<br /> Gomplian�e With En►►ironmen#al Laws. Trus�ar represen�s and warrants to Lende�-tha�: ��y During the periad o�
<br /> Trustor's awnership❑#the Proper�y, there has heen n❑ use, g�neration, manufactur�, starage, treatm�nt, disposaf,
<br /> release or #hreaten�d r�lease of any Hazardous 5ubstan�e by any persan on, und�r, abou� or from the Property;
<br /> �2} Trus�vr has no know�edge o�, or reason to belie�e that there has been, except as pre�iously disGlosed tv and
<br /> acknowledged by Lender in wr€�ting, �a3 any hreach or �iafa�ion of any En�ironmental Laws, �b} any use,
<br /> gen�rativn, manufac�ure, storage, treatment, disposa�, re�ease or threa�en�d release �f any Hazardaus 5ubstan�e
<br /> an, under, about or from the Prvper�y by any prior awner� �r �ccupants o� the Property, �r �c� any actuaf or
<br /> threa�ened fitigation or claims a� any kind by any person relating to such matt��s; and �3} Except as pre�iously
<br /> disclosed�o and acknowEedged by Lender in wr�t�ng, �a� nei�her Trus�or nor any tenant, cantractor, ag�nt or v�her
<br /> authorized user of�he Property shall use, generate, manufacture, store, trea�, dispvse ❑�or �elease any Haza�dous
<br /> Substance an, under, abvut flr from the Praperty; and �b� any such acti�i�y shall he conducted in compliance with
<br /> all appl��ab�e federal, s�a�e, and iocal laws, regulations and ordinances, in�luding without iimitation a�1
<br /> En�ironmental La►nrs. Trustor autharizes Lender and �ts agents to enter upon the Prvperty to make such
<br /> inspections and tests, at Trustor's exp�nse, as Lender may deem appropriate �o determine compiiance ❑f the
<br /> P�oper�y with this section of the Deed o� Trust. Any inspections or tests made by Lende� shall be for Lender�5
<br /> pu�poses only and shall not be construed to �reate any r�s��onsibility or liabili�y on�he par�af Lender ta Trustor or
<br /> to any vther person. The representations and warranties contain�d here�n are based on Trustor's due diligence in
<br /> �n�estigating the Property for Hazardous Subs�ances. Trustor hereby {1� �e�eas�s and wai�es any future claims
<br /> against Lender #or �nd�mnity or contribut�on in the ��ent Trustor hecomes liable for cleanup �r o�h�r casts under
<br /> any such laws; and ��� agrees to indemnify, de�end, and hold harmless Lender against any and all claims, losses,
<br /> �iabilities, damages, penalties, and expenses which Lender rnay dir�ctiy o�indi�e�tly sus�ain or suf�er resul�ing fram
<br /> a breach of�his sect�on o�#he Deed of Trust or as a consequence of any use, genera�ion, manu�acture, s�orage,
<br /> d�spvsal, release ar threaten�d re�ease accurring prior ta Trus�or's own�rship�r interest in the Property, whether or
<br /> not the same was or shaufd hav� been known to Trusfivr. The pro�isions ❑f this sect�on of �he Deed o� Trus�,
<br /> includin�the o#�ligation�v indemnify and d�f�nd, sha!!sur�i��the payment vf�he Indebtedness and�he satis�action
<br /> and re��n�eyance of the lien ofi this ❑eed of Trust and shal� not be a##ected by Lend�r's ac�u�sition of any inter�st
<br /> in the Property, whether by fareclosure or❑�herwise.
<br /> Nuisan�e, V1laste. Trustor shall nofi cause, conducfi or permi� any nuisance nQr commit, permit, vr suffer any
<br /> stripping of or waste on or t❑ the Pr�perty or any p�rtion v� the Praperty. Without limiting the generality o� the
<br /> �oregaing, Trustor wil� not remo�e, or grant tv any o�her party �he right ta r�mo�e, any timber, minerals 4incfuding
<br /> �il and gas�, �oal, c�ay, scoria, soil, gra�el ❑r rock products r�vithou�Lend�r's prior written consent.
<br /> Removal o�Imp�o�ements. Trustor shai� not demo�ish or remv�e any Impro�ements fr�m the Real Property withou�
<br /> Lende�'s prior written consent. As a condition�o�he remo�al of any Impro�ements, Lender may require Trusto�to
<br /> make arrangements sa�isfac�ory to Lender to repface such impro�ements wi�h Impro�ements �# a� least �:qual
<br /> �alue.
<br /> Lender`s Right�o Enter. Lende� and Lender's agents and representati�es may enter upon the Real Property at all
<br /> r�asana�le �imes to attend to Lender's int�rests and �a inspec� �he Real Prvperty �or purposes vf Trustor's
<br /> comp�iance with the�erms and conditivns of this ❑��d a�Trust.
