Lender's in�er�s�s and �o inspect the Real Praper�y for purposes af Trus��r's
<br /> compliance with-�he terms and ��nditions �f this Dsed of Trust.
<br /> Compfiance wrfih Gov�rnmental Requiremenfs. Trustar sha�l promptfy comply with all laws, ardinances, and
<br /> regulations, now or her�af�er in e��ect, of all go�ernmental autha�it�es applicable to the us� or o�cupancy of the
<br /> Praperty, including withaut iimitatian, �he AmerEcans With ❑isa�ilEties Act. Trustor may con�est in g�od faith any
<br /> such faw, �rdinance, or re�ulation and withho�d c�mpliance durin� any pro�eeding, incfuding appropriat� appeals,
<br /> so lang as Trustor has no�i�ied L�nder in writing pri�r to doing so and so [ong as, in Lender`s s�le opinian, Lender's
