<br /> wi�hou� limita�3on, howe�er subjec�to any limits under applicable law, Lender's attorneys' fees and Lender's legal

<br /> �including ef�or�ts to modify or�aca�e any automa�ic stay❑r injunc�ionf, appeals, and any an�icipa�ed post-judgment

<br /> Trus�or also will pay any court costs, in addit�an to all other sums pro�ided by law.
<br /> Rights of Trustee. Trus�tee shall ha�e all ❑f�he righ�s and du�ies o�Lender as se�for�h �n this section.
<br /> P�WERS AND �6LfGATf�NS �F TRl1STEE. The following pro�isions relat�ng �o the powers and obligations o�Trustee
<br /> are par�o�this [�eed o�Trus�t:
<br /> Powers of Trustee. In add��ion to all powers ❑f Trus�ee ar�sing as a ma��er o�law,Trus�ee shall ha�e�he power t❑
<br /> take �he following actions wi�th respec�to the Proper�ty upon the wri��en request of Lender and Trus�or: �a7 join in
<br /> prepar�ng and �il�ng a map or pla� ❑� the Real Proper�y; �ncludEng �he dedEcation o� streets or o�ther rights to the
<br /> public; �b7 join �n granting any easement or crea�ing any res�rict�on on the Real Proper�ty; and �cf join in any
<br /> subord�na��on or❑�ther agreemen�t affec�ing th�s i�eed o�Trus�t or the in�teres�o�Lender under�his i�eed ❑�Trust.
<br /> Trustee. Trustee shall mee� al! quali�ica��ons requ�red for Trustee under appl�cable law. In addi�tion �❑ �he rights
<br /> and remed�es set for�h abo�e. w��th respec� �o all or any par� of �he Property. the Trustee shall ha�e �he r�ght �o
<br /> �oreclose by no�ice and sale. and Lender shall ha�e �he right to foreclose by judic+al �oreclosure, in e�ther case �n
<br /> accordance w��h and to the full extent pro�ided by applicable law.
<br /> Su��essor Trustee. Lender, a� Lender's aption, may�rom time�❑ time appo�nt a successor Trus�ee�o any Trus�ee
<br /> appo�n�ed under this I�eed of Trust by an instrument executed and acknowledged by Lender and recorded in �he
<br /> o���ce o� �he recorder o� HALL �oun�y, S�ate of Nebraska. The instrumen� shall contain, in addit�on to all other
<br /> ma�ters requ�red by s�tate law, the names of �the original Lender, Trus�ee, and Trus�or, �he book and page 4or
<br /> computer system referencef where �this i�eed of Trust �s recorded, and the name and address ❑f �he successor
<br /> trustee, and the�nstrumen�shall be execu�ted and acknowledged by all the beneficiar3es under�his I�eed of Trust or
<br /> �their successors in �n�eres�. The successor trus�ee, w��hou�t con�eyance of the Property, shall succeed to all �he
<br /> ti�le, power, and duties conferred upon�the Trus�tee in�his i�eed of Trust and by appl�cable law. This procedure for
<br /> subst��u�ion❑�Trus�ee shall go�ern�o the exclus+on o�all o�her pro�isions�or subs�i�u�ion.
<br /> N�TfCES. Any not�ce required �o be g��en under this i�eed of Trus�, including wi�hou� limi�a�ion any notice o� default
<br /> and any no�ice o�sale shall be gi�en En writ�ng, and shall be e�fec�i�e when actually del��ered, when ac�ually recei�ed
<br /> by tele�acsimile �unless o�herwise required by lawf, when depos�ted with a nat�onally recogn�zed ❑�ernight courier, ❑r, if
<br /> mailed, when deposi�ted �n�he Uni�ted S�ta�es ma�l, as first class, certi�Eed or registered ma�l postage prepaid, direc�ed �❑
<br /> the addresses shown near�he beginning of�his i�eed ❑�Trus�. All copies of no�ices ❑f foreclosure from the holder of
<br /> any lien which has priori�y o�er �his I�eed o� Trus� shall be sent �t❑ Lender's address, as shown near �the beginn�ng of
<br /> this I�eed of Trust. Any par�y may change i�s address for no�ices under �his i�eed ❑f Trust by g��ing �ormal wri��en
<br /> notice t❑ the other parties, specifying �hat the purpose of �he notice �s to change the party's address. For notice
<br /> purposes, Trustor agrees �❑ keep Lender informed a�t all times of Trustor's current address. Unless otherwise pro��ded
<br /> or requEred by law, ���here is more�han ❑ne Trustor, any no�ice gi�en by Lender to any Trus�or is deemed to be no�ice
<br /> gi�en to all Trustors.
<br /> MISCELLANE�l1S PR�ViSi�NS. The�ollowing miscellaneous pro�3s�ons are a part o�th�s I�eed of Trust:
<br /> Amendmen#s. This I�eed o�Trus�.�ogether wi�h any Rela�ed i�ocuments, cons�i�u�es the entire understanding and
<br /> agreement of�he par�ies as �to �he ma��ers se� far�h �n �h�s I�eed of Trus�. No al�era�ion o� or amendment to this
<br /> i�eed of Trus�shall be effecti�e unless gi�en in wri��ng and s�gned by�he party or parties sough�to be charged or
<br /> bound by�he altera�ion or amendmen�.
<br /> Annuai Reports. If �he Proper�y is used �or purposes other �han Trustor's res�dence, Trus�or shall furnish to
<br /> Lender, upon reques�, a cer�ified s�a�ement of ne�t opera�ing income recei�ed from �he Proper�y during Trus�tor's
<br /> pre�ious �iscal year in such form and de�ail as Lender shall requ�re. "Ne� opera�ting income" shall mean all cash
<br /> rece�p�s from�he Proper�y less all cash expendi�ures made in connec�ion w�th the opera�ion of�he Property.
<br /> Caption Headings. �ap�ion headings in th�s I�eed o� Trus� are for con�enience purposes only and are not t❑ be
<br /> used�o in�erpret or de��ne�he pro�isions of�his i�eed of Trust.
<br /> Merger. There shall be no merger of the in�erest or es�ate crea�ed by�his i�eed o�Trust with any o�her interest or
<br /> es�a�e +n�he Property at any�ime held by or for�he benefi�of Lender En any capac3�y, wi�hout�he written consen�
<br /> of Lender.
