PACKER and <br />DEBORAH L. PACKER, Husband and Wife, hereinafter called the GRANTORS; in <br />consideration of Six Hundred Twenty -Eight Dollars and Seventeen Cents ($628.17), <br />receipt of which is hereby acknowledged, does hereby give, grant, and convey unto the <br />CITY OF WOOD RIVER, NEBRASKA, a municipal corporation, GRANTEE, a perpetual <br />easement and right -of -way over, across, under, through, and upon the following - <br />described real estate, to -wit: <br />See attached EXHIBIT "A" for legal description of easement area. <br />CO <br />CL) <br />- -n <br />Said easement includes but is not limited to the right to install, construct, <br />maintain, replace, and operate public utility facilities by the GRANTEE in, on, over, or <br />under the described easement area in connection with its public utility systems. It is <br />further provided that said easement shall be deemed to provide GRANTEE with the <br />right of unrestricted access to its public utility facilities by ingress and egress over, <br />across, through, and under the lands described herein, together with all rights of ingress <br />and egress necessary for the full and complete use, occupation, and enjoyment of the <br />easement hereby granted, including the right to excavate and refill ditches and <br />trenches for the location of said facilities and appurtenant structures related thereto, and <br />hereby prohibiting the planting of trees, bushes, and shrubs, or placing other <br />obstructions, in, upon, above, along, over, across, underneath, and through the <br />easement area. <br />To have and to hold the same unto the said GRANTEE and its successors and <br />assigns as appurtenant to the land and every part thereof; and GRANTORS hereby <br />dedicate their respective interests in said real estate to the use of the GRANTEE.
