<br />COMES NOW, the undersigned, being first duly sworn upon oath, and deposes and states
<br />that the undersigned knows the Decedent and the surviving spouse of the Decedent and that the
<br />following information is true and correct.
<br />1. Name of Decedent: Edward L. VanWinkle
<br />Date of Death: February 26, 2014
<br />Domicile at Death: Cairo, Hall County, Nebraska
<br />Name of Surviving Spouse: Judith Ann VanWinkle
<br />Date of Marriage: June 1, 1958
<br />2. The Affiant is the attorney for the Decedent and, in that capacity, is familiar with the
<br />marital status and the death of the Decedent.
<br />3. That there is no federal estate tax, Nebraska inheritance tax or Nebraska estate tax due.
<br />4. Title to the following described real estate is held by the Decedent and the surviving
<br />spouse in joint tenancy, to -wit:
<br />The Southeast Quarter (SE1 /4) of Section Twenty -Eight (28), Township Twelve (12)
<br />North, Range Twelve (12), West of the 6` P.M., Hall County, Nebraska,
<br />EXCEPTING THEREFROM a tract of land described as follows: commencing at the
<br />Southwest Corner of said Southeast Quarter (SE1 /4) thence N88 °49'42 "E on the
<br />south line of said Southeast Quarter (SE1 /4) and on an assumed bearing (and all
<br />bearings contained herein are relative, thereto;) a distance of 717.75 feet to the
<br />point of beginning; thence NO2 °24'35 "W a distance of 300.15 feet; thence
<br />N30 °59'28 "E a distance of 1106.00 feet; thence S00 °00'19 "W a distance of
<br />1236.61 feet to the south line of the Southeast Quarter (SE1 /4); thence
<br />S88 °49'42 "W a distance of 556.86 feet to the place of beginning, and EXCEPTING
<br />THEREFROM a tract deeded to County of Hall, State of Nebraska, and more
<br />particularly described as All of a certain tract in the Southeast Quarter of the
<br />Southeast Quarter (SE1 /4SE1/4) of Section Twenty Eight (28), Township Twelve
<br />(12) North, Range Twelve (12), West of the 6 P.M., more particularly described as
<br />Beginning at a point 33.0 feet north and 33.0 feet west of the southeast corner of
<br />said section; running thence west, parallel to the south line of said section, 33.0
<br />feet; running thence north, parallel to the east line of said section, 367.0 feet;
<br />running thence North Nine degrees Twenty Two minutes West, (N9 °22'W), 202.7
<br />feet; running thence east, parallel to the south line of said section, 66.0 feet, to the
<br />present roadway right of way line; running thence, south, parallel to and 33.0 feet
<br />westerly from, the east line of said section, 567.0 feet, to the place of beginning;
<br />containing 0.50 acres, more or less, to be used for highway and channel change
<br />purposes.
<br />5. As of the date of death, the real estate had a fair market value of $1,028,365.
<br />6. The Decedent and the surviving spouse were married as of the date of death. There
<br />is no Nebraska inheritance tax lien by reason of Nebraska Revised Statute §77 -2003.
