[Signature Page Follows] <br />2 <br />201000503 <br />terminates it at the end of the then current terns by giving the LESSOR written notice of the intent <br />to terminate at least six (6) months prior to the end of the then current term. <br />2. LESSOR hereby leases to LESSEE a portion of that certain parcel of property (the entirety of <br />LESSOR's property is referred to hereinafter as the Property), located at Stuhr Road S & Former <br />Park Road E, Grand Island, Hall County, Nebraska, and being described as a 32' by 52' -6" parcel <br />containing approximately 1,683 square feet (the "Land Space "), together with the non - exclusive <br />right (the "Rights of Way ") for ingress and egress, seven (7) days a week twenty -four (24) hours a <br />day, on foot or motor vehicle, including trucks over or along a twenty -two foot (22') wide <br />right-of-way extending from the nearest public right-of-way, S Stuhr Road, to the Land Space, and <br />for the installation and maintenance of utility wires, poles, cables, conduits, fiber optic cables and <br />pipes over, under, or along a twenty foot (20') wide right -of -way, or more rights of way ( "Further <br />Rights of Way ") from the Land Space, said Land Space, Rights of Way and Further Rights of Way <br />(hereinafter collectively referred to as the "Premises ") being substantially as described herein in <br />ExhibitA -1 attached hereto and made a part hereof. The Property is also shown on the Tax Map of <br />Hall County and is further described in Warranty Deed recorded as Instrument No. 201201220 in <br />the Office of the Hall County Register of Deeds. The Parties agree that LESSEE shall use the <br />Premises for the purpose of constructing, maintaining, repairing and operating a communications <br />facility and uses incidental thereto and not for any otherunrelated purpose. <br />3. The Conunencement Date of the Agreement, of which this is an Amended Memorandwn, is <br />October 1, 2014. <br />4. LESSEE has a limited right of first refusal to purchase the Premises during the initial terns and all <br />renewal terms of the Agreement. <br />5. The terms, covenants and provisions of the Agreement, the terms of which are hereby <br />incorporated by reference into this Amended Memorandum, shall extend to and be binding upon <br />the respective executors, administrators, heirs, successors and assigns of LESSOR and LESSEE. <br />
