<br />TRUSTEE'S DEED
<br />KNOW ALL MEN BY THESE PRESENTS that GREGORY L. GALLES, is the
<br />Successor Trustee under a Deed of Trust made and entered into on or about July 3, 2013, by and
<br />between MARIO FELIPE BENITEZ and YISELL N. MARTI FONSECA, husband and wife,
<br />Trustors, and U.S. BANK TRUST COMPANY, NATIONAL ASSOCIATION, Trustee,
<br />MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. as nominee for
<br />CharterWest National Bank, Beneficiary. Said Deed of Trust was recorded on July 8, 2013, as
<br />Instrument No. 2013 -05479 of the Mortgage Records of Hall County, Nebraska. Said Deed of Trust
<br />having been assigned by virtue of an Assignment to U.S. BANK NATIONAL ASSOCIATION,
<br />and which was filed for record on June 30, 2014, as Instrument No. 2014 -03913 of the Mortgage
<br />Records of Hall County, Nebraska. GREGORY L. GALLES was appointed Successor Trustee by
<br />virtue of a Substitution of Trustee dated September 10, 2015, and recorded September 21, 2015, as
<br />Instrument No. 2015 -06419 in the Office of the Register of Deeds for Hall County, Nebraska.
<br />GREGORY L. GALLES, Grantor, in consideration of the sum of Sixty -Three Thousand One
<br />Hundred Forty and 00/100 Dollars ($63,140.00) and other good and valuable consideration received
<br />from U.S. BANK NATIONAL ASSOCIATION, does hereby grant, bargain, sell, convey and
<br />confirm unto U.S. BANK NATIONAL ASSOCIATION, (hereinafter "Grantee" where
<br />appropriate), the following - described real property in Hall County, Nebraska, to wit:
<br />THE SOUTHERLY FIFTY FOUR AND SEVEN TENTHS (54.7) FEET OF LOT FOUR
<br />(4), BLOCK TEN (10), KERNOHAN AND DECKER'S ADDITION TO THE CITY OF
<br />GRAND ISLAND, HALL COUNTY, NEBRASKA.
<br />to have and to hold the above - described premises together with all tenements, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />1. That MARIO FELIPE BENITEZ and YISELL N. MARTI FONSECA, as Trustors,
<br />failed to pay to Beneficiary payments which were contractually due, and the Grantor, at the
<br />request of the Beneficiary, elected to declare the entire unpaid principal balance, together
<br />with interest thereon at once immediately due and payable.
<br />2. That a Notice of Default as required by § 76 -1006 was filed by Grantor on September 21,
<br />2015, as Instrument No. 2015 -06420 in the Office of the Register of Deeds of Hall County,
<br />Nebraska. A copy of said Notice of Default was thereafter mailed to all parties entitled to
<br />notice, pursuant to said Deed of Trust and in compliance with § 76 -1008, R.R.S. Nebraska.
<br />3. That the Trustors failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing of the Notice of Default.
<br />4. That a Notice of Trustee's Sale was filed by Grantor on November 12, 2015, as Instrument
<br />No. 2015 -07814 in the Office of the Register of Deeds of Hall County, Nebraska. A copy of
<br />said Notice of the time and place of the sale was thereafter mailed to all parties entitled to
<br />notice pursuant to said Deed of Trust and in compliance with § 76 -1008, R.R.S. Nebraska.