<br /> Compliance w�th GaWernmental Requirements. Trustor shaff pramptly comp�y wi�h all faws, ordinanc�s, and
<br /> regulations, naw vr herea�te� in ef#ect, o� all go�ernmental authorities applicable �o �he use �r occupancy of the
<br /> Property, including wi�kh�ut lim�tation, th� Americans 1Nith aisabili�ies Ac�t. Trustvr may contes� in good fa�th any
<br /> such law, ordinance, or regulation and withhofd comp[iance during any pro�eeding, inc[uding appropria'�e appeals,
<br /> so I�ng as Trustor has na�ified �ender in wri�ing prior to doing so and so �ong as, in Lender's sole opinian, Lender's
<br /> int�rests in �he PrQpe�ty are not jeopardi�ed. Lender may require Trustvr to past adequate security or a surety
<br /> bond, reas�nably satisfactary to Lender, to prote�t Lender's in�eres�.
<br /> Du�ty tv Protec�. Trustor agrees neither to abandon or leave unattended the Pr�perty. Trustor shall da al! other
<br /> acts, in addition to fihose ac�s set�orth abo�e in this section, which from the character and use af the Property are
<br /> reasana�fy ne�essary to protec�t and preser�e the Property.
<br /> DUE �N SALE- C�]NSENT BY LENDER. Lender may, a� Lender`s vption, declare imm�diately due and payab�e all sums
<br /> secured by this ❑eed vf Trust upon�he sa�e or�rans#er, withvut Lender`s prior writ�en cQnsent, of all or any part of the
<br /> Rea[ Prope�ty, ar any in�erest in�he Reaf Property. A "saie or trans#er" means the con�eyan�e o� Real Property or any
<br /> righ#, tit[e or interest in the Real Proper�y; whether legaf, k�en��ic�a� or equitable; whether �a�untary ar in�ofuntary,
<br /> whe�her by ou�right sale, deed, installment sale �vn�ract, �and vontract, �ontract fflr deed, leaseh�(d interes� with a
<br /> term grea�er than three �3� years, lease-option cvn�rac�, or by sale, assignment, or�ransfer of any bene�icia� interes� in
<br /> or to any land trust holding titfe t� the Real Praperty, or by any ��her method of con�eyance af an interest in the Real
<br /> Pr�perty. Howe�er, this optian shall not be exercised by Lender i� such exercise �s pr�hihited by federal 1aw or by
<br /> Nebraska law.
<br /> TAiCES AND LIENS. The following pro�isions relating t� the taxes and fiens on the I'roper�ty are part of this Deed af
<br /> Trus�:
<br /> Payment, Trustor sha�l pay when due {and in all ��en�s prior t❑delinquencyy a��taxes, special fiaxes, assessments,
<br /> charges 4including water and sewer�, fines and impasitions Ie�ied against or on a�count vf the Property, and shalf
<br /> pay when due alf claims far wark done on or far ser�i�es rendered ar materia[ furnished to '�he Property. Trus�vr
<br /> shall ma�ntain the Proper�y#ree of a[f liens ha�in� priority v�er ar equal to the in�erest of�ender under this Deed �f
<br /> Trust, �xcept fvr the lien of �axes and assessments n�t dUe and except as o�herwise pro��ded in this Deed of
<br /> Trus�.
<br /> Right tv Contest. Trustvr may withhold paymen�of any tax, assessment, or cla�m in connection w�th a good faith
<br /> dispu�e o�er the ob�igation�o pay, so fong as Lender's in�erest in the Prvperty is not jeopardized. If a lien arises or
<br /> is filed as a result af n�npayment, Trustor shall wi�hin �if�een {��y days after �he lien arises or, if a lien is �iled,
<br /> within �fifteen {15� days afiter Trustor has notice o# the �iling, secure �he discharg� o� the lien, vr if requested by
<br /> Lender, deposit wi�h Lender cash or a suffic�ent corpo�ate su�ety bond or o�her security satis�actvey tv Lender in an
<br /> amount suf�icien�to discharge�he lien plus any costs and attorneys' fees, or o�her�harges that could accrue as a
<br /> result o�a�oreclosure or sale under the lien. In any contest, Trustor shall defend i�self and Lender and sha[I satisfy
<br /> any ad�ers�judgment before en�farcemen�against the Prvperty. Trustor shall nam� L�nder as an additionaf obfigee
<br /> und�r any surety bond �urnished in�he contest proceedings.
<br /> Evidence af Payment. Trus�or shall upon demand �urnish t� L�nder sat�s�actory e�idence vf payment of the fiaxes
<br /> ar assessments and sha�� authorize the appropria�e go�ernmental o��icia� to deli�er to Lend�r at any time a written
<br /> sta�ement of the taxes and assessments against the Property.
