<br /> Possession and Use. Until the ❑�currence of an E�ent of Defaul�, Trustor may (1} remain in passession and
<br /> cont�ol of#he Prvperty; ��� use,operate or manage the Property; and (3} ca��ec��he Rents�rom the Properiy.
<br /> �uty tv i1�a�ntain. Trus�or shall maintain the Prvperty in tenantable condition and promptly per�arm all repairs,
<br /> rep[acsmen�s,and mainfienance n�cessary to preserve its�alue.
<br /> Comp���nce l�i�h Environmen�ai Laws. Trustor represents and warrants to Lender that: �'1} Durin��he period �f
<br /> Trus�vr's own�rship of fihe Property,there has been na use,genera�ian, manufacture,starage,treatment,dispasaf7
<br /> release ar threatened refease vf any Hazardous Substance by any pers�n an, under, about vr frorn th� Proper-�y;
<br /> ��1 Trustor has no knawledge of, ❑r reason to believe that there has been, except as pre�iausly disclvsed to and
<br /> acknowledged by Lender in writing, �a} any breach o� �iofation of any En�irvnmental Laws, �b� any use,
<br /> generation, manufactu�e, stvrage, trea�ment, dispasal, re�ease ar threa�ened release of any Hazardvus 5ubstan�e
<br /> on, under, abc�ut ar from the Prvperky by any prior owners or oGcupants af the Properly, ar �c� any actual ar
<br /> threatened li�igation or �laims ❑�any kind by any person rela�ing ta such ma�ters; and ��} Excep�as pr��iously
<br /> d�sclased tv and acknvwledged hy Lender in writing, �a} neither Trus#�r nor any�enant,contractvr,agent vr��her
<br /> autho�-i�ed user af the Praperty shall use, generate, manufiacture, stor�, trea�, dispose vf ar reiease any Hazardaus
<br /> Substance an, under, abaut or from the Prvperty;and �b} any such activity shal[be canducted in comp�iance with
<br /> ali applicable federal, state, and local laws, regulations and ordinances, including withaut limita�ion al[
<br /> Environmental Laws. Trus�or authari�es Lender and i�s agents to enter upan �he Property to make such
<br /> inspections and #ests, at Trustor's expense, as Lender rnay deem appropriate �v determine campliance of the
<br /> Prop��y wi�h �his section o�the De�d of Trust. Any inspections o�tests made by Lend�r shall �e for Lender's
<br /> purpvses only and sha[� not be cons�rued to create any respansib����nr liability on�he part vf Lender�Q Trus�or or
<br /> to any�ther person. The representa�ions and warranties con�ained herein are ba�ed vn Trustor's due diEsgence in
<br /> in�estigating#he Property for Ha�ardous Substances. Trustor hereby �1� releases and waives any fufure claims
<br /> against Lender far indemnity or con�ribu#�on in �he e��n�Trustar becames liabfe#or �leanup or ather cvs�s un��r
<br /> any such iaws; and ��} agrees to �ndemnify, de�end, and hv�d harmless Lender again�t any and a�l claim�, losses,
<br /> liabi[ities, damages, penalties, and expenses which Lende�-may direGtly or indirec�ly sustain or suf�er resu�ting frvm
<br /> a breach of this sec�ian ❑f the Deed of Trus�or as a�onsequence❑f any use, gene�-ation, manufac�ure, starage,
<br /> dispvsa�, release nr threatened release accurring priar to Trustor's awnership vr interest in�he Property,wh�ther ar
<br /> nat the same was ❑r shou�d ha�e been knnwn t❑ Trustor. The pra�isions of th�s se�ti�n ❑��he aeed af Trust,
<br /> including th�❑bligation�o indemnify and defend,shall survi�e the payment af the �ndebtedness and fihe satisfaction
<br /> and r�con�eyance af�he lien of this Deed af Trust and shall no#be affeGfied by Lender's acquisi�ian of any inter�st
<br /> in the Property,whether by fareclosure or vtherwise.
<br /> Nuisance, 1Naste. Trus�or Shaff not cause, conduct vr permit any nuisance nor �ommit, permit, vr suffer any
<br /> stripping �f or was�e on ❑r fo the Property ❑r any pvrtic�n af the Property. Without limi�ing �he generaf�ty of the
<br /> farego�ng, Trus�or will not remove, ar grant ta any ath�r party�he right to �emo�e, any�imber, minerals�including
<br /> oil and gas}, caa1,clay, scoria, soil, gra�el or rock prvducts withvut Lender's prior written consent.
<br /> Remarra[of lmpravements. Trus�or shall not demolish vr remn�e any�mpra�ements frvm the Real Property wi#haut
<br /> Lender`s priar w�-i��en cansent. As a�andition ta the remo�al vf any lmpro�ements, Lender may require Trustar to
<br /> make arrangemen�s satisfa��ory �� Lender to replace such Impro�ements with �mpra�emeri�s af at least equa�
<br /> �alue.
