KNOW ALL MEN BY THESE PRESENTS, that Larry L. and Patricia A. Sadd, or <br />their heirs, successors, or assigns, hereinafter referred to as "GRANTOR ", for valuable <br />consideration, does hereby give grant and convey unto Robert E. and Audrey M. <br />Brummund, or their heirs, successors, or assigns, "GRANTEE ", a perpetual easement and <br />right -of -way over, across, under, through and upon the following- described real estate <br />owned by the GRANTOR, to -wit: <br />A tract of land in the South Half of the Northwest Quarter (S 1 /2NW 1 /4) of <br />Section 36, T. 10, N. R. 9W. of the 6t'' P.M., in Hall County, Nebraska, <br />described as follows: Commencing at the Northwest corner of said tract, <br />thence Easterly along and upon the Northerly boundary thereof a distance of <br />435.6 feet; thence Southerly and parallel with the Westerly side of said tract <br />and at right angles a distance of 200 feet; thence Westerly at right angles <br />and parallel with the Northerly side of said tract a distance of 435.7 feet; <br />thence Northerly along and upon the center of the road West of said tract a <br />distance of 200 feet to the point of beginning. <br />for the use and benefit of that re4l estate owned by the GRANTEE described as: <br />Part of E1/2 NE1 /4 NW1 /4, and N1/2 NE1 /4 of 35 -10 -9, Hall County, NE <br />Said easement includes, but is not limited to, the right to install, construct, maintain, <br />replace and operate an underground irrigation pipeline or pipelines by the GRANTEE <br />within the described easement area in connection with GRANTEE'S use of irrigation water <br />from a well located upon other real estate. It is further provided that said easement shall be <br />deemed to provide GRANTEE with all rights of ingress and egress necessary for the full <br />and complete use, occupation and enjoyment of the easement hereby granted, including the <br />right to excavate and refill ditches and trenches for the location of said underground <br />irrigation pipeline or pipelines and utilities or appurtenant structures related thereto. <br />To have and to hold the same unto the said GRANTEE, its successors and assigns as <br />appurtenant to the land and every part thereof; and GRANTOR hereby dedicate its <br />interests in said real estate to the use of the GRANTEE. This easement is perpetual and <br />shall run with the land. <br />The GRANTOR does hereby covenant with the GRANTEE that it is lawfully <br />seised and possessed of the real estate described herein; that it has a good and lawful right <br />to convey it; that it is free from encumbrance; and that it will forever warrant and defend <br />the title thereto against the lawful claims of all persons whomsoever. <br />Dated this F4 day of <br />Larry L.
