• AGREEMENT 20/508740 This Agreement is made and entered into this 30 day of October, 2015 by and between Patty Jo Cummings, Lynn Drudge, Rhonda Longenecker, and Jodie Soto, hereinafter referred to as "Sellers ", and Doyle Jantzi, of Hall County, Nebraska, hereinafter referred to as "Buyer ". WITNESSETH: The Sellers are the owners of a tract of land consisting of 5.56 acres, more or less, all as more particularly described on Exhibit A attached hereto and incorporated herein by this reference; and WHEREAS, the Sellers desire to convey to Buyer the property described on Exhibit A, and in return therefore, will be allowed to have use of an irrigation well situated on land owned by Buyer on real estate described on Exhibit B attached hereto and incorporated herein by this reference. NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: 1. Incorporation of Recitals. Recitals above made are incorporated into the body of this agreement and are made a material part hereof by this reference. 2. Trade of Real Estate for Well Usage. Sellers hereby convey to Buyer the real estate described on Exhibit A, and Buyer, in return therefore, shall allow the Sellers use of an irrigation well located on Exhibit B attached hereto. 3. Maintenance of Well: Whichever party, or a party's successor, who is using the well shall be responsible for well maintenance and repair. 4. Public Record. This Agreement shall be indexed against the legal descriptions to the tracts of real estate shown on Exhibit A and Exhibit B, and the Sellers shall have use of the irrigation well located on Buyers property for the life of the well casing. The parties agree that upon expiration of the term (i.e. either by abandonment or by obsolescence or replacement of the well casing) the parties agree to sign a document indicating said fact, releasing the license that the Sellers have on the use of Buyers well, and index the same against the legal description of the real estate. 5. Binding Effects. This Agreement shall be binding upon the parties hereto and their respective successors and assigns.
