<br />KNOW ALL MEN BY THESE PRESENTS, that Rick L. Houchin and Minerva Houchin,
<br />husband and wife, and Javier T. Rojas and Sylvia Rojas, husband and wife, GRANTOR
<br />(whether one or more) for valuable consideration, receipt of which is hereby acknowledged, do
<br />hereby give, grant, and convey unto the CITY OF WOOD RIVER, NEBRASKA, a municipal
<br />corporation, GRANTEE, a perpetual easement and right -of -way over, across, under, through,
<br />and upon the following- described real estate, to -wit:
<br />A tract of land comprising a part of Lot Nine (9), County Subdivision of
<br />part of the Southeast Quarter (SEY4), of Section Nineteen (19), Township Ten
<br />(10) North, Range Eleven (11) West of the 6 P.M., in the City of Wood River,
<br />Hall County, Nebraska, more particularly described as follows:
<br />Beginning at the southwest corner of the Northwest Quarter of the
<br />Southeast Quarter (NW %SE %); thence running northerly on the west line of said
<br />Southeast Quarter (SEY4), on an Assumed Bearing of N00 °05'15' W, a distance
<br />of Four Hundred Nineteen and Sixty Two Hundredths (419.62) feet, to a point on
<br />the southerly right of way line of the Union Pacific Railroad; thence running
<br />N68 °37'06 "E, on the southerly right of way line of the Union Pacific Railroad, a
<br />distance of Five Hundred Fifty Eight and Eighty Nine Hundredths (558.89) feet, to
<br />the ACTUAL Point of Beginning; thence continuing N68 °37'06 "E, on the
<br />southerly right of way line of the Union Pacific Railroad, a distance of Eighty
<br />Eight (88.00) feet; thence running S89 °22'54 "E, a distance of Fifty Seven and
<br />Ninety Two Hundredths (57.92) feet; thence running S00 °05'41 "E, a distance of
<br />Eight and Eighty Five Hundredths (8.85) feet; thence running southwesterly
<br />parallel with the southerly right of way line of the Union Pacific Railroad, a
<br />distance of One Hundred Fifty and Seventeen (150.17) feet; thence running
<br />N00 °05'30' W, a distance of Thirty Two and Thirty One Hundredths (32.31) feet,
<br />to the ACTUAL Point of Beginning and containing 0.088 acres (3833 Sq. Ft.)
<br />more or less.
<br />Said easement includes but is not limited to the right to install, construct, maintain,
<br />replace, and operate underground public utility facilities by the GRANTEE within the described
<br />easement area in connection with its public utility systems. It is further provided that said
<br />easement shall be deemed to provide GRANTEE with the right of unrestricted access to its
<br />public utility facilities by ingress and egress over, across, through, and under the lands
<br />described herein, together with all rights of ingress and egress necessary for the full and
<br />complete use, occupation, and enjoyment of the easement hereby granted, including the right
<br />to excavate and refill ditches and trenches for the location of said facilities and appurtenant
<br />structures related thereto, and hereby prohibiting the planting of trees, bushes, and shrubs, or
<br />placing other obstructions, in, upon, above, along, over, across, underneath, and through the
<br />easement area.
<br />It is further provide that said easement shall be deemed to provide to GRANTEE the
<br />right to install, construct, maintain, replace, and operate overhead power lines on the lands, and
<br />to cut and trim trees and shrubbery to the extent necessary to keep them clear of said electric
<br />line, and to cut down from time to time all dead, weak, leaning or dangerous trees that are tall
<br />enough to strike the wires in falling. It is further provided that said easement shall be deemed to