<br /> Lender's Right ta Enter. Lender and Lender's agents and representatives may en�er upon the Reai Property at all
<br /> reasonable times �o attend to Lender's interests and ta inspect the R�ai Property �or purposes of Trustor's
<br /> cvmpliance with the terms and candi�ions of�his ❑eed vf Trust.
<br /> Camp�iance w'rth Go�ernmental Requirements. Trustor shall pramptiy camply with all laws, ordinances, and
<br /> regula#fans, naw or herea�ter in �ffec�, of all go�ernmental au�horities applicable �v the us� or occupan�y vf the
<br /> Praperty, includ�ng withou��imitation,the Ame�icans V1lith Disahslities Act. Trustv� may contest 4n goo�i faith any
<br /> such faw, ordinan�e, ar regulation and withhald �ompliance during any prviceeding, �ncluding approp�iate appeals,
<br /> sa lang as Trustar haS notified Lender in wrifing prior to doing s�and s❑long as, in Lende�'s sale❑pinian, Lende�`s
<br /> interests in �he Praperky are not jevpardized. Lender may require Tr-ustvr tv past adequate securi�y or a surety
<br /> bond, reasona�aly safisfac�ory tv Lender,ta protec�Lender'�interest.
<br /> Dufy �v Pr��ect, Trustor agrees neither to abandon ar [eave unattended the Property. Trustor shall da all ather
<br /> ac�s, �n addition to those acts set f�rth abv�e in this sec�i�n,whi�h�rvm the�haracter and use of the Property are
<br /> r�asonably necessary t❑ pro��ct and preserve the Property.
<br /> TAXES AND �tENS. The follvwing p�o�isivns relating to the �axes and liens ❑n the Property are part of this Deed of
<br /> Trust:
<br /> Rayment. Trustor shail pay wh�n due�and in a�l even�s prior t❑ delinquency}a�l taxes,spe�ial taxes, assessm�nts,
<br /> �harges �in�luding►rva�er and sewer}, f�nes and impflsi��ans le�ied against or on a�cQunt❑f the Property, and shall
<br /> pay when due�II ciaims fvr wark dvne an or for senrices rendered ❑� material furnished tv #he Praperty. Trustar
<br /> shall ma�ntain the Property free of a�l �iens having priority❑�er or equal�o�he in#erest of Lender under this ❑eed ofi
<br /> Trust, except for the lien of taxes and assessmen�s nat due, except for the Existing lndebtedness referred ta
<br /> be�ow, and except as otherwise provided in this�eed af Trust.
<br /> Fiigh#tv Contes�, Trustar may withholci payment❑f any tax, assessment, or claim in cannec�ion with a good fa��h
<br /> dispute o�er the❑aligation�a pay, so lang as Lender's interest in the Property is na�je�pardized. [f a lien a�ises or
<br /> is filed as a result af nonpayment, Trustar shall within fifteen �'i 5� days af�e�the lien arises or, if a lien is filed,
<br /> within fifteen (�5} days after Trusfor has notice �f the filing, secure�he discharge ❑f the lien, or if requested by
<br /> Lender,dep�si�with Lender cash or a suf��cient corp�rate su�e�y band ar ather security satisfac�ory to Lender in an
<br /> amount suff�ci�nt to dis�harge the[ien pfus any cos�s and attorneys'fees, vr other charges that cvuld accrue as a
<br /> resu�t af a foreclosur�or sale under�the�ien. �n any contest, Trustor shall deten�i itse�f and Lende�and shall safisfy
<br /> any ad�erse judgment before enfvrcement against the Property. T�ust�r Shall name Lender as an additiona!obiigee
<br /> under any surety bond furnished in the contest proceedings.
<br /> Evidence o�Payment. Trus�or shaii upan demand furnish fin Lender satisfactvry e�idence v�payment of�he�axes
<br /> vr assessments and shall authorize the appropriate ga�ernmen�al afficial to deli�er to Lender at any time a written
<br /> sta�ement af the�ax�s and assessments against the Property.
<br /> Notice of Construction. Trus�or shall notify Lender at least fifteen t�5} �ays befiore any work is�Qmmenced, any
<br /> services are furn�s�ed,or any materials are supplsed�fl �he Prope�ty, if any mechan�c's�'ten, materfalmen's lien, or
<br /> other lien could be asserted on accvunt af the �rvork, ser�ices, or mate�rials. Trustvr wil� upvn requ�st of Len�ier
<br /> furnish ta Lender ad�ance assurances satis�actory to L�nder that Trus�or can and �rviil pay the c�s� of such
<br /> �mprovemen�s.
<br /> PR�PERTY DO�f�IA�E IIVSVRAIVCE. The fof�vwing proWisions relating#v insuring the Prape�ty are a part❑f thi$ Deed vf
<br /> Trust.
<br /> Maintenance �f lnsurance. Trustor shall procure an� maintain policies a��ire insurance wi�h standard extend�d
